HomeMy WebLinkAbout3/19/1969WEDNESDAY, MARCH 19, 1969 The Board of County Commissioners of Indian River County, Florida met in regular session on Wednesday, March 19, 1969 at the Courthouse, Vero Beach, Florida at 8:30 o'clock A. M. Present were Jack U. Dritenbas, Chairman; Richard P. Bogosian, Vice Chairman; D. B. McCullers, Jr.; Alma Lee Loy and Edward J. Massey. Also present were Jack G. Jennings, County Administrator; Sherman N. Smith, Jr., County Attorney; and Alfred H. Webber and Janet N. Burriss, Deputy Clerks. The Chairman called the meeting to order and asked if there were any corrections or additions to the minutes of March 5, 1969. There were none and upon a Motion made by Commissioner McCullers, seconded by Commissioner Massey, the minutes of March 5 were unanimously approved as written. Darrell Fennell, County Prosecuting Attorney, appeared before the Board in regard to violations to zoning regulations. Mr. Fennell stated that these violations were Miad.emeanors,andLtiat-•.informations would be filed against the parties who were involved. Mrs. Murray Michael of the Pelican Island Audubon Society appeared before the Board requesting some aid from the County in draining the parking area, removing some old cars and refrigerators which had been left in the Kiwanis-Hobart Park and a little aid with the natural trails. On a Motion made by Commissioner Bogosian, seconded by Commissioner Loy, it was unanimously carried that the Administrator assist the Pelican Island Audubon Society with the above listed problems at Kiwanis-Hobart Park. On a Motion made by Commissioner Bogosian, seconded by Commissioner Massey, the following Resolution was unanimously adopted: gtvava nog MAR 1 9 196 RESOLUTION NO. 69-13 The Board of County Commissioners of Indian River County, Florida, resolves: 1. That the easement now existing on both sides of the line dividing Lots 4 and 5 from Lots 6, 7 and 8, Block 5, Rosedale Gardens Subdivision, according to plat recorded in Plat Book 1, page 10, in the office of the Clerk of the Circuit Court of Indian River County, Florida, be and the same is here- with abandoned and this Board does herewith relinquish and disclaim the rights of the public acquired by the dedication in said plat insofar as it pertains to the above described easement. Box 518, Vero Beach, Florida 32960 Sam: Franks, electrician reported that the failure of power in the north end of the Courthouse was due to a panel being too small, he stated that to install a 16 circuit panel, which would. about double the present capacity, and to do the necessary lead-in wiring would be at a cost of approximately $475.00 to $480.00. After some discussion, the question arose as to whether it would not be better to provide for even more capacity, and the Administrator was requested to consult further with Mr. Frank and report his findings at the next meeting. Donald McCullers appeared on behalf of the grove owners on the Old Dock Road, requesting assistance from the County in opening the drainage along the road, as it was backing up and causing root -rot to the citrus trees. The Administrator was authorized to go in with a back -hoe and give relief to the situation on a temporary basis until a time when the Australian Pines could be removed from the ditches and surrounding areas. On a Motion made by Commissioner Bogosian, seconded by Commissioner McCullers, the request of Michael Wodtke, on behalf of the School Board, for four or five yards of fill to be furnished for the Little League Field at Rosewood School was unanimously granted. Marvin Carter and Edward Carr appeared before the Board in regard to the final approval of the Mobile Home Subdivision of Indian River Acres. The County Administrator presented a final plat of a Mobile Home Subdivision known as Indian River Acres and recommended its final approval with the expressed provision that all roads and drainage contained therein are private and not subject to any maintenance by the County at present or in the future. On a Motion made by Comm- issioner Massey, seconded by Commissioner McCullers, the recommended final approval of the Mobile Homes Subdivision of Indian River Acres was unanimously given with the provision that all work must be done in accordance to County Subdivision Regulations. Wilson Brown of Sebastian appeared before the Board regarding a law involving the sale of oysters. On a Motion made by Commissioner McCullers, seconded by Commissioner Massey, it was unanimously carried that the Clerk be authorized and directed to write a l� ert, $ir �3O A{ Legislative Delegation stating that the Board of County Commissioners MAR 191969 of Indian River County has no objection to an amendment of Chap. 57-1411, Laws of Florida,. regarding transportation of oysters from the County, provided any such amendment is applicable only to oysters raised on lands leased from the State of Florida and transported by fish dealers licensed in Indian River County. Irving Hodson, of the Vero Beach Press Journal, appeared in regard to the 50th anniversary of the City of Vero Beach, and suggested that the County might be interested in advertising at a cost of $235.00 per page. No action was taken by the Board. Merrill Barber of the Long Range Planning Authority reported and made the recommendations of the Planning Authority to the Board. Mr. Barber suggested that the Commissioners take up the problem of Interstate I 95 and the repercussions upon SR 60 and the City of Vero Beach with the State Road Department; and or, if necessary, bring the matter to the attention of the United States Senators and Representatives. Mr. Barber further discussed the problems immediately confronting the County and stressed the need of a City -County Planner. R. A. Bluem, Engineer for General Development Corporation, appeared before the Board in regard to Miami Type Gutters, stating that according to the price of the lots, the cost of this type gutter is too involved. He requested that asphalt gutters be considered and stated that he would like to get more information concerning other types of gutters and return this information to the Board. The Administrator reported that he had contacted the State Road Department regarding the traffic lights at Wabasso; and that a letter has been received from John Wilson stating that a study is being made and the findings of that study will be reported to the County Commissioners. The Administrator reported that there were continuing problems with the air -conditioner unit serving the north end of the Courthouse, that it would cost about $1,000.00 to replace the unit or about $400.00 ' for a new compressor. On a Motion made by Commissioner McCullers, seconded by Commissioner Massey and unanimously carried the Administrator was authorized to advertise for bids for a new airconditioner for Book 1.2 1111.415 the north end of the Courthouse. 1111nR 1 9 1969 The Board then adjourned at 11:45 o'clock A. M. and reconvened at 1:30 o'clock P. M. The Administrator was requested to contact the State Civil Defense Director and make inquiries as to the acting capacity of the Civil Defense Director. The appointment of Civil Defense Director was postponed until a later meeting. A letter regarding the opening of a bar in the Fellsmere Inn was to be referred to the City of Fellsmere. A Motion was made by Commissioner Loy, seconded by Commissioner Massey and unanimously carried that the Administrator is requested to check the list of performance bonds and report to the Board the status of the required improvements as required by said performance bond. On a Motion made by Commissioner Massey, seconded by Commissioner Bogosian,-,the following Resolution was unanimously adopted: 1100k 12 .4,(146 MAR 19 1969 RESOLUTION NO. 69-14 The Board of County Commissioners of Indian River County resolves: 1. Pursuant to Section 194.47, Florida Statutes, Ralph Harris, as Clerk of the Circuit Court in and for Indian River County, Florida, has prepared in triplicate and delivered this date to the Board of County Commis sioners of Indian River County, Florida, in duplicate a complete schedule or list, duly certified by him, of all lands in Indian River County, Florida, upon which tax certificates were issued at the County Tax Collector's sales of lands for unpaid delinquent taxes held on the first days of June in the years 1943, 1946, 1948, 1949, 1953, 1954 and 1966, as were bid off by said Tax Collector for said County and which taxes have not been redeemed or pur- chased. 2. One said schedule or list has been retained by the said Clerk of the Circuit Court and is on file in his said office, the second said schedule or list is attached as Exhibit A to this Resolution, and the third said schedule or list shall be delivered this date to Sherman N. Smith, Jr. , as County Attorney. 3. Within ninety (90) days after the date of this Resolution, Sherman N. Smith, Jr. , as County Attorney, shall cause a Complaint to be filed in the Circuit Court of said county in the name of said county and agains any and all of the lands described in the said schedule or list as defendant. 4. This Resolution, together with the attached Exhibit A, shall be set forth verbatim in the minutes of this Board of this date. On a Motion made by Commissioner Loy, seconded by Commissioner Massey and unanimously carried, Richard Bogosian and Ed Schlitt were appointed as Indian River Cdunty Representatives to the East Central Florida Regional Planning Council, and Donald Macdonald was appointed - as alternate. On a Motion made by Commissioner Loy, seconded by Commissioner Massey and unanimously carried, two'. members of the Indian River Long Range Planning Council will be appointed every year for a period of three years. The Administrator was requested to write a letter regarding Federal Funds for County Assistance. in connection with traffic problems. On a Motion made by Commissioner Massey, seconded by Commissioner Loy, the State Witness Payroll for the Circuit Court,Spring Term, in the amount of $449.10; the State Witness Payroll for the County Court, February Term 1969 in the amount of$319.72; and the State Witness Payroll for the County Court, February Term, 1969 in the amount of $46.92 were unanimously approved. On a Motion made by Commissioner Loy, seconded by Commissioner Massey, the application for admission to a State Tuberculosis Hospital by James Albert Delk was unanimously approved. On a Motion made by Commissioner Bogosian, seconded by Commissioner Loy and unanimously carried the Clerk is authorized to advertise for bids for microfilm equipment for the office of the Clerk of the Circuit Court not .to exceed an estimated cost of $15,000.00 The several bills and accounts against the County,having been audited, were examined and found to be correct were approved and warrants issued in settlement of same as follows: General Fund, Nos. 2297 to 2351 inclusive; Road and Bridge Fund, Nos. 1441 to 1486 inclusive; Fine and Forfeiture Fund Nos. 200 to 204 inclusive.
