HomeMy WebLinkAbout2010-061 AMENDMENT NUMBER 4 TO WORK ORDER NUMBER 4 �a © e � This Amendment Number 4 to Work Order Number 4 is entered into as of this 2nd day of March 2010 , pursuant to that certain Continuing Contract Agreement for Professional Services entered into as of April 6 , 2004 and amended effective April 7 , 2007 (as so amended , the "Agreement") , by and between Indian River County, a political subdivision of the State of Florida ("County") and MASTELLER & MOLER , INC . ( " CONSULTANT") , 1 . The County has selected the Consultant to perform the professional services set forth in existing Work Order Number 4 , Effective Date July 11 , 2006 . 2 . The County and the Consultant desire to amend this Work Order as set forth on Exhibit 1 attached to this Amendment and made a part hereof by this reference . The professional services will be performed by the Consultant for the fee schedule set forth in Exhibit 2 and within the timeframe more particularly set forth in Exhibit 3 , all in accordance with the terms and provisions set forth in the Agreement . 3 . From and after the Effective Date of this Amendment , the above-referenced Work Order is amended as set forth in this Amendment. Pursuant to paragraph 1A of the Agreement , nothing contained in any Work Order shall conflict with the terms of the Agreement and the terms of the Agreement shall be deemed to be incorporated in each individual Work Order as if fully set forth herein . Collins , If County Attorney b w Our File #0627 February 18 , 2010 NON -EXCLUSIVE PROFESSIONAL ENGINEERING AGREEMENT CONTINUING CONSULTING SERVICES AMENDMENT #4 TO " EXHIBIT 1 " Work Authorization #4 , which was approved by the Board of County Commissioners on July 11 , 2006 , included Engineering Services in connection with conversion of an existing 8" force main to an 8" reuse pipeline . Amendment # 1 was approved to authorize Engineering Services for the removal of the existing 8" force main and its replacement with a 16" reuse main in accordance with the Reuse Master Plan . Amendment #2 was approved to authorize modifications to the proposed route of the 16" reuse main to satisfy Indian River Farms Water Control District . Amendment #3 was approved to include tasks for additional professional services necessary to survey endangered species and obtain related permits , and additional design and inspection services related to additional utilities work. Construction has commenced on the proposed 16° reuse water main along Lateral G Canal . However, in the course of construction the presence of listed wildlife species were discovered , specifically the gopher tortoise and Florida Scrub Jay. A " Notice to Suspend Work" was issued by the Utilities Department on or about September 17 , 2009 . Since then Scrub Jay and Gopher Tortoise relocation permits have been obtained . The project is ready to re-commence upon completion of the temporary relocation of gopher tortoises . This Amendment #4 is presented to include tasks for additional professional services necessary to temporarily relocate gopher tortoises . A brief description of the scope of services and deliverables for Work Authorization #4 is provided below: Scope of Services Task E — Gopher Tortoise Relocation Using an FWCC Authorized Agent experienced in tortoise removal and relocation , we will provide the on-site relocation of the Florida gopher tortoises anticipated to inhabit the construction area based on the tortoise survey completed under Addendum #3 . The Agent will supervise the excavation of the burrows and the relocation of gopher tortoises and commensal species . Upon completion of the relocation the Agent will prepare and submit to FFWCC all required data . It is understood that the Utilities Department will provide for the installation of silt fence to prevent relocated tortoises from re-entering the construction area , and will provide a backhoe and operator to perform the excavation . These items are therefore not included in this task .
