The Board of County Commissioners of Indian River County,
Florida met in special session at the Courthouse, Vero Beach,
Florida on Tuesday, April 9, 1968 at 2:00 o'clock P. M. Present
were Robert W. Graves, Chairman: D.B. McCullers, Jr., Vice
Chairman; Donald Macdonald; Richard P. Bogosian and Jack U.
Dritenbas. Also present were Jack G. Jennings, County
Administrator; Sherman N. Smith, Jr., County Attorney; Ralph
Harris, Clerk of the Circuit Court; Sam T. Joyce, Sheriff,
Thomas H. Trent, Civil Defense Director and Janet N. Burriss,
Deputy Clerk.
Also present were Charles
Sebastian; D. G. Frisby, Mayor of the City of Fellsmere; Hobart
Lester, President of the City Council of Fellsmere; J. Noble
Richards, Mayor of the City of Vero Beach; James Pryde, City
Manager of Vero Beach; James T. Vocelle, City Attorney of Vero
Beach; Wallace Gossett, Chief of Police of Vero Beach and Guy
Sullivan, Chief of the Vero Beach Fire Department.
The Chairman called the meeting to order and the County
Attorney reported that after conversing with the Sheriff and
Members of the Board of County Commissioners regarding a disturbance
which occured in the Gifford area on the evening of April 8, which
the Sheriff felt was caused by intoxicated persons, he had been
requested to prepare a Resolution relative to the hours during
which alcoholic beverages might be sold by establishments holding
liquor licenses in the County.

After considerable discussion by members of the Board and
other persons'present, Commissioner Macdonald moved, Commissioner
McCullers seconded and it was unanimously carried that the following
Resolution be adopted:

RESOLUTION NO. 68-21
The Board of County Commissioners of Indian River County,
Florida, resolves:
1. Pursuant to the authority granted to this Board by Section
562.14(4), this Board does herewith independently regulate the hours of sale
of alcoholic beverages within the territory of Indian River County, Florida,
not included within any municipality notwithstanding the provisions of the
Beverage Laws of the State of Florida as follows, to -wit:
No alcoholic beverages, that is, any beverage containing more
than one per cent'of alcohol by weight, may be sold, consumed or served, or
permitted to be served or consumed in any place holding a license for the
sale of alcoholic beverages from the State Beverage Department of Florida
between the hours of 4:00 o'clock P. M. and8: °° o'clock A.M. of each
day, said time to be according to the official time in effect from time to time
in Indian River County, Florida.
2. This Resolution shall become effective at 4:00 o'clock P. M. on
April 9, 1968.
