HomeMy WebLinkAbout9/11/1968WEDNESDAY, SEPTEMBER 11,1968 The Board of County Commissioners of Indian River County, Florida met in 'regular session at the Courthouse, Vero Beach, Florida on Wednesday, September 11, 1968 at 8:30 o'clock A. M. Present were Jack U. Dritenbas, Chairman; Robert W. Graves; Donald Macdonald and Richard P. Bogosian. Absent was D. B. McCullers, Jr., Vice Chairman. .Also present were Charles F. Williams and George W. Eyles, acting in the capacity of County Administrator; Sherman N. Smith, Jr., County Attorney; and Alfred H. Webber and Janet N. Burriss, Deputy Clerks., Absent was Jack G. Jennings, County Administrator. The Chairman called the meeting to order and suggested that a change be made on Page 11 of the minutes of August 21. On a Motion made by. Commissioner Graves, seconded by Commissioner Bogosian the minutes of August 21 were unanimously approved, this change having been made. Homer C. Fletcher, Tax Assessor, appeared before the Board and requested authorization for map work to beJdone by Honeycutt and Associates. A Motion was made by Commissioner Macdonald, seconded by Commissioner Bogosian and unanimously carried that the Board tentatively approves the proposal of Honeycutt and Associates as outlined in their letter of August 23 to furnish to the Indian River County Tax Assessor from the account of the Board of County Commissioners, -the map work there outlined, at a cost not to exceed $6,000.00, the map work to be performed under the direction of the Tax Assessor on a cost plus basis under : contract formula to be submitted to this Board and subject to its approval. John Sutherland, Attorney, appeared before the board requesting vacation by the County of an easement in Vero Lake Estates. On a Motion made by Commissioner Bogosian, seconded by Commissioner Macdonald the following Resolution was unanimously adopted: 111110k EE SEP 11 RES0LUTION68- 52 WHEREAS, under Chapter 57-1412, Special Acts of 1957, the Board of County Commissioners of Indian River County, Florida, was duly authorized and empowered by Resolution adopted without publication, to vacate and abandon and relinquish and disclaim the rights of the public acquired by dedication or otherwise, of any and all rights-of-way, easements, or alleys either conveyed to the said county or dedicated by plat or deed recorded in said county; and WHEREAS, AMERICAN MUTUAL CORPORATION, a Florida corporation, as a fee simple title owner for the benefit of STANDARD OIL COMPANY (incorporated in Kentucky) as purchaser, has duly petitioned the'Board of County Commissioners of Indian River.. County, Florida, to vacate and abandon a ten foot public utilities and drainage easement on the rear lot line of the following described property situate in Indian River County, Florida, to -wit: Lots 1, 2, 11, 12 and 13, Block D in the Plat of Vero Lake. Estates Sub- division, UNIT H-4, filed in the office of the Clerk of the Circuit Court of Indian River County, Florida in Plat Book 6, page 31, and WHEREAS, it appears that no notice thereof is necessary and that the rights Of adjacent parties will not be affected by the abandonment and the said easement is not required for public use or public purposes, BE IT, THEREFORE, RESOLVED by the Board of County Commissioners of Indian River County, Florida, in regular session on this, the llth day of September, A. Petitions the Board of County Commissioners Indian River County, Florida, as folloWs: A. That STANDARD OIL COMPANY (incorporated in Kentucky) is in the process of purchasing part of the following described property located in Indian River County, Florida, from your Petitioner, to -it: Lots 1, 2, 11, 12 and 13, Block D in the Plat of VERO LAKE ESTATES SIM - DIVISION, UNIT H-4, filed in the office.of.the Clerk of the Circuit Court of Indian. That the plat of said lands duly recorded in the public records of Indian River County, Florida, in Plat Book 6, page 31 shows the dedication of "a 10 foot public utilities and drainage easement on the rear lot line of Lots.1, 2, 11, 12 and 13. . . 3. They were informed that the Board of County Commissioners have .jurisdiction only over the Road and Bridge Employees. A Motion was made by Commissioner Macdonald, seconded by Commissioner Graves andunanimously carried that the County Administrator be authorized to work with the agents of the United Fund and to take the necessary action to carry out their program. SEP 11 Hu fA .f343 On a Motion made by Commissioner Macdonald, seconded by Commissioner Bogosian, the retroactive approval of the travel of the County Commissioners to Titusville on September 4 to attend a Regional Planning Council Meeting and to Orlando on September 10 to attend a Saint John's River Valley Advisory Committee Meeting was unanimously given. The request of Mr. Robert Lloyd that he be permitted to differ from County Subdivision Regulations on street construction for Van Trtctan Park Subdivision„was unanimously denied by the Board. On. a Motion made by Commissioner Bogosian, seconded by Commissioner Graves the performance bond of Burks Howder for the final approval of Pine View Park Extension in the amount of $30,000.00 was unanimously accepted by the Board and final approval was given. A Motion was made by Commissioner Macdonald, seconded by Commissioner Graves and unanimously carried that Edward Schlitt, Merrill P. Barber, M. L. Blume, Alfred M. Scattergood, J. Pat Corrigan, James Beindorf and Richard P. Bogosian be appointe3 to form the committee of the Indian River County Citizen's Planning Authority. A letter from Daniel D. Wasserman, Area Claims Manager, of the Florida Industrial Commission requesting additional space for its Unemployment Compensation Claims operation for Indian River County was received and discussed at length by the Board. The.Bo'ard referred the problem to the County Administrator; and the County Attorney advised that the County has no duty or obligation toward the housing of State Agencies. On a Motion made by Commissioner Macdonald, seconded by Commissioner Bogosian the Right -of -Way purchase from Gobel McKinley for a strip 25'X208' on State Road #507 at a cost of $300.00 was unanimously approved. The County Attorney reported that he has studied the draft of the new County Zoning Resolution as prepared by George Simon and that he will soon present the Resolution and recommended changes. The County Attorney reported that the Circuit Court has entered an, order directing the County to make up an additional jury list ,for the remainder of 1968 with an additional 400 names. The parties hereto agree that if the work is not being carried on in a mutually satisfactory manner, either party may terminate this agreement upon 60 days written notice to the other party. 5. Mr. Ralph Stogner requesting abandonment of certain lands on Old Dixie Highway was referred to the office of the Administrator. The Board then adjourned at 12:00 o'clock Noon and reconvened at 1:30 o'clock P. M. with the same members present. On Motion by Commissioner Graves, seconded by Commissioner Bogosian and unanimously carried, Commissioner Macdonald was authorized to travel to Tallahassee within the next two or three h weeks regarding several items of County business. Mr. Pat Corrigan, Mr. E. E. Carter, and Mr. M. H. Carlton, local representative of the U. S. Soil Conservation Service appeared before the Board and introduced Mr. James Weir, a Coordinator of the River Basin Investigation Program of the U. S. Department of Agriculture. He advised the Board that his office is cooperating with the Florida State Board of Conservation to make reports on several areas in the State, and to develop a Master Plan for soil and water conservation for many years to come. He stated that Indian River County as part of theSt. Johns River Basin and Intervening Coastal Area is rich' in land resources, but somewhat short on water resources. Mr. Weir then introduced Mr. Charles Saunders,•a civil engineer employed by the U. S. Department of Agriculture, who showed the Board a program of projection slides including maps and charts of water resources of this Area. The presentation showed proposed water management canals, the value of which could be greatly lessened • and perhaps made worthless by the construction of Highway I 95 as presently planned. The Board was made aware of the necessity for at least three large bridges under the new highway in order to allow the proper flow of water across Indian River County. Mr. Weir recommended that the Board communicate with both the State Road Board and Mr. J. B.
