PARTIAL RELEASE OF UTILITY EASEMENT
WHEREAS , on November 10 , 2009 , Century Town Center granted
an easement for utility purposes to Indian River County , Florida ; said
Easement being recorded in the Century Town Center Plat at Plat Book 24 ,
Page 64 of the Public Records of Indian River County , Florida ; and
WHEREAS , the plat of Century Town Center dedicated a utility
easement to Indian River County for water and sewer pipes in the easement ;
and
WHEREAS , plans submitted to the County to construct the ABC
Liquor Store show an encroachment upon the County ' s utility easement ; and
WHEREAS , the Board of County Commissioners wishes to release
a part of this easement as the easement serves only the proposed ABC Liquor ,
Inc . site and no other properties ,
NOW , THEREFORE , THIS PARTIAL RELEASE OF EASEMENT
is executed on behalf of the Board of County Commissioners of Indian River
County , a political subdivision of the State of Florida , whose mailing address is
1801 27th Street , Vero Beach , Florida 32960 , Grantor , to
ABC Properties , Ltd .
c/o Ross Galbraith , Esq .
Dyer, Riddle , Mills & Precourt , Inc .

Orlando , FL 32814
their successors in interest , heirs and assigns , Grantee , as follows :
Indian River County does hereby release and abandon all right ,
title , and interest that it may have in that portion of the following described utility
