HomeMy WebLinkAbout6/6/1969FRIDAY, JUNE 6, r969 The Board of County Commissioners of Indian River County, Florida met in special session on Friday,June 6, 1969 at the Courthouse, Vero Beach, Florida at 10:00 o'clock A.°M. Present were Jack U. Dritenbas, Chairman; Richard P. Bogosian, Vice Chair- man; D. B.'McCullers, Jr.; Alma Lee Loy and Edward J. Massey. Also present were Jack G. Jennings, County Administrator; Sherman N. Smith, Jr., County Attorney; and Alfred H. Webber and Janet N. Turpan, Deputy Clerks. Also present were Ney Landrum, Executive Director of the °Florida Outdoor Recreational Development Council; N. E. Miller, Executive Director of the Florida. Board of Parks; and Harry Goode, Chairman of the Board of Commissioners, and other members of the Sebastian Inlet District. The Chairman called the meeting to order and explained that the purpose of the meeting was to discuss State acquisition of the Sebastian Inlet Park. A tentative plan for the park was presented by the State. After considerable discussion a Motion was made by Commissioner Bogosian, seconded by Commissioner Loy and unanimously carried that ' as a result of the discussions had at this meeting between this Board,. representatives of the Sebastian Inlet District, the Florida Outdoor Recreational Council, and the State Park Board, it has been tentatively determined, subject to development of final plans and the adoption of a formal agreement, that this Board looks with favor on the over-all general tentative plan for development by the State of the Sebastian State Park. This Board makes the following suggestions with respect to the proposed plan of development, to -wit: 1. By reference to an agreement of July 10, 1964, later supplemented and recorded respectively in Official Record Book 219, page 769; and Official Record Book 219, page 781, in the office of the Clerk of the Circuit Court of Indian River County, Florida, it will be noted that there is a 145 foot•strip of land adjacent to Se -s an JUN 144 BOO 14 tvE l I Inlet and shown on a map of a survey prepared by B. H. Mashburn dated June 16, 1964. The agreement specifically details the uses and purposes to which this 145 -foot strip can be used, which is in general the right of the Inlet District to use the 75 -feet adjacent to the Inlet for Inlet purposes, and the remaining 70 feet for use by the County as a public road. These uses should be preserved for these purposes. 2. The westernmost part of the area shown on the.Mashburn survey which is commonly referred to as the sandspit area, is owhed by the County to be used by the public for park and recreational purposes and by \the Inlet District for Inlet purposes. This area should be held, retained and used for those purposes as a part of the over-all plan of the State Park,'but it should not be within a confined and restricted campground or other area, but rather, it and the 145 foot strip mentioned above should be primarily for public access to the Inlet, with boat launching sites on the south side of the area, picnic tables and general public°recreational purposes. Consideration should be given to establishing public camping grounds under controlled conditions in other areas. 3. In the event the State acquired the property commonly known as the Proux property located to the east of the 145 -foot strip mentioned above, then the State should dedicate an extension of the 145 -foot strip to the Atlantic Ocean to be used for the same purposes as the 145 -foot strip now existing. In the event this is done, then in exchange for that, the County would abandon its right to an 80 -foot right-of-way for public road access to the Inlet which was to be located within a 400 -foot strip shown on the. Mashburn survey, so that thereafter public access would be via A -1-A right-of-way to the 145 -foot strip... This would mean that the Inlet District and the State could negotiate the location of the easement to the Inlet District for location of a pipeline extending from the Inlet to the Atlantic Ocean to permit discharge of spoil through the pipeline to the Atlantic Ocean. 4. The County, the Inlet District and the State Park Board would enter into a management agreement placing general control and management t pm 12 WE 16,_'JUN � H" of the entire area under the supervision of the State Park Board, with the understanding that the 145 -foot strip and the sandspit area would be available to the general public continously without charge, and subject only to reasonable regulations relating to public health, welfare and police regulations. It is contemplated that all of this would be formalized in an agreement between all of the parties, and after completion of the contemplated facilities by the State, the County would discontinue its maintenance of the public park facilities and camping facilities, and agree to the maintenance and management of all of the area by the State.
