THIS ADDENDUM TO AGREEMENT, entered into this day of t' w
2012 , by and between the BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER
COUNTY, FLORIDA , a political subdivision of the State of Florida (the " County ") , and
JOSEPH M . WADDY d/b/a FREDDY ' S HOT DOG HOUSE ( "Concessionaire ") .
WITNESSETH :
WHEREAS , on June 7 , 2012 , the parties have entered into the Agreement for concession
services to be provided at the North County Aquatic Center (the "NCAC ") ; and
WHEREAS , section 12 of the Agreement provides for additional concession locations as
agreed upon by the parties ; and
WHEREAS , the parties agree to include two additional locations for concession services ;
and
WHEREAS , operation of said concession will mutually benefit the parties hereto and the
residents of Indian River County , Florida; and
NOW, THEREFORE , in consideration of the covenants herein contained , it is mutually
agreed between the parties as follows :
1 . The Concessionaire is hereby granted a license to operate a food concession pursuant to the
terms and conditions as stated in the Agreement dated June 7 , 2012 , at each of the following
two additional locations (the "Additional Locations ") :
a. Indian River County Public Shooting Range, 10455 102nd Terrace , Sebastian ,
Florida 32958 .
b . Golden Sands Park, 10350 Highway AIA, Vero Beach, Florida 32963 .
2 . The Term for the Additional Locations shall commence on the date of execution of this
Addendum to Agreement and expire on May 1 , 2013 (the "Addendum Term ") . Upon written
agreement, the County may in its sole discretion renew the Addendum Term for two (2 )
successive terms (the "Addendum Renewal Term ") . The Addendum Renewal Term shall be
pursuant to the terms and conditions provided in the Agreement and the Addendum to the
Agreement .
3 . All terms and conditions of the Agreement remain in effect for this Addendum to Agreement .
IN WITNESS WHEREOF , the parties hereto have hereunto set their hands and seals on
the day and year first above written .
