(ENGINEER) and INDIAN RIVER COUNTY (COUNTY) . The proposed scope of work includes plan revisions, utility relocation coordination and permit modifications as needed to support right- of-way acquisitions . All provisions of the original Professional Engineering Services Agreement including Amendment Nos . 1 through 12 shall remain in full force and effect, unless otherwise specifically modified . This amendment addresses changes in " SCOPE OF SERVICES ", "COMPENSATION" and "TIME OF COMPLETION" of the AGREEMENT . SCOPE OF SERVICES See attached letter from Carter Associates , Inc . dated April 13 , 2011 , which specifies changes in the " SCOPE OF SERVICES " and "COMPENSATION" and "TIME FOR COMPLETION . " COMPENSATION This section of the AGREEMENT entitled SECTION V - COMPENSATION shall be revised in response to the Scope modifications set out herein . The charges associated with this AMENDMENT NO . 13 are as follows : Amendment No . 13 Not —to - exceed total $ 28P000 . 00 The charges associated with the AGREEMENT (which include changes from Amendments 1 through 12 and these additional services included in proposed Amendment 12) , shall be increased from $ 621 , 825 . 00 to $ 6495825 . 00 . All sections of the AGREEMENT shall remain in frill force and effect, and are incorporated herein . TIME OF COMPLETION Carter Associates , Inc . shall have 180 calendar days from their receipt of a written Notice to Proceed to complete the additional services of this amendment . All provisions of the original Professional Engineering Services Agreement (dated November 17 , 1998 ) , including Amendment Nos . 1 through 12 , shall remain in full force and effect, unless otherwise specifically modified herein . The following further describes our proposed scope of services and terms of agreement between Carter Associates , Inc . (Engineer) and Indian River County (County) : Additional Services : • Address plan modifications requested by property owners through right-of-way acquisition negotiations with the County (i . e . custom fencing, tree relocations , structure relocations , driveway modifications , drainage , landscaping, etc . ) . Revise Atlantic Bow' evard driveways and convert to roadways with 3'5return radii . Design At'tantic Boulevard roadway transitions at intersection with 66t1i Avenue based on 35 mph design speed . Provide 100 ' cross sections and roadway profile . Revise roadway geometry, drainage and guardrails . Coordinate design with Indian River Farms Water Control District . • Utility relocation coordination with FPL . • Prepare and submit Army Corp of Engineers permit application for new permit . (The previously obtained permit expired on April 8 , 2011 ) . • Prepare and submit a letter modification of the existing St Johns River Water Management District permit after all plan changes are implemented . Compensation : Amendment No . 13 additional service fees will be invoiced on a time and materials basis and shall not exceed $ 28 , 000 . 00 unless authorized by an additional written agreement .
