The Board of County Commissioners of Indian River County,
Florida, met in regular session at the Courthouse, Vero Beach, Florida
on Wednesday, September 20, 1967, at 8:30 A. M. Present were Robert
W. Graves, Chairman; Donald Macdonald, Richard P. Bogosian, Jack U..
Dritenbas, D. B. McCullers,Jr. Also present were Jack G. Jennings,
County Administrator; Sherman N. Smith, County Attorney; and Ruth
Elliott and Janet Burriss, Deputy Clerks.
Mrs. Ethel O'Brien, Executive Director of the Economic Opportunity
Council appeared before the Board to report on the progress of the
Child Development Project for Indian River County. She Stated that
there were five centers in operation with 240 children enrolled. Mrs.
Pit= Bergey, Chairman of the Neighborhood Center Committee was also
present and informed the Board of the plans of?the Catholic Church
to construct a building on their property on South Gifford Road, in
which the EOC may work, and also they hope to develop a recreational
facility for Gifford on that property.
/Motion was made by Commissioner Bogosian, seconded by Commissioner
Macdonald and unanimously carried, that the Board go on record as
commending these ladies for the work they have done and they will
continue to do; and, in addition, a commendation for the Catholic
Church and for the efforts they are making to establish a community
center in Gifford.
Motion was made by Commissioner Macdonald, seconded by Commissioner
McCullers and unanimously carried, that the Administrator be authorized
to make the necessary surveys and have an easement prepared for a 20'
easement through the property of Mr. Andrew Wood in Winter Beach.
Sec 10-T32-S-Rge 39E.
The Board received a request from the Mt. Zion A.M.E. Church in
Gifford, 4221 28th Avenue, requesting that a street light be installed
near the site of their church. The Administrator reported that it
does not meet the criteria that the County has been operatlinT under
for the installation of street lights. The Board denied the request.

Mr. Floyd Wilkes, representing the Babe Ruth Baseball League stated
that they are in need of approximately 15 loads of dirt for the lighted
baseball field being built on the beach on city -owned property and
requested that the County furnish same.

After discussion, Commissioner Bogosian moved that the City of
Vero Beach be allowed to take whatever dirt they feel is necessary
for use at the Babe Ruth Baseball Field and that the City haul the
dirt. If they are unable to do so, the County will haul it.
Rosemary Richey, Supervisor of Elections, appeared before the
Board advising that it will be necessary to change the polling places
in several of the precincts. After discussion, On Motion by Commissioner
Macdonald, seconded by Commissioner McCullers, the following Resolution
was unanimously adopted:

BE IT RESOLVED by the Board of County Commissioners of
Indian River County, Florida, acting upon the recommendation and approval
Of the Supervisor of Elections of that county, that the prior resolutions of
this Board establishing each election precinct, district and polling place in
this county are herewith amended in order that the polling places shall here-
after be at the place hereinafter stated for each of the precincts hereinafter
named, to -wit:
Election Precinct 3-B. Polling Place; Asbury Methodist Church
Election Precinct 4-A. Polling Place: Citrus Elementary School
Election Precinct 5-B. Polling Place: Rockridge Community
Building
and,
BE IT FURTHER RESOLVED that the polling places for all other
election precincts shall remain as heretofore designated and all election
precincts shall remain as hereinbefore designated.

The Board discussed at length Chapter 67-2199 dealing with
mailed questionnaires to prospective jurors. No action was taken.
At this point, the Board was informed of the death of former
County Commissioner J. J. P. Hamilton, and members of the Board stood
in a moment of silent prayer. On Motion by Commissioner Macdonald,
seconded by Commissioner McCullers, the following Resolution was
unanimously adopted:
RESOLUTION NO. 67-56
• WHEREAS, this Board has been advised while in session that the
Honorable J. J. P. Hamilton is dead and the members of this Board desire to
make a matter of record his public service and to extend their condolences
to his widow and children; Now, therefore,
THIS MEMORIAL RESOLUTION is adopted by the Board of County
'Commissioners of Indian River County, Florida, honoring a past member of
this Board who devoted twenty-one (21) years of service to the citizens of
this County as a member of the Board of County Commissioners, for which
this Board, for itself as well as for the people of Indian River County, does
hereby make this public record of this long and faithful service and the
sorrow of the members of this Board on his death and their expression of
sympathy to his widow and children in their bereavement; and,
BE IT FURTHER RESOLVED that a certified copy of this Resolu-
tion be forwarded to Mr. Hamilton's widow and to each of his children.

, the following Resolution was adopted.
WHEREAS, the State Road Department has located and proposes to construct and
improve State Road 512 ,Section 880114-2508 in Indian River
County, Florida; and
WHEREAS, in order for'.the State Road Department to further and complete said'
projectg it is necessary that certain lands now owned by: Indian River
County be acquired by the State of Florida for the use and benefit'of the State
Road Department of Florida; and
WHEREAS, the State Road Department having requested said County to execute
'and deliver to the State Road Department a deed or deeds in favor of the State
of Florida, conveying all nights, title and interest that said County has in and
' to said lands required for right of way for said State Road, end•said request
having been duly. considered.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of said
County that the Chairman and Clerk of said Board be and they are hereby authorized
and directed to make, execute and deliver to the State Road Department a deed or
deeds in favor of the State of Florida conveying all right, title and interest of
said County in and to said lands owned by said County required for right of way
for said State Road.
BE IT FURTHER RESOLVED that a certified copy of this Resolution be forwarded
.forthwith to the State Road Department at Tallahassee, Florida.

The County Administrator reported that City of Vero Beach Fire
Chief, Guy Sullivan advised him that the 1953 fire truck which was in
the name of Indian River County had been taken out of service because
of an unavailability of partsfbecause of its age was unsafe; and that
it had been delivered to the County Barn and was being used as a back-
up truck behind the ditch -burning rig.
On Motion by Commissioner Macdonald, seconded by Commissioner
Bogosian and unanimously carried, the Administrator was authorized
to renew the maintenance agreement for three typewriters in his office
at $37.98 each.
Motion was made by Commissioner Macdonald, seconded by Commissioner
McCullers, and unanimously carried, that the request of Bain's Electronics,
per letter of September 5, to erect lines on County easements in Ixora
Park Subdivision for Educational Television Programs was approved.
Motion was made by Commissioner Dritenbas, seconded by Commissioner
'Macdonald and unanimously carried, that the sealing and water -proofing
of all windows in the north end of the Courthouse Addition be authorized
with Netto Construction Company for $100.00.
At the request of the Administrator and discussion which included
the fact that the Citrus Elethentary School is located on 27th Avenue,
Commissioner Macdonald moved, seconded by Commissioner Bogosian and it
unanimously carried, that the present priority of acquiring right-of-
way for proposed construction during the coming year be:
No. 1 --Emerson Avenue (27th Avenue)
No. 2 -- Clemanns Avenue (43rd Avenue)
The annual report of the Indian River County Fire Control Unit,
of the Florida Board of Forestry for the period July 1, 1966 through,
June 30, 1967 was received.
Commissioner Dritenbas suggested to the Board that he thought
the County, in order to eliminate drainage problems, should make it
mandatory that a permit be obtained for putting in .a driveway culvert,
so that the County could establish the size of the pipe and the grade..
In that way the County can be assured that the grade conforms to the
grade on the plat. Commissioner Dritenbas also stated that he thought

the County should make a survey of .all of the drainage problems caused
by culverts which are improperly laid, and that the owners be notified
that they will be taken out. After considerable discussion in the
matter, the Administrator stated that his office will make an effort,
as each building permit is issued, the people will be advised on the
permit, that if a driveway is constructed which requires a,pipe, the
County should be called to set the grade and determine the size of the
pipe.
On motion by Commissioner Macdonald, seconded by Commissioner
Dritenbas and unanimously carried, Gladys Vigliano, County Welfare
Worker, and Anne Smith were authorized to attend the Florida Association
of County Welfare Executives Convention in Clearwater on October 22nd
through October 25th.
The Sheriff filed with the Board a statement of his appointment
of Anderson Johnson Jr. as a Deputy Sheriff, whose voting precinct is
No. 1C and which was presented to the Board. On motion by Commissioner
McCullers, seconded by Commissioner Macdonald and unanimously carried,
the bond of said Deputy Sheriff was approved and order filed with the
Clerk of the Circuit Court.
Mr. Luigi Oddo appeared before the Board stating that he wanted to
change his airport from a restricted to a private airport, in order that
his friezids might use it. After considerable discussion, Motion was
made by Commissioner Macdonald, seconded by Commissioner Dritenbas and
unanimously carried, that the Administrator be instructed to advise the
Federal Aviation Agency and the Florida Development Commission that
the present Zoning Regulations of the County which are applicable to
the area -now occupied by Mr. Luigi G. Oddo as an airport, do not prohibit
the use of that property as a private airport to be used primarily by
Mr. Oddo but which may be made available by him to others on his invitation;
but, the Zoning Regulations do prohibit a public airport in that area
and do prohibit the operation of any business, airport -related or other-
wise, in that area.

Mr. Henry Thompson appeared before the Board stating that he knew
of a doctor with a trailer who could stay at the Sebastian Inlet
Park permanently and take care of any minor injuries. The Board
informed Mr. Thompson that he and his family were the only ones
authorized to reside there permanently and that they were opposed
to any other permanent dwellings at the Park.
The Board then recessed at 12 noon and reconvened at 1:30 P. M.
The Administrator submitted a cost estimate for the changes
which the County Agent feels will be necessary to carry on his operation
in the present Civil Defense Building. Tom Trent, CD Director, was
also present, and advised the Board of other costs which will be
necessary in setting up his radio equipment in the Courthouse. The
Board decided to defer action until further consideration can be
given the matter.
The recent act passed by the Legislature pertaining to payment
to survivors of certain law enforcement personnel killed in the line
of duty was discussed with Sheriff Sam T. Joyce. It was suggested
that he ask his'insurance carrier for an endorsement that his present
policy covers the purpose of the Act.
Motion was made by Commissioner Macdonald', seconded by Commissioner
McCullers and unanimously carried, that the Administrator be requested
to contact Mr. Jim Williams, of the Trustees of the Internal Improve-
ment Fund, concerning the possible acquisition by the County of the
Southeast quarter of the Southeast quarter of the Northwest quarter
of Section 29, Township 31S, Range 39E, containing 10 acres, for a
park and recreational area in the Wabasso area.
Motion was made by Commissioner Macdonald, seconded by Commissioner
Dritenbas and unanimously carried, that the low bids received by the
Board at its meeting of September 6, furnishing certain materials and
supplies to the County for the coming year, as tabulated by the
County Administrator, be accepted as follows, to -wit:

Motion was made by Commissioner McCullers, seconded by Commissioner
Macdonald, and unanimously carried, that Leonard Kinchen be authorized
to use and occupy the building situated on the east shore of the Indian
River on the old Winter Beach bridgehead, in exchange for his agreeing
to clean up the premises, replace broken windows and keep the property
in presentable shape and pay the cost of fire insurance on the property;
to continue until the Board gives him sixty (60) days notice that this
agreement is revoked; with the further understanding that the bridge-
head property, other than the house itself, is open and available to
the general public.
. There being no further business, on Motion made,seconded and
carried, the Board adjourned at 2:30 o'clock P. M.
