Mooney III and Stefanie M . a Mooney entered into a License Agreement with INDIAN RIVER COUNTY, a an 0 Cl a. &, c political subdivision of the State of Florida ( " County") , for permission to utilize ' r J:k certain riparian land of County ; said License Agreement is recorded in Book a 'o eq ,,� 1744 , Page 762 of the Public Records of Indian River County , Florida ; and 04 aGo U a a " A WHEREAS , Robert G . Mooney III and Stefanie M . Mooney have PC �° violated covenants 5 and 6 of said License Agreement by failure to pay the annual license fee , applicable sales tax and provide indemnification ; and WHEREAS , Robert G . Mooney III and Stefanie M . Mooney were given notice of such violations on February 21 , 2011 and May 26 , 2011 , and were given the opportunity to cure same ; and WHEREAS , Robert G . Mooney III and/or Stefanie M . Mooney have not cured the violations ; and WHEREAS , under the terms of the License Agreement violations of covenants 5 and 6 are terminable events , NOW , THEREFORE , BE IT RESOLVED THAT : 1 . The above recitals are true and correct . 2 . The License Agreement recorded in Book 1744 , Page 762 of the Public Records of Indian River County , Florida is hereby terminated and revoked . 3 . The dock and all improvements constructed on the riparian land of Cn the County as outlined in the License Agreement are the property of County . n 4 . This Termination /Revocation shall be recorded in the Public LU W U. o Records of Indian River County , Florida .
