The Board of County Commissioners of 'Indian River County,
Florida met in regular session at the Courthouse, Vero Beach,
Florida on Wednesday, October 22, 1969 at 8:30 o'clock A. M.
Present were Jack U. Dritenbas, Chairman; Richard P. Bogosian,
Vice Chairman; D. B. McCullers, Jr.;: Alma Lee Loy and Edward J.
Massey. Also present were Jack'G. Jennings, County Administrator;
Paul D. Burch, Attorney to the Board of County Commissioners;
Alfred H. Webber and Janet N. Turpan, Deputy Clerks.
The Chairman called the meeting to order and asked if there
were any additions or corrections to the Minutes of October 6,
October 8 and October 13, 1969. Commissioner Bogosian stated that
in the Minutes of October 13, 1969, in the 3rd paragraph, the
words Attorney Bogosian should be changed to read Commissioner
Bogosian. This correction having been made a Motion was made by
Commissioner Loy, seconded by Commissioner Massey and unanimously
carried that the Minutes of October 6, 8, and 13 were unanimously
approved as corrected.
Dewey Walker, County Zoning Inspector, appeared before the
Board and presented a list of Legal Actions started, Violations,
and Variances granted by the Board of Adjustment.
On a Motion made by Commissioner Loy, seconded by Commissioner
Bogosian, it was unanimously carried that James S. Ayres be
appointed to fill the vacancy on the Zoning Board, which was made
by the resignation of Dewey Reams.
The hour of 8:30 o'clock having passed, the Clerk read the

Resolution was unanimously adopted:

RESOLUTION NO. 69-59
WHEREAS, the Board of County Commissioners did
receive and examine and tentatively adopt a proposed
budget of excess receipts and their expenditures for
the fiscal year ending September 30, 1970, and,
WHEREAS, this Board did cause a summary statement
thereof to be advertised one time in a newspaper of
general circulation published in Indian River County,
Florida, to -wit: In the issue of October 9, 1969 of
the Vero Beach Press Journal as will more fully appear
by proof of publication thereof filed in the minutes of
this Board and
WHEREAS, this Board did meet at the time and place
stated in said advertisement for the purpose of hearing
requests and complaints of the- public. regarding said
Supplemental Budget and for the purpose of holding a
public hearing and making whatever revisions in the
budget it may deem necessary, Now, therefore,
BE IT FURTHER RESOLVED that the Board of County
Commissioners of Indian River County, Florida does herewith
tentatively adopt said Supplemental Budget for the fiscal
year ending September 30, 1970 in the form heretofore
tentatively adopted and duly, advertised.
BE IT FURTHER RESOLVED that said Supplemental Budget
shall be filed in the office of the County Auditor as a
public record and the Clerk ,hereof shall transmit two copies
of the. Supplemental Budget as adopted to the Comptroller
of the State of Florida, and said Supplemental Budget shall
be considered as finally adopted and official upon approval
as to form by the Comptroller.

Richard Starr, Regional Sanitary Engineer, State Board of
Health appeared before the Board and reported that the discoloration
of the water as supplied by Urban Development Utilities was due to
the high content of iron; but that regardless of the color, the
water was potable. Mr. Starr stated that the best solution to this
problem would be to put in an aeration system, which,by the time
the system met Federal Housing approval, would take approximately
six months. Mr. Starr suggested that the Board and he should meet
with Urban Development Utilities. Curtis Hunter and Reverend James
Farr appeared regarding the condition of the Urban Development
Utilities sewerage plant; and Reverend Henson questioned if the
County had considered consolidation of these water systems and
the County furnishing the water. After some discussion, it was
decided that the Administrator, Mr. Starr and anyone else who is
interested would go on an inspection tour of the Urban Development
Utilities Sewerage Disposal Plant on Saturday morning at 9:00
o'clock A. M.
Miles B. Mank II, County Judge, appeared before the Board in
regard to needed additional space in the Courthouse or in the Annex.
The. Administrator was requested to bring some previouslydrawn plans
of the top floor of the Courthouse Annextothe next regular
Commissioner's Meeting; as well as a statement from the Building
Department in regard to the temporary plans presented by Homer C.
Fletcher, County Tax Assessor for a mapping room.
Bud Dalrymple appeared before the Board in regard to the
Dalrymple Subdivision. The County Administrator presented a
tentative plat of a Subdivision: known as Dalrymple Subdivision and
recommended its tentative approval as meeting County Subdivision
Requirements. Upon a Motion made by Commissioner Massey, seconded by
Commissioner McCullers and unanimously carried the recommended
tentative approval was given for the. Dalrymple. Subdivision with the
provision that all building be done to comply with County Subdivision

State Representative, Charles. Davis, appeared before the
Board in regard to the transportation of oysters as requested in
the Minutes of October 8. Recommendations by the Board were that:
1. An individual should be permitted to remove oysters from the County.
2. A licensed dealer should be permitted to remove as many oysters
as he desires from his leased beds.
3. A licensed dealer should not be permitted to remove oysters from
public waters.
4. A licensed dealer should be requested to return a portion of his
shells to public waters.
5. That some regulatory action should also be taken on the removal
of Clams from the Indian River.
It was decided that Representative Davis and Paul D. Burch, Attorney
to the Board would meet and present their recommendations for a
bill at the next meeting of the Board.

On a Motion made by Commissioner Massey, seconded by
Commissioner McCullers, it was unanimously carried that the bid
received in the Minutes of October 8, from Bowen Roofing Company
for reroofing the Courthouse be rejected; and that the Administrator
be authorized to readvertize for bids for reroofing the Courthouse,
completion date of which to be set at December 31, 1969.
Attorney Thomas Thatcher appeared and presented a Resolution.
On a Motion made by Commissioner Bogosian, seconded by Commissioner
McCullers, the following Resolution was unanimously adopted:
RESOLUTION NO. 69- 60
The Board of County Commissioners of Indian River County,
Florida, resolves:
1. That each of the parcels of property hereinafter described has
been acquired by Indian River County, a political subdivision of the State of
Florida, on the respective dates hereinafter stated, for the purpose of con-
structing a public road on said property as hereinafter identified, and that all
of the taxes levied upon said parcels for the year 1969 upon the tax rolls of
Indian River County, Florida, shall be only that portion of the taxes levied
which the part of such year that had expired at the date of such acquisition
bears to the entire year, and that the remainder of such taxes for such year
shall stand cancelled.
2. The public roads for which said parcels were acquired, the
dates of acquisition and descriptions of the parcels so acquired is as follows:

On a Motion made by Commissioner Bogosian, seconded by
Commissioner McCullers, it was unanimously carried that the
Administrator be directed to inform the Board of Public Instruction,
in answer to their letter of October 2Q, 1969 requesting the use
of County trucks and other equipment on a hourly basis to aid
in drain and fill operations for a sewerage disposal plant at the
Middle School, that due to the present overload of work that is
being placed on the Road and Bridge Department, the Board regrettably
denies the request..
Homer C. Fletcher, County Tax Assessor, and Mr. Davis, Financial
Director of the School Board appeared before the Board in regard
to the method of payment of the School Board's Tax Commissions.
A Motion was made by Commissioner Loy, seconded by Commissioner
Massey and unanimously carried that the Attorney to the Board of
County Commissioners, the Attorney to the School Board, the Tax
Assessor and the Tax Collector meet and research the legal aspects
and submit their findings to the Board.
A letter was received from Leslie J. Crain, Hydrologist, of
the United States Geological Department requesting permission
for boring in different localities on County Property. A Motion
was made by Commissioner Massey, seconded by Commissioner Bogosian
and unanimously carried that the request be approved.
A Motion was made by Commissioner Loy, seconded by Commissioner
Massey and unanimously carried that the request of the Town of
Indian River Shores that a sign be placed at the intersection of
Beachland Boulevard and S. R. A -1-A designating the mileage to
the Town of Indian River Shores and John's Island, be referred to
the State Department of Transportation.

The Administrator reported that he has received information
from the Department of Transportation that the speed limit on the:
North Gifford Road has been reduced to 45 and 55 miles per hour,
and that the State Department of Transportation are affixing the
appropriate signs; that he has also received information that
the flashing signals will be set up at all of the County Schools.
The Administrator reported that he has received a letter from
R. W. Froemke, Chief of Concurrent Programs, Outdoor Recreational
Development Council, that the County has been granted an extension
of time in the procurement of additional; land for the Kiwanis-
Hobart Park.
On a Motion made by Commissioner McCullers seconded by
Commissioner Massey, it was unanimously carried that the Administrator
be instructed to advise the Corp of Engineers, Department of the
Army that the Board has no objection to the permit of January 10,
1961 being revised to permit dredging in the west side of the
Channel at the Sebastian Inlet and depositing the spoil in the
designated spoil area.
A Motion was made by Commissioner. McCullers, seconded by
Commissioner Massey and unanimously carried that the request
by General Development Corporation fortentative approval of Vero
Beach Highlands Subdivision, Unit 44 bedenied until they submit
a typical section of the type of pavement to be used in the
Subdivision.
The Administrator submittedthe sketch of 32nd Avenue as
mentioned in the Minutes of October 8; and /stated that the County
could only maintain the part of the Street located in the County.
Commissioner McCullers then left the meeting.
Paul D. Burch, Attorney to the Board, reported to the Board
that an Act of Legislature having been passed revoking governamental
immunity in tort liability, he had received a letter from the
Insurance Carrier stating that the carrier could not insure the
County en masse; and that a detailed list for liability coverage
should be made. It was suggested that he might contact the State
Association of County Commissio regard to the

The Attorney to the Board reported that three or four
condemnation suits were now in process and that since these suits
were started by the former Attorney to the Board, if desired by
the Board, they would be handled by the firm of the former Attorney
to the Board, at a cost to the County Commissioners, of $35.00 per

On a Motion made by Commissioner Bogosian, seconded by
Commissioner Massey, Paul D. Burch, present Attorney to the Board
of County Commissioners is to receive,a salary of $15,000.00 per year,.
all inclusive.
On a Motion made by Commissioner Loy, seconded by Commissioner
Massey, the State Witness Payroll for the Fall Term of the Circuit
Court; and the State Witness Payroll for the August Term of the
County Court in the amounts of $21.96 and $155.00 respectively
were unanimously approved.
On a Motion made by Commissioner Loy, seconded by Commissioner
Bogosian, the out of County travel of Forrest N. McCullars, County
Agricultural Agent to the University of Florida to attend the
Florida DARE Meetings on October 29 through October 31, and to
Miami to attend the State Horticultural Society Annual Convention
on November 5 through November 7; and the out of County travel of
Fred Prestin, Civil Defense Director to Starke Surplus Sale, and
permission to conduct Radiological Training Course at the Civil
Defense Office; and the out of County travel of Gladys Vigliano,
County Welfare Caseworker, to a Welfare Conference at Winter Park
on October 24; were unanimously approved.

The Chairman appointed Commissioners Massey and Bogosian to
meet with the County Tax Assessor and Collector, and representatives
of the various municipalities in the County to negotiate terms for
the assessing and collecting of municipal taxes by the County
Assessor and Collector.

Mr. Billy Roberson of the Florida Forestry Service
has requested information.as.to whether or not the Board
of County Commissioners want to name the Park in the Rose-
land area that is under lease to the Florida Forestry Ser-
vice. The State needs this information in order to have
signs made.
The subject area is abutting and lying immediately
north of the Dale Wimbrow Park.

unanimously voted to request the Administrator to notify.Mr.
Roberson that the choice of the Commissioners for a name of the
Park in question is " The Donald Macdonald Park".
On a Motion made by Commissioner Bogosian, seconded by
Commissioner Loy the following Resolution was unanimously adopted:
RESOLUTION NO. 69-63
The Board of County Commissioners of Indian River County, Florida,
resolves:
1. Sherman N. Smith, Jr. has served Indian River County, Florida
as County Attorney from January 3, 1950 to August 1, 1961 and again from
January 4, 1967 to October 15, 1969 and has abley counseled and advised the
Board of County Commissioners on all legal matters effecting this County and
has given the Board the further benefit of his legislative and judicial exper-
ience together with his personal knowledge of the history of the County and
its citizens.
2. He has served Indian River County with expert legal ability. He
has faithfully attended and served at all meetings of the Board of County
Commissioners and other County Boards and consulted unsparingly with those
requesting his advice and assistance and he is now retiring from those great
duties and responsibilities as County Attorney.
3. This Board and its members individually and upon behalf of the
citizens of this County do hereby publicly recognize and express its sincere
thanks and appreciation to Sherman N. Smith, Jr. for his many years of
devoted and distinguished service to Indian River County, Florida.
4. A certified copy of this Resolution shall be furnished to the news
media and Mr. Smith.

inclusive. Such bills and accounts being on file in the office
of the Clerk of the Circuit Court, the warrants so issued from
the respective funds being listed in the Supplemental Minute Book
as provided by the rules of the Legislative Auditor, reference
to such record and list so recorded being made a part of these
minutes.
