The Board of County Commissioner of Indian River County, Florida
met in regular session at the Courthouse, Vero Beach Florida on
Wednesday, October 23, 1968 at 8:30 o'clock A. M. Present were Jack
•
U. Dritenbas, Chairman, Robert W. Graves and Richard P. Bogosian.
Absent were D. B. McCullers, Jr., Vice Chairman and Donald Macdonald.
Also present were Jack G. Jennings, County Administrator; Sherman N.
Smith, Jr., County Attorney and Alfred H. Webber and Janet N. Burriss,
Deputy Clerks.
The Chairman called the meeting to order and asked if there were
any corrections or additions to the minutes of September 30, October
9 and October 10. There were none and upon Motion made by Commissioner
Bogosian, seconded by Commissioner Graves and unanimously carried, the
minutes were approved as written.
Frank Rogel of the R. D„ Carter Engineering Firm, acting in behalf
of Mr. Edward Carr appeared before the Board regarding the Mobibhomes
subdivision called Indian River Acres Subdivision. Due to the small
size of the lots and Subdivision Regulations regarding septic tanks,
a Motion was made by Commissioner Graves, seconded by Commissioner
Bogosian and unanimously carried that the tentative approval of this
plat be tabled until the matter can be further studied and the matter
can be taken up with the State Board of Health.
A Motion was made by Commissioner Bogosian that approval be given
for the abandonment of Riverview Road as shown on Dixie Heights
Subdivision Unit ##3. Due to lack of second the Motion was not carried.
A Motion was made by Commissioner Graves that the request for

abandonment of Riverview Road as shown on Dixie Heights Subdivision
be denied., Due to lack of second the Motion was not carried.
The Administrator reported that the State Road Department will
mail a report on the findings of the traffic study at SR 5 and
SR 510, with recommendations.

Civil Defense Building Repairs.
Specifications may be obtained in

1. Sandblast the entire two (2)
story building, cut out and pateh
all stucco cracks and loose
stucco, and color -Crete, color to
match the jail building, all
corners to be plumb and
straight.
ALTERNATE:
1. Sandblast the entire two (2)
story building, apply sernteh
cont, then finish cont of cement
stucco, niter whieh a prime
coat and two (2) finish coats of
exterior cement paint (Sec.
waterproof paint) or equal shall
be applied.
All windows and doors shall be
scraped and sanded, and receive
one (1) cont of Aluminum prime
cont, followed by two (2) coats
of exterior white paint: after
prime coat has dried all win-
dows and doors shall be caulked
and sealed.
After all work is completed, the
area shall be cleared of all ex-
cess materials and left clean.
Inspection will be made before
final painting and shrinkage
cracks filled.

A Motion was made by Commissioner Bogosian, seconded by Commissioner
Graves and unanimously carried that these bids be referred to the
Administrator in order that he may consider and examine them to
determine the lowest and best bid and make his recommendation to the
Board.

Thomas H. Trent, Civil Defense Director presented an additional
list of repairs and improvements to the Civil Defense Building. He
was told this list would be considered after the repairs were made
on the exterior of the building.
Mr. Trent stated that there would be a Civil Defense Meeting
regarding Emergency Operating Centers to be held in Wildwood on
November first and that the Commissioners were invited to attend.
A letter was received from the State Road Department stating that
a semi -actuated control signal is justified at the intersection of
SR5 and SR S -5A in Gifford. The Administrator was requested to advise
the Board of the cost of this signal at a later meeting.
Mr. J. B. Norton and Mr. Butler of the Vero Beach -Indian River
County Chamber of Commerce appeared before the Board stating that
their outdoor advertising program has placed nearly all its signs
within the County and that they felt these signs would be more effective
if they were moved into areas outside the County with more congested
traffic. There was no objection by the Board.
A Motion was made by Commissioner Bogosian, seconded by Commissioner
Graves and unanimously carried that the Board or the County Administrator
be authorized to have $250.00 paid to the City of Fellsmere in reply
to their letter of October 12, 1968, to be used for repair and renovation
of the Fellsmere Community Building which is to used -by the County
Health Department, with the recommendation that the building be inspected
for termites before renovation is started.
Upon a Motion made by Commissioner Bogosian, seconded by Commissioner
Graves and unanimously carried the County Administrator was authorized
to advertise for bids for the purchase of an endloader according to
specifications required; and that $20,000.00 of the funds needed to make
this purchase would be taken out of the General Fund and the additional
amount . , required would be taken out of the Road and Bridge Fund.
A Motion was made by Commissioner Graves, seconded by Commissioner
Bogosian and unanimously carried that the County Attorney is requested
to prepare a resolution to the effect that no trucks exceeding the

the poundage of 2' tons will be permitted to use 6th Avenue as far
as.•the City limits.
On a Motion made by Commissioner Bogosian, seconded by Commissioner
Graves, it was unanimously carried that abandonment by"the County be
made on:
That certain public utility and drainage easement
over the South 5 feet of Lot 16, Block 1, Glendale
Terrace; and that certain public utility and
drainage easement over the North 5 feet of Lot 15,
Block 1, Glendale Terrace, as the same is dedicated
upon the Plat of Glendale Terrace, which is recorded
in Plat Book 5, Page 66, Public Records of Indian
River County, Florida
Except, However, the East 5 feet of both said
easements.

Dear Mr. Fletcher:
Pursuant to your request, we are pleased to 'submit our estimate to update
existing sectional maps of Indian River County and to prepare therefrom
auto -positives.
We estimate the work would cost approximately $6, 000 and would include
the following:
1. Make ownership boundary changes in pencil on existing
sectional plats as reflected by your tax roll workbook.
It is understood this will involve between 4, 000 and
5, 000 changes and does not include drafting of new sub-
division plats or preparation of any new maps.
2. Upon,com.pletion of the updating process, the maps
shall be transported to St. Petersburg, where auto -
'positives will be made of each sectional map. The
auto -positives will serve as paper tracings from which
blue -line prints can be made. •
Prior to submitting the firm price, we will wish to have one of our map
department personnel spend two or three days in your office to more
closely determine the exact extent of work involved. Please let us know.

On a Motion made by Commissioner Graves, seconded by Commissioner
Bogosian, the following Resolution was unanimously adopted:
RESOLUTION NO. 68- 59
The Board of County Commissioners of Indian River County, Florida,
resolves:
That the form of contract submitted to this Board dated October

1968, between Indian River County and Hunnicutt & Associates, Inc. , involv-
ing preparing, updating and copying tax assessment maps of the County in the
office of the County Tax Assessor is approved and the Chairman and Clerk of
this ,Board are authorized and directed to make, execute and deliver the said
agreement for and upon behalf of the County.

Graves,' the following easement agreement was unanimously accepted:
EASEMENT.
THIS EASEMENT, Made and entered into this tR / day of Octobe
1968, between W. F. EUBANKS, JR. , and GERTRUDE K. EUBANKS, his wife,
hereinafter called the "Owners, " and INDIAN RIVER COUNTY, FLORIDA, a
political subdivision of the State of Florida, hereinafter called the. "County, "
WITNESSETH:
In consideration of the sum of Ten Dollars ($10. 00) and other
val uable considerations in hand paid by the County to the Owners, the Owners
do herewith give and grant .unto the County the exclusiveright, option and
privilege for the term of six (6) months from this date to go upon the prop-
erty of the Owners situated in Indian River County, Florida, consisting of the
West 20 acres of Tract 4, Section 17, Township 33 South, Range 39 East,
according to the last general plat of lands of the Indian River Farms Company
except the right of way for roads, canals and ditches as shown upon said plat,
and to excavate and remove the earth from said property and to leave remain-
ing a borrow pit, all without payment of any further compensation to the
Owners.
In exchange for this temporary easement, the County agrees that it
will slope, grade and dress up the borrow pit remaining and except for the
water areas in the borrow pit, restore the land surface within the period of
time of the existence of this easement. When the period of time expires, this
easement shall becothe null and void. '
IN WITNESS WHEREOF, the Owners have hereunto set their hands
and seals•and the County has caused these presents to be executed in its name
by its Board of County Commissioners, acting by the Chairman or Vice
Chairman of said board, •and attested by the Clerk or a deputy Clerk of the
Circuit Court.

Upon a Mctton made by Commissioner Bog3sian, seconded by
Commissioner Graves, the following Resolution was unanimously
adopted:
RESOLUTION NO. 68- 60
The Board of County Commissioners of Indian River County
resolves:
1. Pursuant to Section 194. 47, Florida Statutes, Ralph Harris,
as Clerk of the Circuit Court in and for Indian River County, Florida, has
prepared in triplicate and delivered this date to the Board of County Commis-
sioners of Indian River County, Florida, in duplicate a complete schedule or
list, duly certified by him, of all lands in Indian River County, Florida, upon
which tax certificates were .issued at the County Tax Collector's sales of lands
for unpaid delinquent taxes held on the first days of June in the years 1943,
1946, 1948, 1949, 1950, 1953, 1954 and 1966, as were bid off by said Tax
Collector for said County and which taxes have not been redeemed or
purchased.
2. One said schedule or list has been retained by the said
Clerk of the Circuit Court and is on file in his said office, the second said
schedule or list is attached as Exhibit A to this Resolution, and the third said
schedule or list shall be delivered this date to Sherman N. Smith, Jr. , as
County Attorney.
3. Within ninety (90) days after the date of this Resolution,
Sherman N. Smith, Jr. , as County Attorney, shall cause a Complaint to be
filed in -the Circuit Court of said county in the name of said county and against
any and all of the lands described in the said schedule or list as defendant,

I, RALPH HARRIS, as Clerk of the Circuit Court in and
for Indian River County, Florida, do hereby certify that the Tax
Collector of Indian River County, Florida, did on the 1st day of
June, 1943, 1946, 1948, 1949, 1950, 1953, 1954 and 1966, respectively,
sell, as provided by law, all lands in said County delinquent for
taxes assessed against such lands upon the County tax assessment roll
of said County for the years 1942, 1945, 1947, 1948, 1949, 1952, 1953
and 196S, respectively. That the foregoing schedule or list of lands
contains and describes all such lands as were bid off by the Tax
;Collector of Indian River County, Florida at said sale held June 1,
1943, 1946, 1948, 1949, 1950, 1953, 1954 and 1966, respectively, for
the County and which taxes have not been redeemed or purchased and

The Board of County Commissioners of Indian River County,

That the Agreement between Indian River County, Florida, and the
City of Vero Beach, Florida, dated November 17, 1967, pertaining to the City
performing the duties and functions of the Building Department of the County
has resulted in an arrangement entirely satisfactory to the County and of
mutual benefit to the parties and the citizens which the parties e.
That said Agreement in Paragraph 8 provides th t it may be can-
celled by either party giving notice to the other but rather than a notice of
cancellation, the County by this Resolution advises the City that it is its
present intention to continue this arrangement indefinitely and the County
inquires as to whether or not this intention is shared by the City. If so, the
County agrees herewith that the effective time of any notice of cancellation
should and will by the consent of the City be changed from sixty (60) days to
six (6) months.

Upon a Motion made by Commissioner Bogosian, seconded by
Commissioner Graves the following Resolution was unanimously adoptee:
RESOLUTION NO. 68- 62
The Board of County Commissioners of Indian River County,
Florida, resolves:
1. That the Resolution heretofore adopted by this Board known as
the Subdivision Resolution of Indian River County, Florida, is hereby
amended as follows:
A. Section X-4 (a) is amended to read:
"Swale ditches are not permitted within the area
of any street. Instead of swale ditches, all
streets shall be constructed so that the paved
portion of each street will provide drainage. "
B. • Section X-4 (b) is s.mendedto read:
"All areas on both sides of all paved areas of
all streets extending from the pavement to the
,property line shall be seeded, sprigged or
sodded with an approved type grass after com-
pletion of the finished grading. Seeding shall
be 30 lbs. of Bermuda seed per acre with 200
lbs. of fertilizer per acre. Any other alternate
requires prior approval. "
C. Section X-4 (c) is amended to read:
"All driveways leading from the paved portion
of any street shall be paved to conform to the
contour of the land. "
D. Section X-4 (d) is amended to read:
"The area between the paved portion of any
street and the adjoining property line shall be
graded to permit surface drainage to flow over
and into a swale type concrete gutter commonly
known as 'a Miami curb' which shall be con-
structed along both outer edges of the paved
portion of each street. A typical section
drawing of such a Miami type curb will be made
available by the county on request. "
E. Section X-4 (e) is amended to read:
"All concrete gutter sections shall make pro-
vision for intersecting with other drainage
facilities with concrete outlets and changes in
typical sections of the Miami type curb to
assure drainage from the gutter. All culverts
under roadways shall have rip rap or concrete
headwalls. "
F. Add a section following Section X to be known as
Section XI• and renumber all subsequent sections, which said

"XI. By the presentation of the final plat for approval
and recording, the subdivider thereby agrees to main-
tain in good condition all improvements required to be
placed upon the land pursuant to this Resolution for a
period of one (1) year from the completion of the last
of such improvements. To maintain in good condition
means that at the end of the period mentioned, the
improvements shall at the end of said period be in
such condition that they meet the requirements of this
Resolution as it existed at the time of final approval of
the plat. "

A letter was received from B. J. McCullers, President of the
Citrus School P. T. A. requesting that pedestrian paths extending
from Citrus Road North to S. R. 60 be included in the State Road
Department plans for Emerson Avenue. After some discussion and verbal
contact with Mr. McReynolds, Principal of the School, a Motion was
made by Commissioner Bogosian, seconded by Commissioner Graves and
unanimously carried that the State Road Department be asked to
revise their plans for SR 607 to include bicycle paths and concrete
sidewalks from the South Relief Canal to Rosedale Road.
The County Attorney reported that he had received a letter from
the Trustees of the Internal Improvement Fund regarding the repurchase
of the McLarty submerged lands and that after an answer has been
received from the Attorney General as to how to handle the matter, a
decision will be made by*the Trustees.
On a Motion made by Commissioner Graves, seconded by Commissioner
Bogosian and unanimously carried, Commissioner Macdonald, attending a
sale of office furniture in Titusville on Wednesday, October 23, 1968
was authorized to take the following action on behalf of the Board:
Purchase one eight -section conference table from C. S. Goshorn,
Box 566, Titusville for $45.00
Purchase 13 stack chairs from Alex Chamberlin, 8 South Street,
Titusville for $3.00 each.
Purchase on Blue Ray Blueprint Machine from East Central Florida,
Regional Planning Council, 2323 South Washington Avenue,
Titusville for $50.00
Purchase 4 ash trays from East Central Florida Regional Planning
Council, 2323 South Washington Avenue, Titusville for $1.00 each.
Rent from King Car and Truck Rental, 2 South Hopkins Street,
Titusville, one moving van at $20.00 for a period of 24 hours
plus mileage of 10 per mile and actual cost of gasoline used,
together with the necessary furniture pads at $2.00 per pad
per day.

A Motion was made by Commissioner Bogosian, seconded by Commissioner
Graves and unanimously carried that the request of the Clerk and the
Supervisor of Elections that the pay of the Election,Officials and
Deputies be_inkeated_from:$1.00 an hour to $1.25 per hour be granted.
On a Motion made by Commissioner Bogosian, seconded by Commissioner
Graves the loan of the fire truck by Florida Forestry Service for the
purpose of use for brush fires is accepted and the additional cost for
insurance of $155.00 is unanimously approved.
The several bills and accounts against the County having been
audited, were examined and found to be correct were approved and
warrants issued in settlement of same as follows: General Fund, Nos.
1685 to 1723 inclusive; Road and Bridge Fund, Nos. 1164 to 1185
inclusive; Fine and Forfeiture Fund, Nos. 118 to 120 inclusive.
Such bills and accounts being on file in the office of the Clerk of
the Circuit Court, the warrants so issued from the respective funds
being listed in the Supplemental Minute Book as provided by the rules
of the Legislative Auditor, reference to such record and list so
recorded being made a part of these minutes.
