WORD ORDER NUMBER l I ONLY WORK ORDER TASKS 14 SECTOR 3 BEACH AND DUNE RESTORATION PROJECT PRASE 2 — CONSTRUCTION PHASE SERVICES This Work Order Number 11 is entered into as of this 12 day of October 2010 pursuant to that certain Continuing Contract Agreement for Professional Services entered into as of December 13 , 2005 and amended December 8 , 2008 (" Agreement") , by and between Indian River County, a political subdivision of the State of Florida ("COUNTY ") and Coastal Technology Coloration ("CONSULTANT") . The COUNTY has selected the Consultant to perform the professional services set forth on Exhibit 1 , attached to this Work Order and made part hereof by this reference . The professional services will be performed by the Consultant for the fee schedule set forth in Exhibit 2 , attached to this Work Order and made a part hereof by this reference . The Consultant will perform the professional services within the timeframe more particularly set forth in Exhibit 2 , attached to this Work Order and made a part hereof by this reference all in accordance with the terms and provisions set forth in the Agreement . Pursuant to paragraph 1 . 4 of the Agreement , nothing contained in any Work Order shall conflict with the terms of the Agreement and the terms of the Agreement shall be deemed to be incorporated in each individual Work Order as if fully set forth herein . De rail , Deputy ounty Attorney EXHIBIT 1 Indian River County Sector 3 Phase 2 - Construction Phase Services Scope of Work WORK ORDER 11 Sector 3 Beach and Dune Restoration Project Phase 2 - Construction Phase Services Overview : This Scope of Work is intended to provide services in support of construction and monitoring prior to, during, and after construction of Phase 2 of the Sector 3 Beach and Dune Restoration Project. Phase 2 construction is expected to : • employ the same upland sand sources and Contractor as employed in Phase 1 construction , and ■ occur between December 1 , 2010 and April 30, 2011 . Note that the monitoring under this Scope of Work provides for immediate post-construction monitoring of the Phase 2 fill area and the "year l " annual monitoring for the previously completed Phase I fill area — subject to approval of FDEP . In general , the work will support the efforts of COUNTY staff, be performed by COASTAL TECH, and supported (via sub-contracts) by Ecological Associates, Inc . ( EAI ), CSA International , Inc . (CSA ), Aerial Cartographics of America (ACA), Morgan & Eklund , Inc . (M &E), and Inwater Research Group (IRG) as described below . The following describes the work under this Scope of Work: Part 1 — Pre- Construction Services Specific Condition 33 of the FDEP permit and Special Condition 5 of the USAGE permit require obtainment of a Notice to Proceed for Phase 2 construction in accordance with the "Nesting Test Plan" . The work under Part I entails a Notice-to-Proceed and pre-construction meeting - as required for Phase 2 construction . Task la — FDEP Notice to Proceed : The COUNTY will submit the Nesting Test Plan results to the ACNWR, IRC Marine Turtle Research , USF&WS and FFWCC by October 30, 2010 as expected to obtain - within 15 days - a favorable review and response from these agencies . COASTAL TECH will participate in up to two telephone conference calls with these agencies . If required, the COUNTY and COASTAL TECH will also schedule a meeting with ACNWR, IRC Marine Turtle Research, USF&WS and FFWCC to discuss the reproductive success data compiled under the agency approved Nesting Test Plan . COASTAL TECH will assist the COUNTY with obtainment of written confirmation from all agencies that the conditions of the Nesting Test Plan have been met for the COUNTY to proceed with Phase 2 construction utilizing the upland sand sources . The COUNTY will obtain a Special Use Permit from Archie Carr National Wildlife Refuge to place fill in the refuge . Upon favorable results as described above, COASTAL TECH will compile and submit the following information to FDEP to obtain the required Notice to Proceed utilizing an upland sand source : (a) USFWS and FFWCC written confirmation that the conditions of the "Upland Sand Source Sea Turtle Nesting Test Plan " have been met, ( b) the Special Use Permit from Archie Carr National Wildlife Refuge, (c) a revised project description to include restoration of the Phase I construction template and R20 to R33 (Phase 2 fill area) (d ) signed/sealed construction drawings , (e) Technical Specifications, ( f) Resumes of consultants proposed to conduct shorebird , turtle, and biological monitoring services, Page I of 8 October 4 , 2010 Indian River County Sector 3 Phase 2 - Construction Phase Services Scope of Work ( g) Resumes of turbidity monitor and the Contractor' s construction supervisor. COASTAL TECH will informally confer with the COUNTY and FDEP to expedite obtainment of the FDEP Notice to Proceed . Task lb — Pre-Construction Conference : After issuance of the Notice to Proceed , the COUNTY will prepare an agenda, Chair the pre-construction conference, and prepare a written summary of the conference . COASTAL TECH will : ( a) arrange and attend a meeting between the COUNTY, FDEP , FFWCC , EAI and USACE and support the COUNTY (to serve as Chair) in association with the required pre-construction conference (per FEP Specific Condition 5 ),and (b) provide written notice of commencement of construction to FDEP, FDEP District Office, and USACE per FDEP General Condition 9 . Part 2 — Services During Construction In general, the COUNTY will administer the Construction Contract for Phase 2 ; COASTAL TECH will generally monitor construction progress and spot-check construction to provide assurances that the work is constructed in reasonable conformity with the Drawings, General Conditions, Technical Specifications, applicable permits, and the Construction Contract, Task 2 — Phase 2 Engineering Services : The COUNTY will administer the Construction Contract and provide all communications to the Contractor relative to the Project. The COUNTY will directly observe and monitor the Contractor ' s work to determine the progress and quality of the work, identify discrepancies and report significant discrepancies to the Contractor and COASTAL TECH . The COUNTY will keep accurate detailed records of the Contractor' s daily operations and of significant events that affect the work. The COUNTY will provide to COASTAL TECH a written summary of the Contractor' s progress on a weekly basis for review during Phase 2 . During construction , the COUNTY will : (a) Monitor the Contractor' s work for compliance with the USACE and FDEP permits . ( b) Check that the Contractor maintains Record Drawings — as are required by the General Conditions of the Contract Documents . (c) Check the layout of the work by the Contractor. (d ) Monitor the condition of FDEP survey reference monuments , and the Contractor ' s care of these monuments . (e) Monitor the Contractor' s mobilization and demobilization of men and equipment . (f) Monitor the Contractor' s transport of material from the upland mines to the beach fill area. (g) Monitor the details of the work including final grading and dressing of placed fill . (h ) Monitor the Contractor' s work area and measures to provide for public safety . ( i ) Monitor turbidity monitoring and reporting by the Contractor including the Contractor ' s Testing Certificate . Submit the required turbidity reports to FDEP ( per FDEP Specific Condition 47) . (j ) Monitor the Contractor ' s compliance with the Sediment QA/QC Plan . (k) Monitor the Contractor ' s work relative to any impacts to any historical , archeological , and cultural resources . ( 1 ) Check the work for substantial compliance and monitor the Contractor ' s final clean- up of the project site including the staging areas and trucking routes . ( m) Document and monitor conditions of the areas to be used by the Contractor including truck routes, staging areas, and the overall Project area before, during, and after construction . (n) Collect and deliver (< 25 ) sand samples to COASTAL TECH ' S Vero Beach office . Page 2 of 8 October 4, 2010 Indian River County Sector 3 Phase 2 - Construction Phase Services Scope of Work (o) Confer with existing Marine Turtle Permit Holders to coordinate work ( see Part 3 ) . ( p) Perform compaction testing along the Phase 1 and 2 Project area (per FDEP Specific Condition 23 ) ( q) Take representative photographs along each fill acceptance section and compile them in a document to photo -document that the Contractor tilled the beach following completion of each fill acceptance section of Phase 2 . (r) Monitor the Contractor ' s dune planting and submit an as-built (Phase 2 ) report within 30 days of planting completion and a post-Phase 1 annual post-construction dune vegetation monitoring report to FDEP (per FDEP Specific Condition 14). During construction , COASTAL TECH will : (a) Analyze pre-construction surveys (obtained via prior authorization as "post-Phase 1 Construction Survey" under WORK ORDER NUMBER 8 ) to re-assess the estimated volume required for construction . (b) Amend the Technical Specifications and Drawings to incorporate amendments as may be required by FDEP Notice to Proceed and updated survey data . (c) Produce and deliver five (5 ) sets [two (2 ) for the COUNTY and three (3 ) for the Contractor) of the amended Technical Specifications and Drawings to the COUNTY with digital copies furnished to the COUNTY upon request. (d) Conduct site visits at the mine and construction area ( if allowed access to the mine ) to spot check the Contractor' s progress and construction . (e) Perform independent spot-check sampling (obtained during site-visits by COASTAL TECH or otherwise provided by the COUNTY) and analysis (< 25 samples) of sediment samples to check the Contractor ' s compliance with the Sediment QA/QC Plan . ( f) Check the work for substantial compliance with the Drawings , General Conditions, Technical Provisions , applicable permits, and the Construction Contract. ( g) As may be requested by the COUNTY , review up to two (2) Change Orders for approval by the COUNTY and Contractor. ( h ) Prepare Construction Field Directives . ( i ) Interpret the Contract Documents , 0 ) Seek to resolve claims by the Contractor and/or COUNTY . ( k) Consult and advise the COUNTY relative to progress and requirements of the Project . ( 1) Review payment applications from the Contractor, and prepare Certificates recommending payment by the COUNTY . ( m ) Prepare and submit a Final Certification to FDEP . ( n ) Provide as-built drawings and a completed As-Built Certification form to the USACE with pre-Phase 2 construction aerial photographs (obtained via prior authorization as "post-Phase 1 construction controlled aerial photography" under WORK ORDER NUMBER 8 and post— Phase 2 construction aerial photographs (collected under Task 5 - if completed and available) per USACE Special Condition 9 . ( o) Prepare and submit a letter to the agencies summarizing the findings of items p and q in Task 2 above . (p) Under subcontract with M&E, perform "pay profile surveys" and determine actual quantities placed by the Contractor for acceptance of fill segments at a minimum segment length of 1 , 000 feet with pay profiles at a spacing of 100 feet; for Phase 2 a total of 138 "pay surveys" are required, for the uncompleted portion of Phase 1 a total of 21 "pay surveys" are required, for a the completed portions of Phase 1 to be "touched up" in conjunction with Phase 2 a total of 25 "pay surveys" are required ; a total of 184 " pay surveys" are planned to coincide with spot checks during construction . These surveys will be performed within two weeks prior to Page 3 of 8 October 4, 2010 Indian River County Sector 3 Phase 2 - Construction Phase Services Scope of Work beach fill being placed and within one week after the beach has been filled along each 1 , 000 foot long acceptance section . Pre-fill surveys will include bathymetric data collected conventionally using a laser for stationing and differential leveling for elevations . Page 4 of 8 October 4, 2010 Indian River County Sector 3 Phase 2 - Construction Phase Services Scope of Work Part 3 — Monitoring During Construction & First Year Post- Construction In general , work described in Part 3 constitutes monitoring required by FDEP or the USACE permits consistent with the USF& WS Biological Opinion dated December 2 , 2009 . It is expected that the monitoring under this Scope of Work will be accepted by FDEP as the immediate post- construction monitoring of the Phase 2 fill area and the "year I " annual monitoring for the previously completed Phase 1 fill area . Post-Phase 2 Construction Annual Biological or Physical Monitoring (years 1 , 2 , 3 , 5 +) is not addressed in this Scope of Work. Task 3 — Phase 2 Permit Administration : During construction of Phase 2 , COASTAL TECH will confer with the COUNTY , the Contractor, USACE and FDEP staff to check and document that the Contractor and COUNTY have fulfilled reporting requirements as cited in the permits . COASTAL TECH will : (a ) Prepare a tabular summary of permit requirements, the responsible entity for each applicable permit condition, and the required date for compliance . (b) Assist the COUNTY with documentation of permit compliance . (c ) Maintain a written schedule and summary of permit compliance including dates that requirements are met and/or submitted to the agencies . Task 4 — During Phase 2 Construction - Sea Turtle, Lighting, and Shorebird Monitoring : On a daily basis during Phase 2 construction (starting March 1 or at least 65 days prior to commencement, whichever is later) , EAI shall monitor, relocate, and/or mark sea turtle nests along the entire project area shoreline (R-20 to R-55 ) including areas of beach access to fulfill requirements of FDEP Specific Conditions 19 and item 3 ( including 3a through 3c) of the "Terms and Conditions" for the "Protection of sea turtles" in the USF&WS Biological Opinion dated December 2 , 2009 — in accordance with Florida Fish & Wildlife Conservation Commission (FFWCC) guidelines . Nighttime monitoring will not be required due to use of upland sand sources . EAI will directly confer with existing Marine Turtle Permit Holders in collaboration with the COUNTY to appropriately coordinate the project monitoring by EAI with the existing yearly monitoring efforts . EAI will also conduct beachfront lighting surveys as required by FDEP Specific Condition 27 (May 15 ) along the entire project area and item I I (pre-construction survey) of the "Terms and Conditions" for the "Protection of sea turtles" by the USF&WS Biological Opinion dated December 2 , 2009 . In conjunction with the During Phase 2 Construction — Sea Turtle Monitoring, EAI shall also conduct early nesting season shorebird surveys along the entire project area as required by FDEP Specific Condition 35 (commencing April I through August) . Task 5 — Post-Phase 2 Construction Physical Monitoring : In general , COASTAL TECH will provide physical monitoring services for post-Phase 2 construction monitoring for the Sector 3 Project — required by the FDEP Permit No . 285993 -001 -JC and outlined in the Physical Monitoring Plan dated December 16, 2009 . Specifically , COASTAL TECH will : • via subcontract with M& E , perform topographic and bathymetric surveys of the beach and dune from R- 15 to R-60, • via subcontract with ACA, provide controlled aerial photography from R- 15 to R-60 , • perform beach sand sample collection (obtained via subcontract with M& E), and analysis (<20 samples) of sediment samples to evaluate the sediment characteristics of the restored beach (summer months, 12 month post-Phase 1 construction per Physical Monitoring Plan), and Page 5 of 8 October 4, 2010 Indian River County Sector 3 Phase 2 - Construction Phase Services Scope of Work • prepare and submit a post- Phase 2 engineering report and the associated monitoring data to FDEP and USACE (90 days post survey) . This report will also serve as the Phase 1 , year 1 annual physical monitoring report . Task 6 — Post-Phase 2 Construction Biological Monitoring - Escarpmentse EAI will conduct visual surveys for escarpments along the entire project area (R20 to R55 ) to fulfill post-Phase 2 construction monitoring requirements of FDEP Specific Condition 24 and item 5 ( including 5a through 5b) of the "Terms and Conditions" for the " Protection of sea turtles" in the USF& WS Biological Opinion dated December 2 , 2009 - in accordance with FFWCC protocol . Upon completion of construction and from May l to October 31 , both the treatments and controls will be monitored for the presence of escarpments (scarps) on a weekly basis . EAI will notify COASTAL TECH of any persistent scarps within the two treatments that may interfere with sea turtle nesting . COASTAL TECH will notify FDEP of the presence of those scarps and for coordinating any remediation measures , if required . The COUNTY will address leveling of escarpments as may be required . Escarpment data for the two controls will be included in the annual report as a basis for evaluating Project effects . Task 7 — Post-Phase 2 Construction Sea Turtle, Lighting , and Shorebird Monitoring and Reporting : EAI and IRG will perform post-Phase 2 construction sea turtle monitoring services EAT will directly confer with existing Marine Turtle Permit Holders in collaboration with the COUNTY to appropriately coordinate the project monitoring by EAI with the existing yearly monitoring efforts . Turtle monitoring services by EAI shall be in accordance with FFWCC guidelines . EAI will also conduct post-Phase 2 beachfront lighting surveys as required by FDEP Specific Condition 27 (May 15 , June 15 , July 15 , August 15 and September 15 ) along the entire project area and submit a summary report of the survey and documentation of property owner notification to FWC by the 0 of the following month with a final summary report provided by December 15 . Consistent with item 11 of the "Terms and Conditions" for the "Protection of sea turtles" by the USF& WS Biological Opinion dated December 2 , 2009, the June 15 lighting survey by EAI will serve as the USF& WS 30 day post construction lighting survey . In conjunction with the Post Construction Phase 2 — Sea Turtle Monitoring, EAI shall conduct shorebird surveys along the entire project area as required by FDEP Specific Condition 35 (May 1 through August) . Within 60 days post-construction, EAT will provide a report to the USF& WS describing the actions taken and the information required under item 13 of the USF&WS Biological Opinion dated December 2 , 2009 . IRG will perform the field work required under FDEP Special Condition 32 for assessing sea turtle population levels in the nearshore area within and adjacent to the project area . This assessment is to be conducted quarterly, post-construction with the first survey for the post-Phase 2 construction monitoring being conducted in the summer quarter (June-August) . Following the initial survey, surveys will then be conducted during the fall quarter 2010 ( September-November) , winter quarter 2010-2011 ( December-February) and spring quarter 2011 (March -May) . The surveys will be conducted in accordance with the requirements of Special Condition 32 of the issued permit, and will employ the same methodology and transect locations used in the 2007 baseline study of nearshore sea turtle abundance conducted by IRG for COASTAL TECH and Indian River County . The methodology will include concurrent sampling of the project area and an appropriate control area to allow potential project effects on nearshore sea turtle abundance to be separated from natural background variability . Page 6 of 8 October 4, 2010 Indian River County Sector 3 Phase 2 - Construction Phase Services Scope of Work Surveys will be conducted along a series of 3 - kilometer long transects previously established for the 2007 Sector 3 baseline survey. IRG will provide all equipment, personnel , and supplies needed to conduct the surveys . Ordinarily, four IRG personnel will be required for the project (two observers, a data recorder, and a boat operator) . IRG will only conduct surveys when weather conditions are acceptable for survey accuracy and safety . IRG will not bill for weather days, when equipment and personnel are mobilized , but surveys cannot be completed . Field effort for each quarterly census will include a complete survey of both the Treatment and the Control sites (three transects at each site) . To eliminate the effect of day-to-day variability in turtle sighting conditions on the data set, surveys of the Treatment and Control sites will be conducted in the same day . If deteriorating weather conditions do not allow for a complete survey of both sites to be conducted in the same day, the entire survey effort will be repeated on the next acceptable date Data will be tabulated and transmitted to COASTAL TECH at the conclusion of each survey effort . At the conclusion of each year ( four quarters) of surveying, data will be analyzed and marine turtle abundance will be compared between the preconstruction baseline and the current year ' s data for each individual transect and for the sites as a whole (all transects combined) for both the Treatment and Control sites . Data for green and loggerhead turtles will be analyzed and presented separately. At the conclusion of each annual survey effort (four quarterly surveys) IRG will prepare and deliver a summary report completely describing the methods , results and conclusions of the survey project, in a format acceptable to COASTAL TECH and Indian River County . IRG will also provide periodic progress reports as requested by COASTAL TECH . Up to ten ( 10) hard copies of the report, each including an electronic copy on CD , will be provided . Task 8 — Post-Phase 2 Construction Nearshore Hardbottom Monitoring : In general, COASTAL TECH and CSA will perform services to fulfill requirements for immediate post-Phase 2 construction "Nearshore Hardbottom Monitoring" as identified in the FDEP approved Biological Monitoring Plan (dated April 2009) and including FDEP Specific Conditions 48 through 54 . Monitoring events shall consist of an immediate post construction survey conducted during the summer after project completion (May 1 through September 30) . The report and all data deliverables shall be provided to COASTAL TECH within 90 days after completion of the survey . Using aerial images .obtained from ACA via COASTAL TECH (developed via Task 5 ) , the "aerial photographs will be digitized " by CSA to ( i ) produce GIS -based habitat map (ESRI shape files), and ( ii) facilitate further analysis . Based upon these maps COASTAL TECH will assess post-Phase 2 construction hardbottom impacts — due to physical burial - likely attributable to Phase l or 2 of the Project. CSA will (a) perform "ground -truth" verification of the aerial photography to include bounce dives and/or cross-shore video transects ( b) include the geo-referenced field position in copies of the "ground-truthing" photography and transect video record to be provided by CSA to the COUNTY, COASTAL TECH, and FDEP , and (c) use the "ground -truthing" (and transects as may be appropriate) to verify interpretation of the aerials to produce the GIS-based habitat map . Per the Biological Monitoring Plan , COASTAL TECH and CSA will : conduct transects, quadrat sampling and "Nearshore Hardbottom Edge Mapping" in the post- Phase 2 Project fill area, and analyze the transects and aerial photography and prepare a summary report including : Page 7 of 8 October 4, 2010 Indian River County Sector 3 Phase 2 - Construction Phase Services Scope of Work (a) a comparison with statistical analyses of the pre and post construction hardbottom exposure including net loss/gain of hardbottom, (b) sand volume and distribution changes, (c) an assessment of hardbottom impacts attributable to the Project, natural processes, and other effects including recent "treasure-salvage" operations, as observed on monitoring transects or along the landward edge of hardbottom . CSA and COASTAL TECH will meet with the COUNTY to review and identify any changes warranted in the summary report . After such changes are made by CSA and COASTAL TECH , COASTAL TECH will forward the summary report to FDEP in partial fulfillment of permit conditions . Task 9 — Post-Phase 2 Construction UMAM Analysis of Hardbottom Impacts : Based upon the assessment of hardbottom impacts and the monitoring report prepared under Task 8 , COASTAL TECH will conduct a Uniform Mitigation Assessment Methodology (UMAM) analysis, pursuant to Chapter 62-345 , F . A .C . The UMAM analysis will include qualitative descriptions of impacted communities and associated ecological functions, and quantitative estimates of the extent of impacts . COASTAL TECH will confer with FDEP staff during the undertaking and upon completion of the UMAM analysis in order to determine what mitigation , if any , the COUNTY may be required to perform . The UMAM spreadsheets, in addition to supporting documentation , will be provided in hard copy and digital format to the COUNTY for review prior to submittal to FDEP .
