EXTENSION OF STATUTE OF LIMITATIONS a.o i 3 � 11 SA
On behalf of the City of Fellsmere (the "City") , and pursuant to the vote of the City
Council taken on September 5 , 2013 , the City through the undersigned, hereby promises and
agrees not to plead Section 95 . 11 (3 )(p) F . S . (statute of limitations) as a defense to any litigation
by Indian River County brought against the City with respect to Ordinance No . 09 - 17 pertaining
to the City ' s and City ' s Fire Marshall ' s Office ' s authority to review and approve or reject plans
and specifications for new occupancies, building renovations or additions, installation of fire
protection or detection systems, fire and life safety related installations for compliance with the
Florida Fire Prevention Code or the Florida Building Code, for a period of one hundred twenty
( 120) calendar days from September 5 , 2013 . This extension is binding upon the City Council,
City Manager, City Attorney, City Fire Marshall and all other employees and representatives and
agents of the City during said one hundred twenty ( 120) day period.
