The Board of County Commissioners of Indian River County, Florida
met in 'regular session at the Courthouse, Vero Beach, Florida on
Wednesday, September 11, 1968 at 8:30 o'clock A. M. Present were
Jack U. Dritenbas, Chairman; Robert W. Graves; Donald Macdonald and
Richard P. Bogosian. Absent was D. B. McCullers, Jr., Vice Chairman.
.Also present were Charles F. Williams and George W. Eyles, acting in
the capacity of County Administrator; Sherman N. Smith, Jr., County
Attorney; and Alfred H. Webber and Janet N. Burriss, Deputy Clerks.,
Absent was Jack G. Jennings, County Administrator.
The Chairman called the meeting to order and suggested that a
change be made on Page 11 of the minutes of August 21. On a Motion
made by. Commissioner Graves, seconded by Commissioner Bogosian the
minutes of August 21 were unanimously approved, this change having
been made.
Homer C. Fletcher, Tax Assessor, appeared before the Board and
requested authorization for map work to beJdone by Honeycutt and
Associates. A Motion was made by Commissioner Macdonald, seconded by
Commissioner Bogosian and unanimously carried that the Board tentatively
approves the proposal of Honeycutt and Associates as outlined in their
letter of August 23 to furnish to the Indian River County Tax Assessor
from the account of the Board of County Commissioners, -the map work
there outlined, at a cost not to exceed $6,000.00, the map work to be
performed under the direction of the Tax Assessor on a cost plus basis
under : contract formula to be submitted to this Board and subject to
its approval.
John Sutherland, Attorney, appeared before the board requesting
vacation by the County of an easement in Vero Lake Estates. On a
Motion made by Commissioner Bogosian, seconded by Commissioner Macdonald
the following Resolution was unanimously adopted:

WHEREAS, under Chapter 57-1412, Special Acts of 1957, the Board of County
Commissioners of Indian River County, Florida, was duly authorized and empowered
by Resolution adopted without publication, to vacate and abandon and relinquish and
disclaim the rights of the public acquired by dedication or otherwise, of any and
all rights-of-way, easements, or alleys either conveyed to the said county or
dedicated by plat or deed recorded in said county; and
WHEREAS, AMERICAN MUTUAL CORPORATION, a Florida corporation, as a fee simple
title owner for the benefit of STANDARD OIL COMPANY (incorporated in Kentucky) as
purchaser, has duly petitioned the'Board of County Commissioners of Indian River..
County, Florida, to vacate and abandon a ten foot public utilities and drainage
easement on the rear lot line of the following described property situate in Indian
River County, Florida, to -wit:
Lots 1, 2, 11, 12 and 13, Block D in the Plat of Vero Lake. Estates Sub-
division, UNIT H-4, filed in the office of the Clerk of the Circuit Court
of Indian River County, Florida in Plat Book 6, page 31,
and
WHEREAS, it appears that no notice thereof is necessary and that the rights
Of adjacent parties will not be affected by the abandonment and the said easement
is not required for public use or public purposes,
BE IT, THEREFORE, RESOLVED by the Board of County Commissioners of Indian
River County, Florida, in regular session on this, the llth day of September, A. D.
1968, that the ten foot public utilities and drainage easement on the rear lot lines
of the following described property, to -wit:
Lots 1, 2, 11, 12 and 13, Block .D in the Plat of Vero Lake Estates Sub-
division, UNIT H-4, filed in the office of the Clerk of the Circuit Court.
of Indian River County, Florida in Plat Book 6,. page 31,
be and the same is hereby abandoned and vacated and that all claims or rights of the
public acquired by dedication or otherwise in and to the said easement is relin-
quished 'and disclaimed.

PETITION TO VACATE EASEMENT
Comes now AMERICAN MUTUAL CORPORATION, a Florida corporation by and through
the undersigned attorney, and respectfully. Petitions the Board of County Commissioners
Indian River County, Florida, as folloWs:
A. That STANDARD OIL COMPANY (incorporated in Kentucky) is in the process
of purchasing part of the following described property located in Indian River County,
Florida, from your Petitioner, to -it:
Lots 1, 2, 11, 12 and 13, Block D in the Plat of VERO LAKE ESTATES SIM -
DIVISION, UNIT H-4, filed in the office.of.the Clerk of the Circuit Court
of Indian. River County, Florida 'in Plat Book 6, page 31.
2. That the plat of said lands duly recorded in the public records of Indian
River County, Florida, in Plat Book 6, page 31 shows the dedication of "a 10 foot
public utilities and drainage easement on the rear lot line of Lots.1, 2, 11, 12 and
13.

3. It is necessary that the aforesaid easement be vacated insofar as it
affects the above described property in order that a filling station may be con-
structed on the property over and across the said easements.
4. That the vacation of the said easement will not adversely affect the
surrounding lands or will not affect the ownership of persons owning other parts
of said subdivision.
5. That all state and county taxes on the said land have been fully paid as
shown in Abstract #30308, prepared by Title Security Company through the year 1967.'
WHEREFORE, Petitioner respectfully petitions the Board of County Commissioners
:of Indian River County, Florida to vacate and abandon and relinquish and disclaim
all the rights of the public acquired by the dedication of the aforesaid easements. •

Mr. Sappington. and Mr. Black appeared before the Board on behalf
of the United Fund, and requested that payroll deductions be allowed
for the Fund from County Employees' payroll checks. They were
informed that the Board of County Commissioners have .jurisdiction
only over the Road and Bridge Employees. A Motion was made by Commissioner
Macdonald, seconded by Commissioner Graves andunanimously carried that
the County Administrator be authorized to work with the agents of the
United Fund and to take the necessary action to carry out their program.

On a Motion made by Commissioner Macdonald, seconded by
Commissioner Bogosian, the retroactive approval of the travel of
the County Commissioners to Titusville on September 4 to attend
a Regional Planning Council Meeting and to Orlando on September 10
to attend a Saint John's River Valley Advisory Committee Meeting
was unanimously given.
The request of Mr. Robert Lloyd that he be permitted to differ
from County Subdivision Regulations on street construction for Van
Trtctan Park Subdivision„was unanimously denied by the Board.
On. a Motion made by Commissioner Bogosian, seconded by Commissioner
Graves the performance bond of Burks Howder for the final approval
of Pine View Park Extension in the amount of $30,000.00 was unanimously
accepted by the Board and final approval was given.
A Motion was made by Commissioner Macdonald, seconded by
Commissioner Graves and unanimously carried that Edward Schlitt,
Merrill P. Barber, M. L. Blume, Alfred M. Scattergood, J. Pat Corrigan,
James Beindorf and Richard P. Bogosian be appointe3 to form the
committee of the Indian River County Citizen's Planning Authority.
A letter from Daniel D. Wasserman, Area Claims Manager, of
the Florida Industrial Commission requesting additional space for
its Unemployment Compensation Claims operation for Indian River County
was received and discussed at length by the Board. The.Bo'ard referred
the problem to the County Administrator; and the County Attorney
advised that the County has no duty or obligation toward the housing
of State Agencies.
On a Motion made by Commissioner Macdonald, seconded by Commissioner
Bogosian the Right -of -Way purchase from Gobel McKinley for a strip
25'X208' on State Road #507 at a cost of $300.00 was unanimously
approved.
On a Motion made by Commissioner Graves, seconded by Commissioner

This Agreement, made and entered into this A/ day
of J,47f , 1968, by andbetwteen SOUTHERN BELL TELEPHONE
AND TELEGRAPH COMPANY, a corporation organized and existing under
the laws of the State of New York, hereinafter called the "Tele-
phone Company", and INDIAN RIVER COUNTY, a political subdivision •
of the State of Florida; hereinafter called the "County":.
WITNESSETH
WHEREAS, the Telephone Company is the fee simple owner
of a certain parcel of land situate inl Indian River County, Florida,
more particularly described as follows:
South 300 feet of East 830 feet of Tract
359, Fellsmere Farms Company's Subdivision,
Township 31 South, Range 37 East, according
to the Plat filed in the office of the Clerk
of the Circuit Court of St. Lucie County,
Florida, in Plat Book 2, pages -1 & 2.
WHEREAS, the Telephone Company has constructed, main-
tains and operates thereon, a radio relay repeater station which
constitutes a vital link to its .communications systems serving.

ON MOTION of Commissioner Macdonald , seconded by
Commissioner Bogosian the following Resolution was adopted:
WHEREAS, the State. Road. Department of Florida has established
loca-
tion for that part of State Road. 3-510 designated as Section 88050 y'

Bridge and approaches oniState Road 5-510 over'Intracoastal Waterway.
and proposes to construct and maintain the same as a part of its Secondary Road
program; and, Whereas, Traian River County is vested with all right
of way required for said road;
NOW, THEREFORE, the Board of. County Commissioners of Indian River
County does hereby affirm that it is vested with all of the required right of
way for said portion of said. State Road, and that said right of way is legally
clear and has been physically cleared of all buildings, fences and other im-
provements; that all utility poles, lines, cables, pipes and other facilities
have been removed or adjusted as required for construction of said project by
the State Road Department or such removal, and/or adjustments have been ar-
ranged for and will be effected without delay to the State Road. Department and/or
its contractors; andthe State Road. Department is hereby requested to proceed
with the construction and maintenance of said.portion of said. State Road; and.
Indian River County hereby agrees to save harmless the State Road De-

partment, its contractors, agents and employees, from all claims arising out of

The Board of County Commissioners of Indian River County, Florida
That The Moorings Development Company has filed its petition with
this Board requesting that this Board renounce and disclaim any right of the
county and the public in and to all land or interest therein acquired by dedi-
cation for street, alleyway, road or highway purposes delineated and shown
as Floralton Boulevard upon the Plat showing property of Col. Joseph W.

Walton in Sections 21, 22, 27 and 28 in Township 33 South, Range 40 East,
Indian River County, Florida, recorded in Plat Book 3, page 30, in the office
of the Clerk of the Circuit Court of said County, none of which now constitutes
or was acquired for a state or federal highway and none of which is located
within the limits of any incorporated municipality. This Board does herewith
declare that a public hearing will be held to consider the advisability of
granting the petition and exercising the authority granted by Section 336.09,

The County Attorney reported that he had replied to the letter
of August 30 from Jones, Adams, Paine and Foster regarding a claim
for injuries and damages caused by the alleged defective condition
of State Road A1A, in the effect that AlA is a state road under
the sole jurisdiction of the State Road Department and that the
County does not carry public liability insurance with respect to its
roads and therefore has no liability.
The County Attorney reported that he has studied the draft of
the new County Zoning Resolution as prepared by George Simon and
that he will soon present the Resolution and recommended changes.
The County Attorney reported that the Circuit Court has entered
an, order directing the County to make up an additional jury list
,for the remainder of 1968 with an additional 400 names.
On a Motion made by Commissioner Graves, seconded by Commissioner
Bogosian and unanimously carried, the following persons were selected,
in compliance with the Laws of Florida to be placed on the Indian
River County Jury List for the year 1968.

A Motion was made by Commissioner Macdonald, seconded by
Commissioner Bogosian that.. the. Members of the Board of County
Commissioners and the County Administrator be authorized to attend
a Shoreline Erosion Program to be held in West Palm Beach on
September 12 was unanimously approved.
On,a Motion made by Commissioner Graves, seconded by Commissioner
Macdonald and unanimously carried that the wages of the County
Administrator be increased to $13,000.00 per year effective as of
October 1, 1968.
A Motion was made by Commissioner Bogosian, seconded by
Commissioner Graves and unanimously carried that the Clerk be
authorized to deposit the unbudgeted surplus collections of Race
Track Funds for the year ending September 30,.1968 as follows:

On a Motion made by Commissioner Graves, seconded by Commissioner
Bogosian the out of County travel of the. County Agricultural Agent
to Cocoa to attend Extension Workers' Conference on September 6 and 7,
to Fort Pierce to attend South Florida Tomato Growers' Institute
on September 11, and to Indian River Field Laboratory,Fort Pierce
to meet with Research Personnel on September 18 was unanimously
approved.
The Monthly Reports of the County Agricultural Agent, the
County -Service Officer and the County Welfare Case Worker were
received and placed on file in the office of the Clerk.
Mr. L. J. Snell of Ocala and Mr. L. G. Craine of Orlando appeared
before the Board in regard to the Agreement for Investigation of
Water Resources between Indian River County and Florida Board of
Conservation, Division of Geology. Mr. Snell Stated that Mr. Craine
would be working on the investigation of water resources in Indian
River County and was now ready to start on the project. The Chairman
expressed the gratitude of the Board to these Gentlemen for appearing

and they were introduced to Doctor Britton and Mr. Sellers who
will aid them in the program.
On a Motion made by Commissioner Macdonald, seconded by Commissioner

1. The parties hereto agree that subject to the availability of appropri-
ations and in. accordance with their respective authorities, there is in existence
a cooperative agreement for investigation of water resources of the State of
'Florida between the FLORIDA BOARD OF CONSERVATION -DIVISION OF
GEOLOGY, the U. S. GEOLOGICAL SURVEY, and Indian River County, Florida.
2. Party of the first part agrees that records, reports, and other '
items of information resulting from this investigation shall be made available
to party of the second part upon request, as promptly as possible.
3. Party of the second part agrees to contribute the sum of $ 15. 000. p0
toward the cost of the necessary field and office work directly related to this
investigation for the period October 1, 1968 through September BOE 19h9.
Such funds shall be made payable in advance to the Florida Board of Conservation -
Division of Geology and placed in a trust fund with the State Treasurer for
disbursement to the U. S. Geological. Survey upon receipt of vouchers from
the U. S. Geological Survey. Such funds shall be matched by State and/or
Federal. funds.
4. The parties hereto agree that if the work is not being carried on in
a mutually satisfactory manner, either party may terminate this agreement
upon 60 days written notice to the other party.
5. All non -expendable property necessary for the performance of this
investigation shall be purchased from funds made available by the Florida
Board of Conservation -Division of Geology or the U. S. Geological Survey.

Mr. Ralph Stogner requesting abandonment of certain lands on
Old Dixie Highway was referred to the office of the Administrator.
The Board then adjourned at 12:00 o'clock Noon and reconvened
at 1:30 o'clock P. M. with the same members present.
On Motion by Commissioner Graves, seconded by Commissioner
Bogosian and unanimously carried, Commissioner Macdonald was
authorized to travel to Tallahassee within the next two or three

weeks regarding several items of County business.
Mr. Pat Corrigan, Mr. E. E. Carter, and Mr. M. H. Carlton,
local representative of the U. S. Soil Conservation Service appeared
before the Board and introduced Mr. James Weir, a Coordinator of
the River Basin Investigation Program of the U. S. Department of
Agriculture. He advised the Board that his office is cooperating
with the Florida State Board of Conservation to make reports on
several areas in the State, and to develop a Master Plan for soil
and water conservation for many years to come. He stated that
Indian River County as part of theSt. Johns River Basin and
Intervening Coastal Area is rich' in land resources, but somewhat
short on water resources.
Mr. Weir then introduced Mr. Charles Saunders,•a civil engineer
employed by the U. S. Department of Agriculture, who showed the
Board a program of projection slides including maps and charts of
water resources of this Area. The presentation showed proposed
water management canals, the value of which could be greatly lessened
• and perhaps made worthless by the construction of Highway I 95 as
presently planned.
The Board was made aware of the necessity for at least three
large bridges under the new highway in order to allow the proper
flow of water across Indian River County. Mr. Weir recommended
that the Board communicate with both the State Road Board and Mr.
J. B. Solohub of the State Water Resources and Conservation Division

in Tallahassee regarding this matter. Commissioner Macdonald
volunteered to include this with the other items of Comity
business about which he is shortly going to Tallahassee.
At this point Commissioner Graves left the meeting.

Commissioner Bogosian and unanimously carried, all bids were
