Dear Mr. Henley : Please accept this request for modification number one for the above referenced Community Development Block Grant (CDBG) Agreement between Indian River County and the Florida Department of Community Affairs (DCA) . This request for modification is for a six month time extension, a revision to the CDBG Agreement Work Plan, a revision to the Program Budget and Scope of Work and a revision in the Number of Accomplishments and Beneficiaries . As of the beginning of March 2010 , construction activities were fifty percent complete , and the County had expended $ 67 , 867 . 50 and encumbered over $ 70, 000 . 00 on the project . This is slightly less progress than the County had previously anticipated for the project . The principal reason for the delay in the project ' s progress is that significantly more applicants are being assisted by funding from this project than had been anticipated . While the goal of the project was to assist 6 households , the actual number of households assisted will . be over 30 . A TRUE COPY E: R I , FICATION ON LAST PAGE J . K . BARTON , CLERK Although the County believes that the project will be completed by the June 26 , 2010 contract deadline, the County feels that it is responsible to ask for a six month extension in advance of the forty-five day notice requirement for time extensions . While the extension may not be needed, the County wants to avoid having to request a reinstatement of the grant should there be any additional unforeseen delays . BARTON , CLERK MODIFICATION NUMBER 1 TO GRANT AGREEMENT BETWEEN THE DEPARTMENT OF COMMUNITY AFFAIRS AND INDIAN RIVER COUNTY This Modification is made and entered into by and between the State of Florida , Department of Community Affairs , (" Department") , and Indian River County , ( Recipient") , to modify DCA Contract Number 08DB = D3 - 10 =40 =01 =Al2 , award dated June 27 , 2008 , ("the Agreement") . WHEREAS , the Department and the Recipient entered into the Agreement , pursuant to which the Department provided a grant of $ 176 , 869 . 25 to Recipient under the Small Cities Community Development Block Grant (" CDBG ") Program as set forth in the Agreement ; WHEREAS , the Department and the Recipient desire to modify the Agreement ; NOW, THEREFORE , in consideration of the mutual promises of the parties contained herein , the parties agree as follows : o Reinstate Agreement ( NO ) 1 . The Attachment B 'Activity Work Plan ' of the Agreement is hereby deleted and is replaced by the revised Attachment B 'Activity Work Plan , ' which is attached hereto and incorporated herein by reference . • Revise Program Budget and Scope of Work (YES ) 4 . The Attachment A , Program Budget and Scope of Work section of the Agreement is hereby deleted and is replaced by the revised Attachment A , the Program Budget and Scope of Work , which is attached hereto and incorporated herein by reference . 7 . The Attachment B , Activity Work Plan section of the Agreement is hereby deleted and is replaced by the revised Attachment B , Activity Work Plan section , which is attached hereto and incorporated herein by reference . • Change in Number of Accomplishments and/or Beneficiaries (YES ) 8 . Attachment A , the Program Budget and Scope of Work section of the Agreement , is hereby deleted and is replaced by the revised Attachment A , the Program Budget and Scope of Work , which is attached hereto and incorporated herein by reference . All provisions of the Agreement and any attachments thereto in conflict with this Modification shall be and are hereby changed to conform to this Modification , effective as of the date of the execution of this Modification by both parties .
