M. Present were Jack U. Dritenbas, Chairman; Richard P. Bogosian, Vice Chairman; D. B. McCullers, Jr.; Alma Lee Loy and Edward J. Massey. Also present were Jack G. Jennings, County Administrator; Paul D. Burch, Attorney to the Board of County Commissioners; Alfred H. Webber, and Janet N. Turpan, Deputy Clerks. The Chairman called the meeting to order and asked if there. were any additions or corrections to the Minutes of April 22. there were none and upon a Motion made by Commissioner McCullers, seconded by Commissioner Loy, the Minutes of April 22 were unanimously approved as written. Dewey Walker, County Zoning Inspector, appeared before the Board and reported on the removal of zoning violations. Ross H. Long of Tropicolony Subdivision appeared in regard to swimming in the Tropicolony Park pond. He requested that the sign reading "Swim at Your Own Risk" be removed and not replaced at all or replaced with one reading "Positively No Swimming". A Motion was made by Commissioner Bogosian, seconded by Commissioner Loy and unanimously carried that the existing sign at the Tropicolony Park pond be removed and replaced with one prohibiting swimming. Hugh W. Penuel, Juvenile Counselor, appeared in regard to the hiring ofaFlorida State University Student for three of the summer months. A Motion was made by Commissioner Massey, seconded by Commissioner McCullers and unanimously.carried that the request of Hugh W. Penuel to hire a Florida State University Student for three of the summer months on internship, compensation to be arranged at a later date, be approved. Letters were received from Fred Prestin, Civil Defense Director, and from the Florida State University Extension Program commending the Indian River County Board of County Commissioners o, MAY the. -� LCIS ' success of the Emergency Operation Simulation. The Chairman read the following Proclamations Proclamation for Mental Health Month Whereas ...mental illness is no longer hopeless as evidenced by the increased rates of improvement and recovery in the mental hospitals, and Whereas ...recovery from mental illness is dependent on early and proper treatment, and Whereas ...many mental hospital patients are being denied the chance for recovery because mental hospitals lack adequate staff, equipment and medical supplies to provide all their patients with proper treatment, and Whereas ...mental disorders can be checked in their early stages, and Whereas ...thefailure to provide early care through Community Mental Health Centers, Mental Health Clinics,,Guidance Services and Mental Health Programs in schools and industry results in severe illness and hospitalization for many, and Whereas ...these conditions can be remedied by concerted action of the citizens of Indian River County, Therefore..I, Jack Dritenbas, Chairman of Board of County Commissioners do hereby proclaim the Month of May as Mental Health Month, and furthermore call upon the citizens of Indian River County to help the mentally ill by working together with the Indian River County Mental Health Association for improved care and treatment of mental hospital patients and for the creation of community mental health centers and services for the prevention and early treatment of mental disorders and to support the Indian River County Mental Health Association. Done under my hand and seal MAY 61970 3 Mr. Clark of General Development Corporation appeared before the Board in regard to Vero Beach Highlands Subdivisions ##3 and WRF00 and WRF01 of Unit #4. The County Administrator presented the tentative plats of the subdivisions known as Vero Beach Highlands Subdivision Unit #3 and Vero Beach Highlands Unit #4, W.RF00 and WRF01, and recommended their tentative approval as meeting County Subdivision Requirements. Upon a Motion made by Commissioner Massey, seconded by Commissioner McCullers and unanimously carried tentative approval was given for Vero Beach Highlands Subdivision WRF00 and WRF01 in Unit #4 and Vero Beach Highlands Subdivision Unit #3 with the provision that the developer obtain State Board of Health approval of utility services; and post performance assurance satisfactory to the Board of County Commissioners with the Clerk of the Circuit Court prior to recording the final plat. John Cann, Mayor of the City of Fellsmere appeared before the Board in regard to 1969 taxes on property held for sale by the City of Fellsmere. The Attorney to the Board was requested to research the matter and report to the Board at its next regular meeting. On a Motion made by Commissioner Bogosian, seconded by Commissioner Loy, it was unanimously carried that the Administrator be authorized to take the necessary steps to acquire by prescription the first road to the east of Broxton Road, which has been maintained through the years by the County, which leads to the 10 acre park near Wabasso; and to have title search and deeds made from the property owners by dedication of ten additional feet which would be necessary for proper road and drainage purposes. r'he Administrator reported trash being spilled on Citrus Road in the area of 43rd Avenue and Range Road and the Sheriff was requested to arrest violaters.for the purpose of imposing -fina:s;. !Jk a >'V MAY 6 1970 0 A Motion was made by Commissioner Loy, seconded by Commissioner McCullers and unanimously carried that the Attorney be authorized to write to the delegation to go on record as being in favor of Senate Bill 800, relating to county home rule by use of ordinance. A proposed bill that the State assume the financial responsibility of health employees was received from the Pinellas County Board of County Commissioners. On a Motion made by Commissioner Loy, seconded by Commissioner McCullers, the following Resolution was unanimously adopted: RESOLUTION NO. -70-19 WHEIZZ, AS, May 4 1070 masked the fourth anniversary of the Indian River County Volunteer Ambulance Squad, and WHEREAS, this group of volunteers organized in a time of need when Didian, River County was without €tn ambulance service, and WHEREAS, more than 175, 000 volunteer man hours have been contributed and more than 5, 000 calls have been axe ,icred since the date of organization, and W= EAS, countless tax dollars have been saved by the citizens of Indian River County, and WTHERF.AS, the appreciation for the service rendered by this group is count3nvide, NOVI, TIMEFORE, BE IT RESOLVED by the Board of County Commissioners of IndiaJn. Arnold Ford Sales 2,496.00 3. Kenn Terry, Inc. 4,669.38 4. Motorola (Only bid) 11050.00 John L. Murman, Southgate Village appeared before the Board protesting the use of 12th Street between U. S. 1 and 6th Avenue by speeding trucks. No action was taken by the Board. On a Motion made by Commissioner McCullers, seconded by Commissioner Loy, the request of Paul D. Burch, Attorney to the Board of County Commissioners, to travel to Tallahassee on May 13, 1970 to attend a meeting of the Legislature to present material compiled on the Charlene Williams case, was unanimously approved. A Motion was made by Commissioner McCullers, seconded by Commissioner Bogosian, it was unanimously carried that the Clerk be authorized to pay the bills of the appraiser, and the title search and abstracts necessary in the acquisition of Lots 8 and 9, Block 30, Original Town for the purpose of a parking lot. It was reported that Luster Merriman has two lots 100 feet by 125 feet that he would be willing to sell to the County for a parking lot at a price of $18,000.00. No action was taken by the Board. The following Agreement was received, signed and ordered to be made a part of these minutes: 6 J l I t STATE OF FLORIDA COUNTY OF INDIAN RIVER THIS AGREEMENT, made and entered into this �dday of 1970,,• by and between the Board of County Commissioners of Indian River County, Florida, and the City bf Orchid, a municipal corporation of the State of Florida; WITNESSETH: Y t WHEREAS, the Legislature of the State of Florida did at its 1969 Session, enact what is now Chapter 69-54 of the Laws of Florida, requiring that the several county tax assessors shall assess and the several county tax collectors shall collect all property taxes for all municipalities located within their respective counties, mandatorily beginning with the year 1971, or at the election of the municipality, beginning with the yeax 1970, and WHEREAS, the City of Orchid has elected to come within the provisions of said Act beginning with the year 1970 which election has been by resolution duly made and adopted by the City Council of the City of Orchid and transmitted to the Board of County Commissioners of Indian River County, and WHEREAS, it, is provided in said Chapter 69-54 that a contract shall be negotiated between the governing bodies of the county and :the municipalities regarding the compensation to be paid to the officials of the county tax assessors and tax collectors for the value of the service to be performed by them, and WHEREAS, the Board of County Commissioners of Indian River County does not desire to obtain any profit to itself or to the tax assessor and tax collector of said county for such services, but desires that said officials shall merely be reimbursed for the actual cost pertaining to such service, and MAY 6 1970 9 WHEREAS, it is difficult, if not impossible, prior to the actual rendering of such service, to determine what the actual cost thereof 4 will be, but in. order to comply with the provisions of said Chapter 69-54, it is necessary that an amount be,fixed, subject to further negotiation, and WHEREAS, the Board of County Commissioners of Indian River County has indicated that the initial charge should be fixed on the basis of $125.00 for each operation, that is to say, $125.00 to the tax assessor for assessing, and $125.00 'to the tax collector for collecting such taxes, subject to further negotiation; NOW, THEREFORE, in consideration of the premises, the parties hereto do agree as follows: 1. That the tax assessor of Indian River County will proceed 'to assess the property within the City of Orchid for city tax purposes for the year 1970 and the tax colledtor of Indian River County will proceed to collect such taxes, in accordance with the law in such cases made and provided. 2. That the City of Orchid will pay for such services $125.00 to such tax assessor and $125.00 to the tax collector respectively. 3. At the end of the 1970 tax collection year, an d. not later than May 1, 19710 a survey will be made subject to inspection of the City'of Orchid to determine the exact cost of such service to the city by the tax assessor and tax collector and if the same shall be determined to be less than the amount herein contracted to be paid, the difference shall be returned to the City by the Board of County Commissioners out of the excess fees of the respective offices of tax assessor and tax collector. 4. BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLOR (SEAL) B Chairman FLOR CITY OF ORCHID., FLORIDA (SEAL) B (jAayor -3- MAY 6 1970 A letter was received from State Representative Charles Davis that the Delegation wishes to repeal the bill disallowing surfing and swimming in the Sebastian Inlet, stating that it is a County function. The Board then adjourned at 12:15 o'clock P. M. and reconvened at 1:35 o'clock P. M. Homer Simpson, President of the City Council of Fellsmere, and other residents appeared requesting the assistance of the County to acquire suitable property to be used as a joint City -County sanitary dump in the Fellsmere area. The Chairman to the Board appointed Commissioner Massey to work with these residents to find a suitable solution to this problem. On a Motion made by Commissioner Loy, seconded by Commissioner Bogosian, the State Witness Payroll for the County Court, February Term, in the amount of $179.08 and the State Witness Payroll for the County Court, February Term, in the amount of $145.00 were unanimously approved. On a Motion made by Commissioner Bogosian, seconded by Commissioner Loy, the application of Margaret M. Madsen for renewal for a license to carry firearms was unanimously approved. On a Motion made by Commissioner Loy, seconded by Commissioner Bogosian, the Civil Defense Director was unanimously authorized to purchase short wave radio equipment to tie in with the Courthouse, installation not to exceed $150.00. The Report of the County Welfare Caseworker and the Financial Report of the Operation'of the Sebastian Inlet Park for the past six months were received and placed on file in the office of the Clerk. Acknowledgement of Resolution 70-16 relative to porpoises and other Cetaceans was received from Randolph Hodges of the Department of Natural Resources. Forrest N. McCullars, County Agricultural Extension Agent, appeared before the Board requesting more compensation for himself and his secretary. On a Motion made by Commissioner McCullers, seconded by Commissioner Massey, the following Resolution was unanimously adopted: RESOLUT ION 70- 20 WHEREAS, Homer Fletcher, Indian River County Tax Assessor, has made a request to this.Board for the right to restrict public inspection of public records held in his office"to the hours of 8:00 A. M. - 1:00 P. M., June 1, 1970 -t.61 the date the Board of Equalization meets in July, 1970, and WHEREAS, Homer Fletcher has stated that this request is made to insure completion of the 1970 tax roll and WHEREAS, the Tax Assessor's chief function and greatest responsibility is to prepare the tax roll. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Indian River County that the public's right to inspect public records in the Indian River County Tax Assessor's Office is restricted to the hours of 8:00 A. M. to 1:00 P. M. June 1, 1970 to the date the Board of Equalization meets in July, 1970. MAY 6 14,70 11 1. The Board then adjourned at 3:20 o'clock P. M. and immediately, at the call of the Chairman convened as the Indian River County Agricultural zoning Board as provided for in Section 193.201, Florida Statutes. Present were Jack U. Dritenbas, Chairman; Richard P. Bogosian, vice Chairman; D. B. McCullers, Jr.; Alma Lee Loy and Edward J. Massey, the voting members; and Homer C. Fletcher, County Tax Assessor and Forrest N. McCullars, County Agricultural Agent as ex -officio members. The Tax Assessor presented to the Board returns and applications for certain lands described in each return to be zoned as agricultural land. The Bca rd examined the returns, No. 1 to No. 2005 inclusive and found"that with the exception of Nos. 167, 179, 189, 228, 630, 680, 714, 842, 843, 929, 1166, 1213, 1226, 1232, 1244, 1329, 1400, 1456, 1462, 1476, 1504, 1542, 1544, 1896,2002, 2003, 2004, and 2005; all of the land described in those returns were used primarily for agricultural purposes. On a Motion made by Commissioner Massey, seconded by Commissioner McCullers and unanimously carried all the lands in said returns were zoned as gricultural lands under the provisions of Section ' 193.201, Florida Statutes. After due consideration, a Motion was made by Commissioner Massey, seconded by Commissioner McCullers and unanimously carried that returns No. 167, 179, 228, 630, 714, 842, 843, 929, 11.66, 1213, 1226, 1232, 1244, 1329, 1400, 1456, 1462, 1476, 1504, 1542, 1544 and 1896 were used primarily for agricultural purposes and are zoned as agricultural lands under the provisions of Section 193.201, Florida Statutes. Upon a Motion made by Commissioner Massey, seconded by Commissioner McCullers, Agricultural Assessment Return , No. 2002 was unanimously denied. Upon a Motion made by Commissioner Massey, seconded by Commissioner McCullers Agricultural Return, No. 2003 was unanimously denied. Upon a Motion made by Commissioner Bogosian, seconded by Commissioner Massey, Agricultural Assessment Returns, Nos. 2004 N11V L MAY 6 1970 I and 2005 were unanimously denied. Upon a Motion made by Commissioner McCullers, seconded by Commissioner Massey Agricultural Assessment Return, No. 189 was unanimously denied. The remaining return No. 680, making application for the lands therein described to be zoned as agricultural land, the Clerk of the Board is requested to advise the person making the return that the Board has insufficient information required to establish that said land is actually used for bona fide agricultural purposes, and to provide further information,the person filing this return is requested to file with the.Board a further detailed return for their further consideration. On a Motion made by Commissioner Bogosian, seconded by Commissioner McCullers and unanimously carried, the Indian River County Agricultural Zoning Board then adjourned to meet again at the call of the Chairman. The Board then reconvened as Board of County Commissioners. Richard Martin appeared on behalf of his father, Bert Martin who is in violation of the zoning regulations by hauling dirt from a R-1 zone. It was decided that Mr. Martin should appear before the Zoning Board at the earliest possible time and that no action would be taken by this Board until that time. The several bills and accounts against the County having been audited, were examined and found to be correct were approved and warrants issued in settlement of same as follows: General Fund, Nos. 907 to 964 inclusive; Road and Bridge Fund, Nos. 469 to 510 inclusive; Fine and Forfeiture Fund, Nos. 196 to 202 inclusive. Such bills and accounts being on file in the office of the Clerk of the Circuit Court, the warrants so issued from the respective funds being listed in the Supplemental Minute Book as provided by the rules of the Legislative Auditor, reference to such record and list o ecorded 111 being made a part of these minutes. \ MAY 9 1970 There being no further business, on Motion made, seconded and carried, the Baard then adjourned at 4:50 o'clock P.
