This Amendment No . 1 to Developer' s Agreement Between Indian River County ,
Florida and ACTS , Inc . ( "Amendment" ) is entered into this 14th day of Deco , 2010 ,
nunc pro tunc to , 2010 , by and between Indian River County , a political
subdivision of the State of Florida ( " County" ) and ACTS , Inc . , a Pennsylvania corporation
( Developer ) .
1 . The County desires the Developer to design and implement improvements to 26th
Street between 74th Avenue and 82nd Avenue as set forth in the Developer' s Agreement
dated as of September 7 , 2010 .
2 . The County and Developer have mutually agreed to share in the implementation
and cost of the improvements to 26th Street between 74 h Avenue and 82nd Avenue .
3 . The County and the Developer desire to amend the Agreement by adding survey
and design services and utility construction as set forth in Exhibit "A" attached to this
Amendment and made a part hereof by this reference , all in accordance with the terms and
provisions set forth in the Agreement .
4 . The County and the Developer agree that 100 % of the cost of the additional survey
and design services and utility construction shown in Exhibit "A" will be borne by the County .
IN WITNESS WHEREOF , the parties hereto have executed this Amendment as of the
date first written above .
