M. Present were Jack U. Dritenbas, Chairman; Richard P. Bogosian, Vice Chairman; D. B. McCullers, Jr.; Alma Lee Loy and Edward J. Massey. Also present were Jack G. Jennings, County Administrator; Paul D. Burch, Attorney to the Board of County Commissioners; Alfred H. Webber and Janet N. Turpan, Deputy Clerks. The Chairman called`the meeting to order and asked if there were any additions or corrections to the minutes of March 4. There were none and upon a Motion made by Commissioner McCullers, seconded by Commissioner Massey, the minutes of March 4 were unanimously approved as written. Dewey'Walker,County Zoning Inspector, appeared before the Board and reported on the progress in removing zoning violations. On a Motion made by Commissioner Bogosian, seconded by Commissioner Massey, the request of Chester Clem, Attorney, for advertisement for public hearing for a Zoning Change before the Zoning Commission for a trailer park from R1 -A to C-1, was unanimously approved. On a Motion made by Commissioner Massey, seconded by Commissioner McCullers, the request of Gene Roddenberry to operate a junk yard, to be known as North Gifford Auto Salvage, was unanimously approved. Commissioner Loy reported that arrangements have been made to close the draw in the Merrill Barber Bridge over the Indian River for the passage of emergency vehicles, particularly ambulances; and her Motion that this Board officially approve an emergency signal system now in operation and that the Administrator affirm by letter to the State Department of Transportation, was seconded by Commissioner McCullers and unanimously carried. D. Moody & Sons, InMAR fF tft purchase of a carrier by the County at a cost of $21.628.00 was unanimously accepted, subject to reviewing the specifications. A Motion was made by Commissioner Bogosian, seconded by - Commissioner Loy and the Right -of -Way Agreement between the County and Gearl V. and Ellen Rivenbark for Right -of -Way on Citrus Road was unanimously approved and accepted„ at a cost of $500.00. The County Administrator presented a tentative plat of a Subdivision known as Hickory Hill Estates Subdivision and recommended its tentative approval as meeting County Subdivision Requirements. Upon a Motion made by Commissioner *asset', seconded by Commissioner McCullers and unanimously carried the recommended tentative approval was given for Hickory Hill Estates Subdivision with the provision that all building be done in accordance to County Subdivision Regulations. Rudy Hercun appearing on a Veteran matter and on a Judicial matter was referred to the proper authorities. A letter was received from A. R. Jones requesting that -he be permitted to post warning signs on two County roads to warn of water from his new irrigation system hitting the road. A Motion was made by Commissioner Massey, seconded by Commissioner McCullers and unanimously carried that the request be denied and that the Range Lines Groves, Inc. cease and desist from spraying water on County roads. The Attorney to the Board was requested to write a letter to the State Department of Parks and Recreation requesting that all building to be done at Sebastian Inlet Park comply with the Southern Standard Building Code. Jerry Cummings and other members of the Wabasso Neighborhood Planning Council appeared before the Board in regard to the condition of Broxton Road. A Motion was made by Commissioner boy, seconded by Commissioner Massey and unanimously carried that the Administrator is authorized to open the swale ditch on 14th Avenue between 4th Court and 4th Avenue. There was no objection by the Board to a submarine cable to be placed across the Indian River in the vicinity of U. S. #1 and the Sebastian Bridge by Southern Bell Telephone Company. It was moved by Commissioner Massey, seconded by Commissioner Loy and unanimously voted to authorize the County Administrator to purchase not more than 65 pieces of steel sheet piling, this being the approximate amount of piling necessary in connection with the repairing or rebuilding of a County Bridge over the South Relief Canal at Twentieth Avenue; and to further authorize the purchase of this piling without advertising for bids, it being considered of vital importance in the public interest and as an immediate safety precaution that the provisions of Section 125.08 (2) be waived in this specific instance in order to prevent undue delay resulting from the time elapsed in advertising for bids; and to instruct the Administrator to purchase the piling from L. B. Foster of Orlando, Florida, in a effort to obtain it at the least possible cost to Indian River County, in as much as the said L. B. Foster is apparent low bidder in contracting to sell steel sheet piling to the State Board of Transportation for Florida State purposes. Reference was made to Florida Attorney General's Opinion No. 329 of 1947 wherein the Board of County Commissioners of Volusia County were authorized to repair a bridge at New Smyrna Beach, Florida, under similar circumstances, without advertising for bids. Ar :&S MAR 18 1970 I , r � rim y .; i On a Motion made by Commissioner McCullers, seconded by Commissioner Massey, the Administrator was unanimously authorized to travel to Sarasota to an asphalt conference on April 10. Commissioner Dritenbas returned to the meeting and again took the Chair. A Motion was made by Commissioner McCullers, seconded by Commissioner Massey and unanimously carried, that no bids having been received upon advertising for bids to be opened January 7, 1970, the Administrator was authorized to notify A. and T. Roof and Sheet Metal Company that their proposal to repair the Courthouse roof at a cost of $1,263.00 is accepted. A Motion was made by Commissioner Massey, seconded by Commissioner McCullers and unanimously carried that the Board be authorized to travel to Tallahassee to the State Department of Transportation on March 25. On a Motion made by Commissioner Massey, seconded by Commissioner McCullers, it was unanimously carried that this Board approves the Contracts signed by the City of Fellsmere, the City of Sebastian, the City of Indian River Shores and the City of Vero Beach for tax assessing and tax collection by Indian River County. WHEREAS, the Board of County Commissioners of Indian River County, Florida, is vitally interested in the improvement of the primary road system in Indian River County, Florida; now, therefore, BE IT RESOLVED by the Board of County Commissioners of Indian.River County, Flor*da, that this Board does herewith respect fully request the Florida Department of Transportation to include in its budget of primary roads for the fiscal year 1970-1971 the following projects in Indian River County: 1. Complete feasibility study for location and construction of second bridge across the Indian River in or south of the City of Vero Beach. 2. Construct a second bridge across the Indian River in or south of the City of Vero Beach. 1. 3. Complete right of way acquisition maps and folders - Indian River Boulevard (Section 88501-2601) from SR 606 (Oslo Road) to Hobart Road, Section 340 Township 31 South, Range 39 East. 4. On a Motion made by Commissioner Massey seconded by Commissioner ` McCullers,°the following agreement was approved and the following °Resolution was unanimoutly,adopted: PROJECT AGREFU:NT SECONDARY ROAD SYSTLN MORA�'�'DUM OF AGREBlEw ; THIS AGREB,1ENT, made and entered into this 18th day of March , 19 70 , by and between the STATE OF FLORIDA DEPARD EINT OF TRANSPORTATION, a component agency of thA State of Florida, hereinafter called the Department, and the COUNTY OF INDIAN RIVER , hereinafter called the County': ' WITNESSETH: WHEREAS, by Florida Statutes, 1965, 335.041, the'expenditure of secondary road funds for the construction and reconstniction of roads, highways, and municipal connecting links thereof and city streets was authorized: and Wmkm, the County has, designated the roads as listed on Exhibit "A", attached hereto and make a part hereof, for construction (or reconstruction) from gasoline tax funds accruing to the Department for expenditure in the County under the provisions of Florida Statutes, Section 208.44, and Article IX, Section 16, of the Constitution of the State of Florida: and WHEREAS, said work has been requested by the County to be completed by the Department under the Department's supervision in accordance with specifications of the Department. NOW, THEREFORE, THIS INDENTURE WITNESSETH: That in consideration of the premises•and the covenants hereinafter set forth to be kept and performed by each of the parties hereto, it is hereby mutually covenanted and agreed as follows: . 1. The Department will add said roads as listed on said ' Exhibit "A" attached hereto, as'necessarv,_ to the state secondary road system and construct or. MAR 18 19T reconstruct said project charging all costs of the project to gasoline tax funds accruing -to the Department for use in Indian River County under the provisions of Florida Statutes, Section 208.44, and Article IX of the Constitution of the State of Florida and the construction or reconstruction of said project will be in compliance with requirements of the Florida Statutes and Department Regulations relating to expenditure of secondary gasoline tax funds and construction of roads on the State secondary road system. 2. The County does hereby authorize the Department to pursue said project through the planning, preliminary engineering, right of way acquisition and construction phases in an orderly, uninterrupted sequence, according to the usual practices, standards and specifications of the Department. The time schedule for project completion is to be established by the Department of Transportation after due consideration for the availability of money, manpower and time. All work will be performed under the Department's supervision and in accordance with the specifications of the Department. 3. The County agrees to furnish to the Department free, clear and unencumbered title to all land required for rights of way, borrow pits and easements in connection with said project. Acquisition of said rights of way, borrow pits and easements shall be done under the supervision of the Department and in accordance with the Department's project scheduie. • 4. The Board of County Commissioners may exempt County buildings or other County structures from the requirements of this resolution where it finds that the addition of fallout pro- tection will create, in the County building or other County structure, an additional net cost in excess of three per cent ( 3% ) in the construction of such building, or that other factors make it unnecessary or impracticable to incorporate fallout protection in the design or construction of such building structure. 3. It shall be the policy of the Board of County Commissioners of Indian River County, Florida that fallout shelter protection shall be incorporated into all County buildings or County structures to the fullest extent practicable in order to provide protection against the effects of radioactive fallout for the greatest possible number of people in the event of nuclear attack upon the United States, or an accidental nuclear explosion: and Be it further resolved that this Resolution shall take effect March 18, 1970: and Be it further resolved that a certified copy of this Resolution be filed with the Indian River County, Florida, Director of Civil Defense. Commissioner McCullers left the meeting. A letter was received from the Tax Payers Association requesting the Board to defer action on the Food Programs until after the 1970 Federal Census. On a Motion made by Commissioner Loy, seconded by Commissioner Massey, Fred Prestin, Civil Defense Director was unanimously authorized to travel to Starke on April 16,-1970.-,-.- A Motion was made by Commissioner Loy, seconded by Commissioner Massey and it was unanimously carried that George E. Stokes, County Service Officer be authorised to travel to Daytona Beach, to attend the 19th Annual Statewide Service Officers School and Conference from May 2 through 9, 1970. A Motion was made by Commissioner Massey, seconded by Commissioner Bogosian and the State Witness Payroll for the County Court, February Term in the amount of $190.60 was unanimously approved. A Motion was made by Commissioner Massey, seconded by Commissioner Bogosian and the application of Jimmy B. Walker for a permit to carry a firearm was unanimously approved. The several bills and accounts against the County, having been audited, were examined and found to be correct were approved and warrants issued in settlement of same as follows: General Fund, Nos. 723 to 780 inclusive; Road and Bridge Fund, Nos. 372 to 405 inclusive; Fine and Forfeiture Fund, Nos. 177 to 179 inclusive. Such bills and accounts being on file in the office of the Clerk of the Circuit Court, the warrants so issued from the respective funds being listed in the Supplemental Minute Book as provided by the rules of the Legislative Auditor, reference to such rr''''''record and list so recorded being made a part of these minutes.
