HomeMy WebLinkAbout2007-219 7Q 21219 INDIAN RIVER COUNTY BEACH PRESERVATION PLAN WORK ORDER NO , 8 TO THE PROFESSIONAL SERVICES AGREEMENT BETWEEN APPLIED TECHNOLOGY AND MANAGEMENT, INC. AND INDIAN RIVER COUNTY, FLORIDA Pursuant to the Professional Services Agreement (MASTER AGREEMENT) dated December 13 , 2005 , by and between INDIAN RIVER COUNTY, a political subdivision of the State of Florida, hereinafter referred to as the COUNTY, and APPLIED TECHNOLOGY AND MANAGEMENT, INC . , with a Florida office in WEST PALM BEACH, FL . , hereinafter referred to as the CONSULTANT, this WORK ORDER No. 8 is an extension of and hereby becomes a part of the MASTER AGREEMENT as follows : SECTION I - PROJECT DESCRIPTION Services included in this Work Order are specified in the attached Scope of Work included as Exhibit "A" SECTION II - COUNTY OBLIGATIONS The COUNTY agrees to provide the CONSULTANT with the following material, data, or services as required in connection with the work to be performed under this Work Order: A. Currently available studies, survey drawings, plans, calculations, and other data pertinent to the Project. B . Review and comment on CONSULTANTS work in a timely fashion. SECTION III SCOPE OF SERVICES CONSULTANT will provide services as specified in the attached Scope of Work included as Exhibit "A" SECTION IV - TIME FOR COMPLETION After the COUNTY issues a written authorization to proceed, all work shall be completed on or before November 30, 2007 as set forth in Exhibit "C" unless project delays extend the time of completion. G:\WESTPALMBEACH SHARES\SHARED\PROPOS.ALS\INDIAN RJ VER COUNTY\WORK ORDER 8 - SECT 1 & 2 PHASE 11 SECTION V COMPENSATION The COUNTY agrees to pay, and the CONSULTANT agrees to accept fees for services rendered according to the attached Cost Proposal included as Exhibit `B". SECTION VI - PARTIAL PAYMENTS The COUNTY shall make monthly partial payments to the CONSULTANT for all authorized work pertaining directly to this project performed during the previous calendar month The CONSULTANT shall submit invoices monthly for services performed and expenses incurred pursuant to this Agreement during the prior month. The CONSULTANT shall submit duly certified invoices to the Director of the Public Works Department. For lump sum line items, the amount submitted shall be the prorated amount due for all work performed to date under this phase, determined by applying the percentage of the work completed as certified by the CONSULTANT, to the total due for this phase of the work. For each invoice, the CONSULTANT shall certify that the total invoice amount is correct. The amount of the partial payment due the CONSULTANT for the work performed to- date under these phases shall be an amount calculated in accordance with the previous paragraph, less ten percent ( 10%) of the invoice amount thus determined, which shall be withheld by the COUNTY as retainage, and less previous payments. The ten percent ( 10%) retainage withheld shall be paid in full to the CONSULTANT by the COUNTY, within forty-five days after the date of final acceptance of the work by the Director of Public Works. Billings shall be payable in accordance with the provisions of the Local Government Prompt Payment Act, Florida Statutes section 218.70 et. seq. at not less than monthly intervals. No payment shall be made unless the Public Works Director has received and approved the work products required under the "Scope of Services" herein. EXHIBIT "A" SCOPE OF SERVICES G9WESTPALMBEACH SHARES\SHARED\PROPOSALS\INDIAN I#VER COUNTY\WORK ORDER 8 - SECT I & 2 PHASE If CUNSIIAIM WUKKUK0EK6.DUO Attachment A — Scope of Services June 2007 Work Order 8 Indian River County Beach Sectors 1 & 2 (Ambersand ) Construction Phase II Services and Post-Construction Monitoring INTRODUCTION The sand placement for the limited renourishment of the Ambersand project was broken into two phases. Phase I , placement of sand from the Sebastian Inlet Sand Trap , was performed under a FDEP partial notice to proceed (NTP), and allowed for placement of sand dredged from the Sebastian Inlet sand trap to be placed on the dry beach (landward of the MHW line). The Phase I portion of the project was completed in May 2006 under contract with Great Lakes Dredge and Dock, Inc. (GLDD). Biological Monitoring will be performed this summer, and it is anticipated that the FDEP will issue the County a full NTP to complete Phase II of this project. Phase II will place approximately 160,000 c.y. from the offshore borrow site , resulting in a total construction volume of approximately 258,000 c.y. This Work Order and Scope of Services will also provide the County with the necessary support and coordination to complete construction , necessary monitoring (as required by the project permits), construction phase administration and post-construction services to fulfill permit requirements. Task 1 Phase II Design Revisions Field directives were issued to GLDD and its subcontractor to enable placement of the contract volume for the Sebastian Inlet sand trap dredging . Field changes were made to the construction template such that placed material would remain landward of the MHW line . ATM will process the contractor's surveys and revise the construction templates for Phase II of the project. ATM will deliver revised Construction Plans to the County and Contractor. Task 2 Site Inspections and Meetings ATM will perform site inspections and conduct weekly progress meetings. It is anticipated that the contractor will commence sand placement in November or December of this year. ATM will conduct weekly inspections and conduct on-site progress meetings once mobilization commences. Prior to the contactor's mobilization , ATM will conduct weekly conference calls for a month prior to mobilization . The budget for this task also includes an allowance for contractor coordination and review of the contractor's requests for payment. ATM will prepare and provide the County with meeting notes for each weekly conference call and meeting . Task 3 Agency Coordination and Project Quality Control ATM will provide federal and state agency coordination as needed . Due to the nearshore hardbottom , the regulatory agencies interest in this project will require significant coordination and interaction , and ongoing coordination and updates will be provided . This task will also allow for proactive coordination with the regulatory agencies should any project permit related or regulatory issues arise during construction or though the County's Substantial Completion . ATM will request permit modifications to extend the permit expiration date (the issued permit expires on October 23 , 2007) to allow a sufficient amount of time for the contractor to complete construction activities. ATM will provide the County updates via e-mail of any significant conversations or e-mail exchanges with the regulatory agencies , and will be billed on a time and materials basis. At ATM 's discretion , Coastal Eco-Group , Inc. (CEG ) may be consulted on a time and materials basis . Under this task, ATM will perform quality control and quality assurance measures to ensure that all submittals and agency coordination meet ATM's and the County's standards for reporting . All documents will be peer-reviewed internally by ATM staff, and provided to the County for comment. Task 4 Sediment Sampling and Reporting Per permit requirements , sand samples need to be collected and analyzed . Sand samples (two replicate) need to be collected at two cross-shore locations at each '/z monument station (e .g . , R-51 R-5 .5, R-6 , etc . ) upon the County's acceptance of the pay section . The samples will be collected by ATM staff as part of the site visit (Task 2) . ATM will be in close coordination with County staff regarding collection of the samples . Collected samples will be provided to and analyzed to ASTM standards by a qualified lab (SEA). ATM will provide the necessary regulatory agencies and the County with the laboratory analysis of the sand samples . Task 5 Pre-Construction (Phase II) Biological Monitoring To obtain a NTP from FDEP, biological monitoring of the nearshore resources must be conducted . Continental Shelf Associates, Inc. (CSA) will perform the biological monitoring . CEG will perform required 2n party quality assurance of the monitoring data , and ATM will perform necessary quality control on the reporting of the data . Work will include establishing and surveying the remaining 3 transects at R-5, R-8 , and R-22 , collecting quadrat and sediment thickness data along the eight project transects, and surveying the nearshore edge of hardbottom between R-4 and R-12. ATM will snorkel with CSA for 1 day to observe data collection methods , ensure that data collection methods meet the protocol , and to observe the overall extent and condition of the nearshore hardbottom . ATM and CEG will coordinate with FDEP and USACE on nearshore conditions and efforts undertaken as part of this task. The consultants and the County will have weekly teleconferences to coordinate efforts. ATM and CSA will provide the County with regular updates via e-mail or teleconferences of the field efforts, and a report presenting the data and an analysis of the data . Task 6 Post-Construction Physical Monitoring Report ATM will analyze the data and prepare a post-construction report. The report will include reporting of the pre-and post-construction surveys of the beach profiles and borrow site. ATM will analyze the data for placed sand , shoreline and volume changes and the post-project condition of the borrow site . ATM will provide the FDEP with aerial photography ( rectified and geo- referenced). ATM will prepare the Post-Construction Physical Monitoring Report as necessary. The County will provide ATM with comments to a draft version , and ATM will distribute the report as necessary . It is anticipated that the beach profile and borrow site surveys will be performed by the contractor. The aerial photography will be conducted under a separate work order. ATM will provide the County with one draft report for review, and distribute final copies to the County and regulatory agencies. Future Tasks The issued FDEP and USACE permits require physical and biological monitoring of the project for a minimum of three years. It is assumed that the monitoring requirements will not change, and estimated fees are based on the relevant tasks of this Scope of Work with a 5% increase to account for estimated increases for labor and equipment rates. Since beach profile and borrow site surveys were not a part of this scope, comparable fees were used in the estimate of future monitoring .
