HomeMy WebLinkAbout2010-031a�IIC) g,L aafo w -63r AMENDMENT NO. 11 TO THE PROFESSIONAL ENGINEERING SERVICES AGREEMENT 66TH AVENUE PAVING AND DRAINAGE IMPROVEMENTS BETWEEN SR 60 AND 4TH STREET IRC PROJECT NO* 9810 THIS is an amendment to the existing AGREEMENT dated NOVEMBER 17, 1998, including AMENDMENTS NUMBER 1 through 10, between CARTER ASSOCIATES, INC. (ENGINEER) and INDIAN RIVER COUNTY (COUNTY). The proposed scope of work includes Survey Sketches and Legal Descriptions for Temporary Construction Easements, Drainage Easements and Right of Way acquisitions; and additional design services for permitting compliance and addition of sidewalk along the west side of the proposed roadway.. All provisions of the original Professional Engineering Services Agreement including Amendment Nos. 1 through 10 shall remain in full force and effect, unless otherwise specifically modified. This amendment addresses changes in "SCOPE OF SERVICES", "COMPENSATION" and "TIME OF COMPLETION" of the AGREEMENT. SCOPE OF SERVICES See attached letter from Carter Associates, Inc. dated January 7, 2010, which specifies changes in the "SCOPE OF SERVICES" and "COMPENSATION" and "TIME FOR COMPLETION." COMPENSATION This section of the AGREEMENT entitled SECTION V - COMPENSATION shall be revised in response to the Scope modifications set out herein. The charges associated with this AMENDMENT NO. 11 are as follows: Sketches and Legal Descriptions (27): Lump Sum Amount $125500.00 Design Modifications Lump Sum Amount $181530.00 TOTAL Amendment No. 11 $31.030.00 The charges associated with the AGREEMENT (which include changes from Amendments 1 through 10 and these additional services included in proposed Amendment 11), shall be increased from $557,265.00 to $588,295.00. All sections of the AGREEMENT shall remain in full force and effect, and are incorporated herein. This Amendment No. 11 to the AGREEMENT, regardless of where executed, shall be governed by and construed by the laws of the State of Florida. TIME OF COMPLETION Carter Associates, Inc. shall have 45 calendar days from their receipt of a written Notice to Proceed to submit revised plans and Sketches and Legal Descriptions for review and 30 calendar days additional to submit final plans. N� 1 � Amendment No. 11 — Professional Engineering Services Agreement RECD IRC Project No. 9810 (CAI Job # 98-23E)��"D'`` Dear Chris: We are pleased to present this proposed amendment for additional professional engineering services relative preparing legal descriptions and sketches for storm drainage easements and acquisition parcels, design of additional storm water management facilities, re -grading of intersections for future s>gnalization and the addition of a 6 foot wide sidewalk along the west side of 66TH Avenue, all in conjunction with the Phase 2 portion of the 60 Avenue paving and drainage improvements project (4`h Street to 16`h Street). All provisions of the original Professional Engineering Services Agreement (dated November 17, 1998), including Amendment Nos. 1 through 10, shall remain in full force and effect, unless otherwise specifically modified herein. The following further describes our proposed scope of services and terms of agreement between Carter Associates, Inc. (Engineer) and Indian River County (County): Legal Descriptions & Sketches: CAI shall develop a total of (22) twenty-two Sketches and (28) twenty-eight Descriptions comprised of (19) nineteen storm drainage easements and (9) nine acquisition parcels along the subject route of 66th Avenue, 4th Street (secondary roadway), 8th Street (secondary Roadway) and 12th Street (secondary roadway). The work is further described as follows: 1. Research and retrieve parcel identification card from the Indian River County property appraiser's web site of each of the subject parcels. Retrieve listed description and verify parcel identification with owner of each. A search of the Indian River County Clerk of the Circuit Court Records will be made if record listed document is not available from web site. (An updated title search report of the subject parent parcels is recommended but is not included). 2. Utilize listed parent parcel description to develop new descriptions for easements or parcel acquisitions. 3. Prepare and develop a "Sketch and Description" for each specific case of easement or parcel acquisition. (Not a Survey) 4. Project shall be completed within forty five (45) business days from Notice to Proceed. 6. Deliverables shall be certified to Indian River County and shall include three (3) signed and sealed 8-1/2"xl 1" Sketch of Description of each, an electronic copy in AutoCAD 2009 and PDF formats. Design Modifications: • CAI will re -design the profile grade line and adjacent grading and drainage at the intersections of 4`h Street, 8"' Street and 12t" Street with 66"' Avenue to provide "plateau" grading for the east/west traffic flow on side Streets in anticipation that the intersections will be signalized in the future. • CAI will modify existing design and provide new design for drainage system(s) to provide treatment and attenuation of stormwater runoff for the proposed 12"' Street roadway improvements and right- of-way acquisitions. • CAI will modify plans to include a 6 foot wide sidewalk along the west side of 66`h Avenue from 4"' Street to 16`h Street. Compensation: Amendment No. 11 fees will be invoiced on a percent complete, lump sum basis as shown below. The total amount to be billed shall not exceed $31,030.00 unless authorized by an additional written agreement.
