The Board of County Commissioners of Indian River County,
Florida met in regular session at the Courthouse, Vero Beach,
Florida on Wednesday, May 8, 1968 at 8:30 o'clock A. M.
Present were Robert W. Graves, Chairman; D. B. McCullers, Jr.,
Vice Chairman; Donald Macdonald; Richard P. Bogosian and Jack
U. Dritenbas. Also Present were Jack G. Jennings, Administrator;
Sherman N. Smith, Jr., County Attorney and Janet N. Burriss,
Deputy Clerk.
The Chairman called the meeting to order and asked if
there were any corrections or additions to the minutes of April
9, April 10, April 12, April 15 and April 24. There were none
and upon Motion made by Commissioner McCullers, seconded by
Commissioner Macdonald and unanimously carried the minutes were
approved as written.
The County Administrator presented a tentative plat of a
Subdivision known as Green Acres Subdivision and recommended its
tentative approval as meeting County Subdivision Requirements.
Upon a Motion of Commissioner Macdonald, seconded by Commissioner
Dritenbas and unanimously carried the recommended tentative
approval was given for Green Acres Subdivision.
On a Motion made by Commissioner Macdonald, seconded by
Commissioner McCullers and unanimously carried permission was
granted for the final plat of Karr Subdivision to be put on
record and that the thirty five foot private road was not to be
maintained in any way'by the County.
A Motion was made by Commissioner Macdonald, seconded by
Commissioner McCullers and unanimously carried that the revision
and road grade of the extension of the tentatively approved plan
of Lows Subdivision be approved in order to enable the developer
to plan his water and sewer system; but that the tentative approval
of the remainder of the subdivision Northward and East be withheld

pending further consideration by the Mosquito Control District.
Mrs. Welton and Mr. Long of Tropicolony Subdivision appeared
before the Board requesting that the pond in the County owned
public park there not be filled. They stated that the citizens
of Tropicolony would maintain the pond if the County would clean
the growth from it at this time. The Board decided to table the
matter until the next meeting.
A Motion was made by Commissioner Macdonald, seconded by
Commissioner Dritenbas and unanimously carried that the minutes
of this Board of August 7, 1962, Minute Book 7, Page 755 be
corrected in order that the Motion there appearing establishing
the following right-of-way requirements for Indian River Drive be
changed to appear as Indian River Boulevard as was originally
intended.
On a Motion made by Commissioner Macdonald, seconded by
Commissioner McCullers, the application by Florida Power and
Light to construct submarine cable across Sebastian Creek was
unanimously approved.
A Motion was made by Commissioner Dritenbas, seconded by
Commissioner McCullers and unanimously carried that the Administrator
was authorized to correct eight items in various sections of the
•County at a cost of thirty-five or forty dollars each to comply
with the request of the insurance carrier,
On a Motion made by Commissioner Macdonald, seconded by
Commissioner McCullers, the request of the Administrator that Mrs.
Anne Garrison become a Notary Public was unanimously approved.
Upon a Motion made by Commissioner McCullers, seconded by
Commissioner Dritenbas the request of the Administrator to construct
concrete ramps to the entrance of the Courthouse Annex was
unanimously approved.
A Motion was made by Commissioner Macdonald, seconded by
Commissioner McCullers and unanimously carried that the Trustees of
the Internal Improvement Fund of the State of Florida by advised
by the Administrator that the Board has received their letter of

April 30, 1968 enclosing the application of Lloyd and Associates
on behalf of J. T. Gilbert, et ux, for the purchase of certain
submerged lands in Trustees of Internal Improvement File No.
1972-31-253.12, are advised that this Board objects to the proposed
sale of subject land on the grounds that this application to purchase
has not been submitted to this Board in accordance with the
provisions of Indian River County. Resolution 68-16.
On a Motion made by Commissioner Macdonald, seconded by
Commissioner Dritenbas, the request of the Administrator to construct
ambulance driveways to the Jail and Ambulance }wilding at a cost
of approximately $500,00 was unanimously approved.
A Motion was made by Commissioner Macdonald, seconded by
Commissioner McCullers and the travel of the Board of County
Commissioners, the Administrator and the County Attorney to Fort
Lauderdale on May lst to the State Road Department was unanimously
approved.
On a Motion made by Commissioner Mceulle'rs, seconded by
Commissioner Dritenbas and unanimously carried that the Administrator
advise Mr. Sutherland that the Board will sell the Pahorsky Property
for $2,500.00.
On a Motion made by Commissioner McCullers, seconded by
Commissioner Dritenbas, the request of the Clerk to purchase an
adding machine, cost not to exceed $100.00 was unanimously approved.
On a Motion made by Commissioner McCullers, seconded by
Commissioner Dritenbas the following Item to Item Transfer was

On a Motion made by Commissioner Macdonald, seconded by

A Motion was made by Commissioner Macdonald, seconded by
Commissioner McCullers and the State Witness Payroll for the
April term in the amount of $155.00 was unanimously approved.
On a Motion made by Commissioner Dritenbas, seconded by
Commissioner Macdonald, the expenses of Mr. I. J. Rovang to
Orlando to attend a RACES meeting on April 27 was unanimously
approved.
The monthly reports of the County Welfare Caseworker, the
County Agricultural Agent and the County Service Officer were
received and placed on file in the Office' of the Clerk.
On a Motion made by Commissioner Macdonald, seconded by
Commissioner McCullers, the application of Margaret M. Madsen
for a pistol permit was unanimously approved.
Commissioner Dritenbas reported that there were problems
in the area concerning loose dogs which were not being picked up
by the Humane Society. It was decided that a committee . of Sam
Joyce, Sheriff and Commissioner Dritenbas would take representatives
of the Humane Society to Fort Pierce to study how the situation is
handled there.
Commissioner Bogosian arrived at this point and became seated
with the Board.
Paul Summers and other constituents from the Brevard County
area appeared before the Board requesting that Indian River County
join with Brevard County and other counties by declaring a
moratorium in the matter of the sale of land by the Trustees of the
Internal Improvement Fund. County,Attorney, Sherman M. Smith,Jr.,
explained Indian River County Commissioner's Resolution 68-16 and
its advantages over a moratorium.
Upon a Motion made by Commissioner Macdonald, seconded by
Commissioner McCullers the following Resolution was unanimously
adopted:

RESOLUTION NO. 68- 30
The Board of County Commissioners of Indian River County,
Florida, resolves:
1, That this Board is and has been for a long period of time
greatly concerned with respect to the sale of the bottom lands lying within the
area of the public navigable waters of this state which are held in trust for the
benefit of the people of the State of Florida as the practice has existed for
many years and it hereby expresses its disapproval of the indiscriminate sale
of any of such lands and hereby expresses the opinion that no lands lying below
the ordinary high water mark of the navigable waters of the State of Florida
should be sold excepting only when it is evident and apparent that a sale of a
part thereof should be made to either (a) permit thefilling of the portions
thereof constituting marsh lands as distinguished from lands lying under the
open waters and .even then not beyond the line of vegetation; or (b) when done
to settle and confirm uncertain questions of the boundary of ownership between
the private upland owner and the public lands; or (c) to permit the elimination
of minor irregularities in the shore line; provided, however, that shore in-
dentations should not be permitted to be straightened out except .if the same
may be done by following cords 1,n a straight line from the outermost point to
the innermost point, provided the cord does not have a length of more than
300 feet.
2. This Board does herewith express its intent to oppose thesale
of any of the sovereign lands of the State of Florida not clearly falling within
the exceptions hereinbefore enumerated and does herewith respectfully request
the Trustees of the Internal Improvement Fund of the State of Florida to adopt
a like policy, which policy would in the opinion of this Board permit the
development of marsh and swamp lands and at the same time preserve the
open waters and the bottom lands of the open waters for th 'benefit of the
people of this state .
3. A certified copy of this Resolution shall be forwarded by the
Clerk to said Trustees.

James L. Hair of the Vero Beach Anglers Club,Inc. appeared
before the Board in protest the sale of 2.31 acres of submerged
land in Section 34-22-40 in Indian River County by the Trustees of
the Internal Improvement Fund.
The Administrator reported to the Board that he would like to
take a week of his vacation starting May 23, 1967.

PETITION FOR VACATION OF COUNTY: ROAD
TO THE BOARD OF COUNTY COMMISSIONERS OF INDIANRIVER COUNTY;
Comes now the Petitioner, EUGENE J. MOSHER, and petitions the
Commission as follows:
1. That he is the owner of Lot 14, Block 3 and Lot 12, Block 5,
Glendale Lakes Subdivision, according to plat filed in the office of
the Clerk of the Circuit Court of Indian River•County, Florida, in Plat
Book 6, page 26; said land lying and being in Indian River County, Florida..
2. That he does hereby petition and request this Honorable Board
to close, vacate and abandon that certain 70 -foot street lying between
Glendale Road (4th Street) and the intersection of 47th Avenue and 48th
Avenue, asshown on the plat of Glendale Lakes Subdivision as above.de-
scribed.. The particular street being requested to be vacated is an un=
named and unnumbered street lying between Lot 14, Block 3 and Lot 12,
Block 5 of Glendale Lakes Subdivision as above described.
3. That your Petitioner requests that a public hearing be set
to consider the vacation of said street and that your Petitioner does
further petition the said Board ofi County commissioner to renounce and
disclaim any right of the county and of the public in and to said road
as delineated in said plat as a street or road.

On a Motion made by Commissioner McCullers, seconded by Commissioner
Macdonald, the following Resolution was unanimously adopted:
RESOLUTION NO. 68-31
WHEREAS, Eugene J. Mosher has filed a Petition for the vacation
of County road and the Board of County Commissioners of Indian River
County, Florida has determined that it would be advisable,to consider
the vacating, abandoning, discontinuing and closing of that portion of
road or street lying between Glendale Road (8th Street) and the inter-
section of 47th Avenue and 48th Avenue, as shown on.Glendale Lakes
Subdivision, which said street is more particularly described as follows,
to -wit:

All of that street or road lying between Lot 14, Block 3,
and Lot 12, Block 5, Glendale Lakes Subdivision, according
to plat filed in the office of the Clerk of the Circuit
Court of Indian River County, Florida, in Plat Book 6,
page 26; said land lying and being in,Indian River County,
Florida.
BE IT RESOLVED by the Board of County 'Commissioners of Indian
County, Florida that a public hearing will be held to consider
the advisability of vacating, abandoning and discontinuing and closing
any portion of the right-of-way for the street lying between Lot 14,
Block 3 and Lot 12, Block 5 of Glendale Lakes Subdivision as above
described, renouncing and disclaiming any right and title of the public
and of the county in and to the land in connection therewith as herein-

BE IT FURTHER RESOLVED that Notice of said bearing shall be
published one time in the Vero Beach Press Journal, a newspaper of
general circulation in Indian River County, Florida, which publication
shall be at least two weeks prior to the date stated therein for such
public hearing.
The several bills and accounts against the County having been
audited, were examined and found to be correct were approved and
warrants issued in settlement. of same as follows: General Fund,
Nos. 984 to 1062 inclusive; Road and Bridge`Fund, Nos. 785 to
819 inclusive; Fine and Forfeiture Fund Nos.', 37 to 47 inclusive.
Such bills and accounts being on file in the office of the Clerk
of the Circuit Court, the warrants so issued from the respective
funds being listed in the Supplemental Minute Book as provided by
the rules of the Legislative Auditor, reference to such record and
list so recorded being made a part of these minutes.
There being no further business, on Motion made, seconded and
carried, the1Board adjourned at 11.:25 o'clock A. M.
