HomeMy WebLinkAbout2006-203 WORK ORDER NUMBER CT- 1 a c) c) 6 - a o 3 WABASSO BEACH PARK RESTORATION This Work Order Number CT- 1 is entered into as of this 1 .1th day of June , 200 pursuant to that certain Continuing Contract Agreement for Professional Services entered into as of December 13 , 2005 ( "Agreement' ) , by and between Indian River County, a political subdivision of the State of Florida ( "COUNTY" ) and Coastal Technology Corporation ( "CONSULTANT' ) . The COUNTY has selected the Consultant to perform the professional services set forth on Attachment 1 , attached to this Work Order and made part hereof by this reference . The professional services will be performed by the Consultant for the fee schedule set forth in Attachment 2 , attached to this Work Order and made a part hereof by this reference . The Consultant will perform the professional services within the timeframe more particularly set forth in Attachment 3 , attached to this Work Order and made a part hereof by this reference all in accordance with the terms and provisions set forth in the Agreement . Pursuant to paragraph 1 . 4 of the Agreement, nothing contained in any Work Order shall conflict with the terms of the Agreement and the terms of the Agreement shall be deemed to be incorporated in each individual Work Order as if fully set forth herein . Fell , Assi Cou y Attorney Attachment 1 TO WORK ORDER CT- 1 — Professional Services WABASSO BEACH PARK RESTORATION 1 . INTRODUCTION In September 2004, Hurricanes Frances and Jeanne severely damaged Wabasso Beach Park ( Park); the storms destroyed the boardwalk , restroom , pavilions and portions of the parking area and roadway within the Park. This Scope of Work entails design and permitting services to provide for restoration of the Park (Project) . The Project entails restoration of the Park outside Florida Department of Transportation ( FDOT) right-of-way and makes use of existing stormwater management facilities without exceeding St. Johns River Water Management District (SJRWMD) thresholds for permit exemption ; this Scope of Work is based upon the expectation that no SJRWMD permits are required and that an FDOT utility permit will be required only for new water and sewer utilities located within SR At right-of-way. Services are proposed under the Continuing Contract Agreement for Professional Services between COUNTY and CONSULTANT, dated December 13 , 2005. CONSULTANT shall sub-contract water and sewer related services to Carter Associates , Inc. ( CAI ) . The following describes the work . 2. SCOPE A. Task 1 - Design : CONSULTANT has previously completed a draft preliminary site plan "pro bond". CONSULTANT shall provide customary preliminary and final design services for the site plan , and design of the boardwalk, boardwalk showers , sidewalks, paving , grading , water connection , sewer ( including lift station and force main ) and drainage . Scope of design for water and sewer is based upon service to the park restroom facility with (a ) all proposed water and sewer located on park property except for sewer force main connection to existing service line west of SR A1A, ( b ) the sewer lift station to be located landward of the VE flood zone and CCCL , and ( c) the bottom of the lift station to be set so as to allow for potential gravity flow connections by others to adjacent properties . For each phase of the design , CONSULTANT shall furnish three (3 ) copies of the Design Documents to COUNTY and CONSULTANT will meet with the COUNTY to review the Design Documents and the opinion of probable construction costs . The design will be prepared consistent with COUNTY standards for roadways , the Florida Building Code , and the U . S . Army Corps of Engineers Coastal Engineering Manual. The COUNTY shall provide standard details and Technical Specifications for pavement, curbs , sidewalks , and boardwalks . The design shall be based upon the survey by Morgan & Eklund Inc. ( M& E) dated April 25 , 2005 and titled " Boundary and Topographic Survey of Wabasso Beach Park For Indian River County" or as may be updated by the COUNTY or M&E . Another COUNTY consultant shall provide for design of the restroom , pavilions , landscaping , site lighting , and electricity. CONSULTANT shall incorporate standard building , structure , or other component design documents prepared by COUNTY or other COUNTY consultants into the Design Documents . CONSULTANT's responsibility with respect to such components shall be horizontal and vertical placement and orientation on the Site and integration with components designed by CONSULTANT. CONSULTANT shall coordinate the incorporation of such components with COUNTY and the COUNTY's Architect. In addition , COUNTY shall provide up to three ( 3) 30-foot soil borings and up to three ( 3) 15-foot soil borings , and one ( 1 ) geotechnical laboratory report from a Geotechnical firm currently under continuing contract with the COUNTY. The preliminary design drawings are to be the basis of formal permit applications by the COUNTY under Task 2 and the CONSULTANT under Task 3. CONSULTANT shall prepare a written description of the Project design criteria and any material changes from the draft Preliminary Site Plan . The preliminary design shall address the site-specific design conditions and shall include calculations , which form the basis of the Project design . As part of the preliminary design , the CONSULTANT shall identify expected beach-dune profiles and associated wave loads for the 50 and 100 year return interval storm events for design of the boardwalk ( by CONSULTANT) and restroom ( by others) respectively. These drawings shall illustrate the proposed site plan and include representative cross sections with dune plantings . The final design drawings shall be consistent with the State of Florida Department of Environmental Protection ( FDEP) permit and the Indian River County Minor Site Plan Approval, these drawings shall be prepared after permit issuance or otherwise upon request by the COUNTY. Final design includes proposed Technical Specifications — suitable for bidding and construction. B . Task 2 - Minor Site Plan Approval : The Project is a " nonresidential' project comprised of less than five thousand ( 5 , 000) square feet of new impervious surface area and qualifies for Minor Site Plan approval by the Indian River County. Based upon the Preliminary Design Documents prepared under Task 1 , the COUNTY shall prepare , submit and process Minor Site Plan Approval as follows : 2 . 1 Pre-application Conference : COUNTY will request and hold a pre-application meeting with Indian River County Community Development Department staff. COUNTY will prepare a written summary of staff comments . 2 . 2 Application : COUNTY will prepare and submit a formal application for Minor Site Plan Approval . 2 . 3 Staff Reviews : COUNTY will confer with Department staff to address staff questions , address staff requests for additional information , and provide for completion of the application . 2 . 4 Technical Review Committee (TRC ): COUNTY will meet with the TRC to review the application and address TRC comments . If required , COUNTY will formally address TRC comments in writing and re-submit application with written response to TRC so as to obtain TRC approval of the Site Plan . CONSULTANT will attend up to two (2) TRC meetings and concurrently advise COUNTY as to means to address TRC comments . C . Task 3 - FDEP Permit Application : In general , CONSULTANT shall assist the COUNTY with preparation and processing of a formal permit application for the Project to FDEP as follows : 3 . 1 Pre-Application Conference : Following Task 2 . 1 , CONSULTANT submit the draft Preliminary Site Plan to FDEP staff, formally request and chair a pre-application telephone conference with representatives of the COUNTY and FDEP staff. The purpose of the pre- application telephone conference is to ( a ) verify applicable rule provisions for FDEP permitting of the Project, ( b ) seek FDEP staff comments regarding the proposed Project. CONSULTANT will prepare a written summary of the results of the pre-application telephone conference . 3 . 2 Permit Application : CONSULTANT shall prepare a formal FDEP permit application for the Project to FDEP for submission by the COUNTY to FDEP. COUNTY will provide (a ) permit application fees, ( b ) evidence that the Project does not contravene local building codes , setbacks, or Comprehensive Plan , and (c) evidence of title or ownership . 3 . 3 Permit Processing : CONSULTANT will informally confer with FDEP staff to address staff issues and concerns and to expedite processing of the FDEP permit application . It is expected that FDEP staff will issue two Requests for Additional Information ( RAI ) . D . Task 4 — IRC Utility Application : In general , CONSULTANT shall assist the COUNTY with preparation and processing of a formal permit application for the Project to Indian River County Utilities as follows : 4 . 1 Permit Application : CONSULTANT shall prepare a formal IRC Utility permit application for the Project to IRC Utilities for submission by the COUNTY to IRC Utilities . COUNTY will provide (a ) permit application fees , ( b) evidence that the Project does not contravene local building codes , setbacks , or Comprehensive Plan , and ( c) evidence of title or ownership . 4. 2 Permit Processing : CONSULTANT will informally confer with IRC Utilities staff to address staff issues and concerns and to expedite processing of the IRC Utility permit application . It is expected that ( a ) IRC Utilities staff will issue two Requests for Additional Information ( RAI ) and ( b ) it will be necessary to meet with IRC Utilities staff in to resolve issues surrounding the proposed Project. E . Task 5 — Bidding & Construction Phase Services : COASTAL TECH will address questions from the COUNTY and Bidders and prepare Addenda , if necessary. COASTAL TECH will attend bid opening and make recommendation to COUNTY for contract award . 6 . 1 In general , COUNTY will provide construction administration , construction phase engineering services , and day-to-day site inspections . For sewer, as required by FDEP , COUNTY will retain a " professional engineer registered in Florida , to conduct on-site observation of construction , to prepare a certification of completion of construction , and to review record drawings for adequacy. " 3. DELIVERABLES A. Preliminary design (shall be considered 60 percent design review submittal ) — provide one copy each of structural and civil construction drawings together with one copy of the technical specifications . Also provide quality control comments on the 60 percent review submittal . B . Final design (shall be 100 percent review submittal) — provide one copy each of all drawings and technical specifications compatible with EJCDC 1996 General Conditions and provide digital AutoCAD drawing files 2005 edition or later and digital word document files of the technical specifications . Also provide one copy of the itemized opinion of probable construction cost. C . Conformed sets — After the project is bid but before the COUNTY awards the construction contract, provide five signed and sealed copies of the conformed contract drawings and five signed and sealed sets of the confirmed technical specifications . Further any revisions to the above digital drawing and document files shall be provided . END ATTACHMENT ATTACHMENT 2 to WORK ORDER NO . CT- 1 WABASSO BEACH PARK RESTORATION 1 . COMPENSATION The COUNTY agrees to pay and the CONSULTANT agrees to accept , a not-to-exceed fee of $47 , 797 for services rendered according to Attachment 1 and the attached FEE SCHEDULE of this WORK ORDER . 2. PARTIAL PAYMENTS The COUNTY shall make monthly partial payments to the CONSULTANT for all authorized work completed per the FEE SCHEDULE and pertaining directly to this project performed during the previous calendar month . The CONSULTANT shall submit invoices monthly for services performed and expenses incurred pursuant to this Agreement during the prior month . The CONSULTANT shall submit duly certified invoices in duplicate to the Director of the Public Works Department . For lump sum line items , the amount submitted shall be the prorated amount due for all work performed to date under this phase , determined by applying the percentage of the work completed as certified by the CONSULTANT , to the total due for this phase of the work . The amount of the partial payment due the CONSULTANT for the work performed to date under these phases shall be an amount calculated in accordance with the previous paragraph , less ten percent ( 10 % ) of the invoice amount thus determined , which shall be withheld by the COUNTY as retainage , and less previous payments . Per F . S . 218 . 74( 2 ) , the COUNTY will pay approved invoices on or before the forty-fifth day after the COUNTY receives the CONSULTANT' s invoice . Per F . S . 218 . 74( 2 ) , the ten percent ( 10 % ) retainage withheld shall be paid in full to the CONSULTANT by the COUNTY, on or before the forty-fifth day after the date of final acceptance of the Work by the Public Works Director.
