WORK ORDER NUMBER 3
MONITORING AND REPORTING SERVICES FOR 319(h) GRANT FOR
EGRET MARSH STORMWATER PARK
This Work Order Number 3 is entered into as of this 6th day of
July , 2010, pursuant to that certain Continuing Contract Agreement for
Professional Services entered into as of March 15, 2005 ("Agreement"), by and between
Indian River County, a political subdivision of the State of Florida ("COUNTY") and
Hydromentia, Inc. ("CONSULTANT").
The COUNTY has selected the CONSULTANT to perform the professional
services set forth on Attachment 1, attached to this Work Order and made part hereof
by this reference. The professional services will be performed by the CONSULTANT for
the fee schedule set forth in Attachment 2, attached to this Work Order and made a part
hereof by this reference. The CONSULTANT will perform the professional services
within the timeframe more particularly set forth in Attachment 3, attached to this Work
Order and made a part hereof by this reference, all in accordance with the terms and
provisions set forth in the Agreement. Pursuant to paragraph 1.4 of the Agreement,
nothing contained in any Work Order shall conflict with the terms of the Agreement and
the terms of the Agreement shall be deemed to be incorporated in each individual Work
Order as if fully set forth herein.
IN WITNESS WHEREOF, the parties hereto have executed this Work Order as

MONITORING AND REPORTING SERVICES FOR 319(h) GRANT FOR
EGRET MARSH STORMWATER PARK
INTRODUCTION
In an effort to establish an effective program that facilitates removal and recovery of
nutrient pollutants associated with stormwater runoff attendant with the network of
canals managed and operated by Indian River Farms Water Control District (IRFWCD),
the COUNTY has actively pursued implementation of innovative mechanical and
biological approaches. One such innovative facility, Egret Marsh Stormwater Park
(Egret Marsh), has been constructed in the southwestern part of IRFWCD's watershed,
at the southeast corner of 4th Street and 74th Avenue.
The central nutrient control unit associated with Egret Marsh is a 4.54 acre Algal Turf
Scrubber@ (ATSTM). To assist in the funding of this project, the COUNTY pursued and
secured a grant from EPA's 319(h) program, per the Clean Water Act, as administered
by the Florida Department of Environmental Protection (FDEP). The terms of this grant
are delineated within an agreement between the COUNTY and FDEP - DEP Agreement
G0143. Included in the agreement's terms are requirements to monitor and analyze
performance data, submit quarterly progress reports; and prepare a draft and final
report. The CONSULTANT has completed and submitted to FDEP for review, a Quality
Assurance Project Plan that includes a Monitoring Plan for the grant that includes
protocols for sampling and handling samples, analytical work, and data documentation.
Any such work proposed herein to be completed by the CONSULTANT shall be in
conformance with applicable sections of the Monitoring Plan,
SCOPE OF WORK
The CONSULTANT shall assist the COUNTY in the completion of certain tasks
associated with this grant as set forth below.
Task 1: Contract for 12 continuous months of operation with a NELAP certified
laboratory, which has been accepted in writing by the COUNTY, to provide analysis for
composite and grab water samples as follows:
Influent to ATSTM: 17 composite samples (4 to be replicate samples) to be analyzed for
TKN-N, Nitrate/Nitrite-N, and Total Phosphorus
Influent to ATSTM : 17 grab samples (4 to be replicate samples) to be analyzed for field
filtered Ortho -Phosphorus, Ammonia -Nitrogen, Total Suspended Solids, Alkalinity, Total
Organic Carbon, Color, Biochemical Oxygen Demand, Cadmium, Chromium, Copper,
and Zinc.
Influent to ATSTM : 6 grab samples (Equipment Blanks every four months, Field

Cleaned Equipment Blanks every four months) to be analyzed for TKN-N, Nitrate/Nitrite-

samples) to be analyzed for field filtered Ortho -Phosphorus and Total Dissolved
Phosphorus, Ammonia -Nitrogen, Total Suspended Solids, Alkalinity, Total Organic
Carbon, Color, Biochemical Oxygen Demand, Cadmium, Chromium, Copper, and Zinc.
Effluent from Woodstork Habitat Wetland: 6 grab samples (Equipment Blanks every
four months, Field Cleaned Equipment Blanks every four months) to be analyzed for
TKN-N, Nitrate/Nitrite-N, Total Phosphorus, field filtered Ortho -Phosphorus and Total
Dissolved Phosphorus, Ammonia -Nitrogen, Total Suspended Solids, Alkalinity, Total
Organic Carbon, Color, Biochemical Oxygen Demand, Cadmium, Chromium, Copper,
and Zinc.
Post -Rake Harvest Diversion Flows: 26 composite samples to be analyzed for TSS.
Post -Rake Harvest Diversion Flows: 12 composite samples to be analyzed for TKN-
N, Nitrate/Nitrite-N, and Total Phosphorus
Over one year's operation, 69 analyses will be required for the parameter list noted in
Table 1 for the listed sites; except for total suspended solids of which there will be 95
samples; and TKN-N, Nitrate/Nitrite, and Total Phosphorus, of which there will be 81
samples. The CONSULTANT will not be responsible for sample collection or shipping,
which will be done by COUNTY personnel. The CONSULTANT, through its contract
with the laboratory will provide sampling bottles, preserved and labeled appropriately,
and shipping containers.

Task 2: The CONSULTANT will receive data from the Water Quality Laboratory Contractor
per Task 1, and shall ensure the appropriate COUNTY and State personnel are provided
this data as it becomes available. The data presentation shall be such that laboratory
results are accurately linked to a specific sampling location and time, and that proper
laboratory quality assurance and quality control has been conducted. The contracted
laboratory will provide all data in a format that is compatible with the most updated version
of the DEP's Automated Data Processing Tool (ADaPT) software as developed by
Laboratory Data Consultants (Royal Palm Beach, FL).
The CONSULTANT shall transfer results to a performance spreadsheet that facilitates
time -active tracking of system performance in terms of mass removals of nutrients and
nutrient areal removal rates, as well as harvest and tissue data. The CONSULTANT shall
be responsible for reviewing all Quality Assurance data related to results for Blank
samples, and for noting any outlier or aberrant data, and shall take appropriate steps to
ensure data collected is reliable. Management of suspect data shall be in accordance with
the approved Quality Assurance Program Plan.
Task 3: The CONSULTANT shall contract with a certified laboratory capable of analysis of
dried algal tissue. The CONSULTANT shall collect composite dried samples on a monthly
basis from the COUNTY, and shall be responsible for preparing and shipping these
samples to the selected laboratory, and distributing results as they become available.
Analysis shall include parameters shown in Table 2.

Task 4: The CONSULTANT shall provide the County data spreadsheets, and any relevant
operational data maintained by the CONSULTANT as required for the County's
preparation and submittal of Quarterly Progress Reports required per Contract G0143.
Task 5: The CONSULTANT shall prepare and submit to the County a Draft Final Project
Report in which one year's continuous operation is reviewed in terms of system
performance, to include refinement of parameters to be applied to the ATSDEM model,
and comparative performance of model projections to actual field conditions. To be
included within the Draft Final Project Report shall be a summary of collected data; QA
summaries; operational field notes; a discussion regarding assessment of the system's
effectiveness and applicability for future stormwater management projects, and a review of
product development associated with the algal turf harvest. The CONSULTANT shall
assist Indian River County staff who shall be responsible for preparing responses to FDEP
comments pertaining to the submitted Final Report.

ATTACHMENT 2 to WORK ORDER n
1.
COMPENSATION
The COUNTY agrees to pay and the CONSULTANT agrees to accept, a lump sum fee of
$59,900.00 for services rendered according to Attachment 1 of this WORK ORDER. A
breakdown of the fees is set forth below.
2. PARTIAL PAYMENTS
The COUNTY shall make monthly partial payments to the CONSULTANT for all
authorized work pertaining directly to this project performed during the previous calendar
month. The CONSULTANT shall submit invoices monthly for services performed and
expenses incurred pursuant to this Agreement during the prior month.
The CONSULTANT shall submit duly certified invoices in duplicate to the Indian
River County Stormwater Division, attention Keith McCully, P.E. For lump sum line items,
the amount submitted shall be the prorated amount due for all work performed to date
under this phase, determined by applying the percentage of the work completed as
certified by the CONSULTANT, to the total due for this phase of the work.
The amount of the partial payment due the CONSULTANT for the work performed
to date under these phases shall be an amount calculated in accordance with the previous
paragraph, less five percent (5%) of the invoice amount thus determined, which shall be
withheld by the COUNTY as retainage, and less previous payments. Per F.S. 218.74(2),

the COUNTY will pay approved invoices on or before the forty-fifth day after the COUNTY
receives the CONSULTANT's invoice.
Per F.S. 218.74(2), the five percent (5%) retainage withheld shall be paid in full to
the CONSULTANT by the COUNTY, on or before the forty-fifth day after the date of final
acceptance of the Work by the Stormwater Division and the Public Works Director.

The CONSULTANT will perform all services in a timely manner, allowing the
COUNTY to prepare and submit its Quarterly Reports to FDEP on schedule. The Draft
Final Project Report shall be completed and submitted to the COUNTY and FDEP within
thirty days of the CONSULTANT receiving the results of the last sample set from the
testing laboratory.
