HomeMy WebLinkAbout2012-072 <a ~ d ?0, WORK ORDER NUMBER 3 This Work Order Number 3 entered into as of this 17 day of April , 2012 pursuant to that certain Continuing Contract Agreement for Professional Services entered into as of December 6 , 2011 ( the "Agreement" ) , by and between INDIAN RIVER COUNTY, a political subdivision of the State of Florida ( " COUNTY" ) and CDM Smith Inc ., ( CDM Smith ) ( "Consultant" ) . The COUNTY has selected the Consultant to perform the professional services set forth on Exhibit A ( Scope of Work ) , attached to this Work Order and made part hereof by this reference . The professional services will be performed by the Consultant for the fee schedule set forth in Exhibit B ( Fee Schedule ) , attached to this Work Order and made a part hereof by this reference . The Consultant will perform the professional services within the timeframe more particularly set forth in Exhibit A ( Time Schedule ) , attached to this Work Order and made a part hereof by this reference all in accordance with the terms and provisions set forth in the Agreement . Pursuant to paragraph 1 . 4 of the Agreement, nothing contained in any Work Order shall conflict with the terms of the Agreement and the terms of the Agreement shall be deemed to be incorporated in each individual Work Order as if fully set forth herein . Alan S . ftl ich , Sr ., County Attorney EXHIBIT A WORK ORDER NO . 3 FOR INDIAN RIVER COUNTY SOLID WASTE DISPOSAL DISTRICT C & D DEBRIS LANDFILL PERMIT RENWAL AND MPIS TECHNICAL REPORT This Authorization, when executed, shall be incorporated in and become part of the Contract for Consulting/ Professional Services between the Indian River County Solid Waste Disposal District ( IRC SWDD) , and CDM Smith Inc. ( CDM Smith), dated December 6 , 2011 hereafter referred to as the Agreement. PROJECT BACKGROUND The current operations permit ( Permit Number S031 - 012 £1769 - 014) for the construction and demolition (C & D) debris landfill was issued by the Florida Department of Environmental Protection ( FDEP) on June 15, 2007 and will expire on April 20 , 2012 . This permit will need to be renewed at this time if IRC SWDD intends to keep the C & D debris landfill operational . The Scope of Work for preparing and submitting the renewal application is outlined below. SCOPE OF WORK TASK 1 - C &D DEBRIS LANDFILL OPERATIONS PERMIT RENEWAL Subtask 1 . 1 - Preparation of Permit Renewal Documents The " renewal' application consists of the four page FDEP Form # 62 - 701 . 900 ( 6) , Florida Administrative Code ( F.A .C .) and other additional supporting information . In accordance with Chapter 62 - 701 . 730 ( 2) , F .A . C ., the renewal applications shall include the information in paragraphs (b) through (f) . CDM Smith will provide the following information as required in Part B of the application : Part 1 - Not required for permit renewal . Part 2 - A boundary survey and legal description and topographic survey of the property. A prior topographic survey ( February 2012 ) will be used for this purpose . A new survey will not be performed as a part of this project. Part 3 - An updated operations plan, which describes in detail the operations, safety, and training procedures, which are used on a daily basis to minimize the risk of environmental degradation . CDM Smith will make minor modifications of the existing operating plan as required to incorporate the chromated copper arsenate ( CCA) treated wood management plan . Part 4 - CDM Smith will submit an updated closure plan . No significant changes will be made to the Closure Plan that was submitted in September 2006 . A4 j13626 WO 3.docx Part 5 - Financial assurance for closure and for 5 years of long- term care . A detailed closure and long - term care cost estimate for the C & D debris landfill will be prepared and submitted as part of the renewal application . The financial assurance documentation will also be sent to the FDEP Tallahassee office as part of the application . Part 6 - A CCA treated wood management plan . A CCA treated wood management plan will be prepared and submitted as part of the renewal application . Part 7 - A groundwater monitoring plan . The Monitoring Plan Implementation Schedule ( MPIS ) for the Class 1 landfill includes the C & D landfill . A copy of the MPIS dated March 7, 2011 will be submitted to meet this requirement. Part 8 - Documentation to show that stormwater will be controlled . No change to the current stormwater system or Environmental Resource Permit ( ERP) is anticipated and is not included in this Scope of Work. CDM Smith will submit a copy of the current ERP to meet this requirement. Part 9 - Documentation that shows how the Owner will comply with the temporary storage requirements of Rule 62 - 701 . 730 ( 6) , F.A. C . CDM Smith will attach the required documentation necessary for this part to the permit renewal application . Part 10 - Documentation that shows how the Owner will comply with the operation requirements of Rules 62 - 701 . 730 ( 7) , ( 18) and ( 19), F .A. C . CDM Smith will attach the required documentation necessary for this part to the permit renewal application . Part 11 " Documentation that shows how the Owner will comply with the training requirements of Rule 62 - 701 . 730 (8) , F .A. C . CAM Smith will attach the required documentation necessary for this part to the permit renewal application . Part 12 - Documentation that shows how the Owner will comply with the closure and long-term care requirements of Rules 62 - 701 . 730 (9 ) and ( 10 ) , F.A . C . CDM Smith will attach the required documentation necessary for this part to the permit renewal application . Part 13 - Documentation that the Owner will comply with the annual report requirements of Rule 62 - 701 . 730 ( 12 ) 0 F .A. C . CDM Smith will attach the required documentation necessary for . this part to the permit renewal application . Part 14 - A history and description of any enforcement actions by the applicant described in Chapter 62 - 701 . 320 ( 3 ) , F.A . C. relating to solid waste management facilities in Florida . CDM Smith will prepare a narrative of the history and description the enforcement actions by the applicant. Under this subtask, CDM Smith will participate in a teleconference pre- application meeting with FDER Subtask 1 . 2 — C & D Debris Landfill Permit Renewal Water Quality Monitoring and Reporting CDM Smith will perform the field testing, sample collection, and water- level measurements from the 10 C & D debris landfill groundwater monitor wells, which will be performed concurrently with the April 2012 Quarterly Monitoring event. CDM Smith will contract with Ideal Tech Services Inc. A- 2 113626 WO 3.docz ( ITS) to perform the groundwater sampling. The samples will be analyzed for the Permit Renewal Ground Water Monitoring Parameters in accordance with Paragraph 10 of the current Monitoring Plan Implementation Schedule, which was revised on March 7, 2011 . ENCU will perform the laboratory analysis under IRC SWDD ' s contract. The laboratory analytical reports must be delivered to CDM Smith no later than the close of business on April 18, 2012 in order to be included with the permit renewal application . CDM Smith will assist IRC SWDD in coordinating the analytical testing activities with ENCO, notify FDEP prior to sampling as required by the MPIS, review the analytical test results, and submit them as an attachment to the permit renewal application . Subtask 1 . 3 - Submit Permit Renewal Application The following will be produced and submitted : ■ CDM Smith will provide one draft copy of the landfill operations permit renewal application for IRC SWDD to review by close of business on April 16, 2012 . ■ CDM Smith will meet with IRC SWDD on the afternoon of April 17, 2012 to review and discuss the comments on the draft permit renewal application . ■ CDM Smith will prepare the final permit renewal application based on the comments obtained from IRC SWDD and submit the completed permit application and supporting documents to FDEP . CDM Smith will submit four copies of the completed permit application to FDEP by April 20 , 2012 . ■ CDM Smith will provide two copies of the permit application to IRC SWDD. ■ if requested by FDEP, CDM Smith will provide supplemental information in order to complete the application . Field work is not included . TASK 2 - MONITORING PLAN IMPLEMENTATION SCHEDULE TECHNICAL REPORT CDM Smith will prepare and submit a technical report in accordance with Chapter 62 - 701 . 510 ( 9 ) ( b ), F.A. C, and Paragraph 35 of the current Monitoring Plan Implementation Schedule, which was revised on March 7 , 2011 . The report will be based on laboratory data received from IRC SWDD . The report is required every 2 . 5 years during the active life of the facility. The report will include : 1 . Tabular displays of any data which shows that a monitoring parameter has been detected, and graphical displays of any leachate key indicator parameters detected (such as pH , specific conductance, Total Dissolved Solids (TDS) , TOC, sulfate, chloride, sodium and iron ), including hydrograph for all monitor wells , 2 . Trend analyses of any monitoring parameters consistently detected ; 3 . Comparisons among shallow, middle, and deep zone wells; 4 . Comparisons between background water quality and the water quality in detection and compliance wells; 5 . Correlations between related parameters such as total dissolved solids and specific conductance; 6 . Discussion of erratic and / or poorly correlated data; A- 3 j13626 WO ldo x 7 . An interpretation of the ground water contour maps, including an evaluation of ground water flow rates; and 8 . An evaluation of the adequacy of the water quality monitoring frequency and sampling locations based upon site conditions . ASSUMPTIONS ■ IRC SWDD will be responsible for permit application fees. ■ The C & D debris landfill groundwater monitor wells will need to be sampled and analyzed for the Permit Renewal Ground Water Monitoring Parameters listed in Paragraph 10 of the MPIS ■ IRC SWDD will be responsible for laboratory analysis fees. ■ Laboratory analytical reports will be due to CDM Smith by April 18, 2012 . ■ There have been no changes to the current Operations or Closure Plans . ■ A CCA treated wood management plan will need to be added to the current Operations Plan . ■ No additional survey will be required . ■ No additional geotechnical or hydrogeological investigations will be required . ■ This Scope of Services does not include any meetings with FDEP . DATA OR ASSISTANCE TO BE PROVIDED BY IRC SWDD ■ Existing data available on construction of the existing groundwater monitor wells ■ A complete copy of the previous biennial report ■ Relevant correspondence and documentation regarding operation of the C &D debris landfill during the last permit cycle ■ Relevant correspondence and documentation regarding compliance with the applicable rules and regulations ■ Available site surveys ■ Available record information ■ Laboratory analytical reports and direct access to laboratory personnel ■ Application fee PROJECT SCHEDULE The following project schedule has been developed based on receiving authorization on before April 17 , 2012 . Task 1 : CDM Smith will provide a draft copy of the permit renewal application for IRC SWDD to review by close of business on April 16, 2012 . CDM Smith will meet with IRC SWDD on the afternoon of April 17 , 2012 to review and discuss the comments on the draft permit renewal application . The final permit renewal application will be submitted to FDEP by April 20, 2012 . Task 2 : The draft MPIS Technical Report will be submitted to IRC SWDD by May 22 , 2012 . CDM Smith shall receive review comments from IRC SWDD by May 28, 2012 . The MPIS Technical Report will be submitted to FDEP by May 31 , 2012 , PAYMENT AND COMPENSATION Compensation for the Scope of Services described herein shall be made on the basis of a lump sum fee . The lump sum fee for Tasks 1 through 2 , inclusive, is $ 54, 900 as shown in Exhibit B . CDM Smith will invoice IRC SWDD on a monthly basis based on percent complete of each task. For invoice purposes only, the value of each task is as shown in the Table 1 .
