CONSTRUCTION SUPPORT SERVICES AND PREPARATION OF A
QUALITY ASSURANCE PROJECT PLAN FOR THE MAIN RELIEF CANAL
POLLUTION CONTROL SYSTEM
This Work Order Number M1 is entered into as of this I Oday of SFer
2007 , pursuant to that certain Continuing Contract Agreement for Professi nal Services
entered into as of March 15 , 2005 ("Agreement' ) , by and between Indian River County, a
political subdivision of the State of Florida ("COUNTY") and Malcolm Pirnie , Inc .
("CONSULTANT') .
The COUNTY has selected the CONSULTANT to perform the professional services
set forth on Attachment 1 , attached to this Work Order and made part hereof by this
reference . The professional services will be performed by the CONSULTANT for the fee
schedule set forth in Attachment 2 , attached to this Work Order and made a part hereof by
this reference . The CONSULTANT will perform the professional services within the
timeframe more particularly set forth in Attachment 3 , attached to this Work Order and
made a part hereof by this reference , all in accordance with the terms and provisions set
forth in the Agreement. Pursuant to paragraph 1 . 4 of the Agreement , nothing contained in
any Work Order shall conflict with the terms of the Agreement and the terms of the
Agreement shall be deemed to be incorporated in each individual Work Order as if fully set
forth herein .
IN WITNESS WHEREOF , the parties hereto have executed this Work Order as of
the date first written above .

CONSTRUCTION SUPPORT SERVICES AND PREPARATION OF A
QUALITY ASSURANCE PROJECT PLAN FOR THE MAIN RELIEF CANAL
POLLUTION CONTROL SYSTEM
SCOPE OF WORK
The COUNTY has requested that the CONSULTANT provide professional engineering
services for the preparation of a Quality Assurance Project Plan (QAPP) and assistance
during construction for the COUNTY's Main Relief Canal Pollution Control System Project.
The QAPP submittal is required by a Florida Department of Environmental Protection
( FDEP) 319 Grant Contract ( DEP Contract No . G0182 , dated April 11 , 2006) . The QAPP
must be prepared in accordance with the 319 Grant. The following tasks provide the
necessary cross-section of activities associated with the preparation of the QAPP and
assistance during the construction period .
Task No. 1 — KICKOFF MEETING - conduct kickoff meeting (telephone conference call )
with COUNTY to discuss and assemble (aerial photo, site plan , sampling locations , etc . )
pertinent information concerning the project as it relates to the required QAPP submittal
and construction work.
Task No. 2 — MEETING WITH FDEP & PREPARATION OF QAPP PROTOCOL —
subsequent to the kickoff meeting with the COUNTY , the CONSULTANT will schedule and
attend a meeting with FDEP staff to discuss the project and gain consensus regarding the
content of the QAPP . The QAPP protocol will be prepared and submitted to FDEP for
review and comment. The CONSULTANT shall provide a timely response to the FDEP's
Request for Information ( RFI ) , if any, in order to finalize and obtain approval from FDEP for
the QAPP protocol . CONSULTANT shall coordinate with the COUNTY's analytical
laboratory, US Biosystems , Inc . , and COUNTY staff who will perform the monthly sampling
activities , to include applicable information from both parties in the protocol .
Task No. 3 — SHOP DRAWING REVIEW AND RESPONSE TO CONTRACTOR ' S
REQUEST FOR INFORMATION SUBMITTALS — provide structural and electrical
engineering services as necessary for shop drawing reviews and respond to contractor
requests for information during the construction period .
Task No. 4 — SITE VISITS DURING CONSTRUCTION AND ASSOCIATED MEMOS —
conduct up to 12 site visits to the project construction site to observe and review project
construction activities . Prepare and submit to the COUNTY , a memo summarizing
observations made during each site visit.
Task No. 5 — STARTUP SITE VISIT AND MEMO - conduct a site visit to the project
construction site at the time of scheduled startup to observe and review project activities .

Task No. 6 — MISCELLANEOUS SERVICES DURING CONSTRUCTION — The
CONSULTANT will provide professional engineering services to the COUNTY during the
construction period on an as-needed basis . Services may include but are not limited to ,
technical assistance , change order assistance , etc .

1 , COMPENSATION
The COUNTY agrees to pay and the CONSULTANT agrees to accept, a fee of $76, 301 .80
for services rendered according to Attachment 1 of this WORK ORDER. Hourly rates shall
be as set forth in the Agreement and a breakdown of the fees is set forth below.

( 1 ) Tasks 3 . 0 , 4 . 0 , and 6 .0 are estimated fees based on hourly rates as set forth in the
Agreement. If project conditions are such that these fees will be exceeded during the
course of this Work Order, a new Work Order will be issued to cover the additional
engineering services .
2 . PARTIAL PAYMENTS
The COUNTY shall make monthly partial payments to the CONSULTANT for all
authorized work pertaining directly to this project performed during the previous calendar
month . The CONSULTANT shall submit invoices monthly for services performed and
expenses incurred pursuant to this Agreement during the prior month .
The CONSULTANT shall submit duly certified invoices in duplicate to the Director of
the Public Works Department. For lump sum line items , the amount submitted shall be the
prorated amount due for all work performed to date under this phase , determined by
applying the percentage of the work completed as certified by the CONSULTANT , to the

total due for this phase of the work . For time and material line items , the amount
submitted shall be based on the actual hours worked and expenses incurred for the billing
period .
The amount of the partial payment due the CONSULTANT for the work performed
to date under these phases shall be an amount calculated in accordance with the previous
paragraph , less ten percent ( 10% ) of the invoice amount thus determined , which shall be
withheld by the COUNTY as retainage , and less previous payments . Per F . S . 218 . 74(2) ,
the COUNTY will pay approved invoices on or before the forty-fifth day after the COUNTY
receives the CONSULTANT's invoice .
Per F. S . 218 . 74(2 ) 5 the ten percent ( 10%) retainage withheld shall be paid in full to
the CONSULTANT by the COUNTY , on or before the forty-fifth day after the date of final
acceptance of the Work by the Public Works Director.

ATTACHMENT 3 to WORK ORDER NO. M1
ALTERNATE DESIGN TO THE EXISTING VORTEX TREATMENT SYSTEM
DESIGN FOR THE NORTH , MAIN , AND SOUTH RELIEF CANALS
1 , TIME FOR COMPLETION
The CONSULTANT will complete the Quality Assurance Project Plan within 60 days
of receiving the Notice-to- Proceed from the COUNTY , excluding COUNTY review time .
The CONSULTANT's time-of-completion for assistance during construction depends on
the construction schedule met by the construction contractor. Said construction schedule
is anticipated to range from 300 to 360 calendar days . The CONSULTANT shall begin
performing construction assistance services as requested by the COUNTY upon receipt of
the Notice-to- Proceed from the COUNTY .
