At a regular meeting of the Board of County Commissioners of Indian River County, Florida, held in the office of the Clerk of the Circuit Court, at Vero Beach, on Tuesday, the 6th day of August 19292 there were present the following County Com- missioners, to-wit:.Albert 0. Helseth, Chairman; J.D.Yongue; J.J.P.Hamilton; Bruce and John H. ,Atkin. .Also present were Uiles Warren, Clerk and Clark S. Rice, Sheriff. The Minutes of the previous meetings were read and approved as read. James F. Morrison appeared before the Board and presented the following petition: PETITION. We, the undersigned citizens and tax payers of Indian River County, Florida, hereby petition the Board of County Commissioners of said Indian River County, Florida, that 3 VMREAS, it is generally reported and common talk among the citizens and tax pay - ere of said County that the finances of the County now and heretofore have not properly been secured as they might or should have been according to law, and, V11MREAS, on account of failure of banks in this County it appears that said County hast so far lost considerable money and that there have been no steps taken for coll- ection or reimbursement to the County by reason of any security or bonds that the said banks had or should have had to guarantee the repayment of all funds deposited with them, and, BEREA:31 it is also reported that certain County Officials have been negligent and possibly responsible to the said County for certain funds that they have failed to account for or collect and turn over to the proper authorities, and, `TEA,, it appears that James T. Vocelle, the present attorney for the Board of County Commissioners, or the firm of Vocelle and Mitchell of which he is a member represents as .Attorneys both banks, being the Farmers Bank of Vero Beach and the Indian River County Bank, Sebastian, now termed County Depositories, and has and did heretofore represent the Vero Beach Bank and Trust Company, and now represents the Receiver for said Vero Beach Bank and Trust Compare, and other interests to _the extent that it mould be at least embarrassing on him if not disqualifying him from investigating, advising and prosecuting, if necessary, certain suits against said defunct bank or its Receiver, and any and all offices of said .County together with their bondsmen that it may be found are liable for any money or moneys due or may become due said County by reason of any collateral or security of any nature that said County may have, or otherwise in the interest of said County. That this action is not being taken, and is not intended to reflect in any way upon the character, ability, or integrity of the said James T. Vocelle but in good faith for the interest and protection of both the Board and Tax Payers of said County. And, we hereby recommend and request your honorable Board to employ an attorney or attorneys, ' to represent your Board in the matters heretofore referred to and such other natters as the Board may from time to time designate, instead of your now attorney, and we suggest that you employ S.N.Sm.ith and. Upon motion of 'Commissioner J.D.Yongue, it was moved that the Board employe ,/ F'226-- S.N.Snith and C.P.Diamond, as attorneys for the Board to investigate the matters stated in the attached petition and for any other purpose the Board may deem necessary, and that -we pay them a reasonable fee to be agreed on between the Board and the attorneys f or their services. The same being seconded by Commissioner Hamilton, and it being suggested that the vote be taken by yeas and.nays, end Commissioners voting for the motion being Commissioners Yongue; Hamilton; LaBruce; Atkin and Helseth. Commissioners jvoting against the motion being Commissioners --none. Nenator A. W- Young, appeared before the Board requesting rental of the .Speeder Ma, chine to State Road Department for use on State Road No. 30. The DeputyvSheriff bond of James W. Tfood, in the sum of 419000.00 with S.B.Monroe and Eli C. Ualke r, as sureties was approved. The Notary Public bond of Hugh D. Keffer in the sun of $500.00 with the American Surety Company, a corporations as surety was approved. V. E. Frans, County Agent filed his monthly report of activities. A letter from the County .=gineer relative to Bridge Tender on quay Bridge was read by the Clerk. ,applications were received and read from several citizens* it was moved, seconded and carried that applications and endorsements of applicants be turned over to Commissioner Hamilton and the County Engines for disposition. Mr. Loudermilk appeared before the Boa d and requested bridge or culvert to be put in at lateral �W' and Road 0-7 to drain water out. Commissioner LaBruce and County Engineer agreed to meet Thursday the 8th day of itugust and investigate, the Board giving them power to act in the matter. Jas. J. Rick appeared before the Board regarding rent on Simonson Building for Lawrence Construction Co., equipment. it was moved, seconded and carried that County pay no rent on this building. Donald Forbes representing the Indian River Faaams Drainage District presented bill for $525.00 for spreading marl and spoil for road right-of-way on west side of Range line canal from Osceola Boulevard South to head of Main Canal and from. the mouth of Lateral. il "C" to the mouth of Lateral "D°t along gest side of lateral OC". The bill being approved by the County Engineer was ordered approved and paid by the Board. a .T.Runi Ston made application to place a four inch culvert pipe under roadway on Osceola Boulevard which was approved. T.A.-Stewart, Receiver of Vero Beach Bank & Trust Company appeared before the Board i regarding Lawrence ConstructioavCo., mortgage. It was moved, seconded and carried that T.A.Stewart, Receiver of Vero Beach Bank & Trust Co., be given full authority to proceed to collect an any and all security held by the County for deposits, and all securities so held are transferred to such Receiver for the purpose of collection. Further the County,Wnngineer is instructed to assist such Receiver in any and all matters pertaining thereto$ that the Receiver may call on him for and such Receiver is to account for all collections and the Board take receipt for all securities. This action may be rescinded at any future meeting of the Board. The. Chairman announce4 that this meeting was held for the purpose of considering and acting upon and adopting the estimates of the expenses for the fiscal year commencing 'October let 1929 and ending September 30th 1930,which were prepared and entered upon the minutes of the meeting of the Board of County Commissioners, held on the 9th day of July, 19299 and to fix the rate of taxation for the year 1929. The foregoing estimates as made by the Board: 'and published in the Vero Beach Press- nal, a newspaper published in the County in the issue of said newspaper of the 12th of July 1929, was' then taken up, considered, and finally adopted. The Board then roceeded with the matter. of fixing the rate of. talion for the County and Special strict purposes for the year 19299 and after a careful consideration of the estimates receipts and the estimates of expenditures it was the determination of the Board t the rate of taxation necessary to*meet such expenses wou14, be for each of the 7 ,1, y r I Iv 9 I following mentioned purposes and amounts estimated, declared and levied ,.vfzs i In order to meet the estimated current expenses•of the County of Indian River, $21,814.501 it is deteim.ined and hereby, declared that a tax rate of Dive (5) mills upon the dollar be levied and is hereby imposed upon all of the property lying and being in the County of Indian River, on the first day of January 1929, for the GFMRA:L FM to meet the current expenses of the County and to provide for the expenditure as es- timated in the budget hereinbefore set forth. To meet the expenses estimated to be necessary to be paid out of the FINEand FORFEITURE FUND, the sum of §15,580.00, it is determined and hereby declared that a tax of Two (2) mills upon the dollar be levied, assessed, and is hereby imposed upon all the property lying and being in the County of Indian River on the first day of January 1929, for the. Fine & Forfeiture Fund, to meet the current expenses as estimated in the budget. To cover the amount of the estimated expenses for keeping the County Roads in good shape and for the construction and repairing of bridges and other necessary expenses to keep the roads of the County in good condition and provide other roads when necessary, of $429630.009 it is detemined and hereby declared that a tax rate of Five (5) mills upon the dollar be levied, assessed, and is hereby imposed upon all of the property lying and being in the County of Indian River on the first day of January 1929, to meet the current expenses of the County as estimated in the budget. To meet the interest payments and provide a sinking fund for the ultimate redemp- tion of County Bonds, Time warrants, and the pro Irata debt due St. Lucie County,Florida; in pursuance of the requirements of the law the sum of §649977.78, it is determined and hereby declared that a tax rete of Sixteen and one-half (16*) mills upon the dollar be levied# assessed, and is hereby imposed upon all the property lying and being in the County of Indian River on the first day of January 19299 6, mills of which amount shall be deposited in the regular County depository of the County to meet general bonds and time warrants and 10 mills of which shall be forwarded to the State Treasurer, ex-offic County Treasurer for the purpose of retiring and paying interest on bonds and time war- rants outstanding, issued for Road construction. ;i To meet the current expenses incidental and necessary to the operation of the Public Schools of the County, and to pay the salaries of teachers and repair school houses as estimated by the County Board of Public Instruction, the sum of $138,252.009 it is detem.ined and hereby declared that a tax rate of Ten (10) mills upon the dollar be levied, assessed, and is hereby imposed upon all the property in the County of Indian River on the first day of January 1929. To meet the outstanding indebtedness and interest thereon, if any., according to the estimates or budget the sum of $109915.00 it is dete=ined and hereby declared that a tax rate of Three (3) mills upon the dollar be levied, assessed, and is hereby imposed upon all the property in the County of Indian River on the first day of January 1929, to meet the current expenses as estimated in the budget. For the encouragement and protection of Agriculture as authorized under Chapter 73020 Acts of 1917, the sum of $2,700.00, it is determined and hereby declared that a tax rate of One-half (j) mill upon the dollar be levied, assessed, and is hereby imposed upon all the property in the County of Indian River, on the first day of Janu 1929, to meet the current expenses as estimated in the budget. To provide a fund for the payment to worthy mothers in order that their children l may attend the Public Free Schools of the County, the sum of $3,800.009 it is determine and hereby declared that a tax rate of one (1) mill upon the dollar be levied, assessed I. 1 1 j i 1 It 01 and is hereby imposed upon all of the property in the County of Indian River on the first day of January 1929, for the MOTHERS MSION Fi1N'D. To meet current expenses, and for the General advertising of the County, the sum of $1,900.00, it' is determined and hereby declared that a tax rate of One half ( ) mill upon the dollar be levied, assessed and is hereby imposed upon all of the pro- perty in the County of Indian River on the first day of January 1929, for the PUBLICITY F=. According to the millage so deteanined, fixed and assessed, the total millage to be entered in� the column provided for County taxes in the assessment roll for the Year 1929, is 43. mills upon the dollar, to cover a total estimated expenditure of $3029569.28. The toard then proceeded to fix the millage for Special Road and Bridge Dis- tricts under Section 1656 of Chapter 129 Revised General Statutes, laws of Florida, and it was detemnined that a tax rate of Stix (6) mills on the dollar be levied and is hereby fixed and assessed for the year 1929 on all of the property in the County of Indian River lying and -being within the boundaries of Special Road and Bridge District No. 1 for the purpose of paying interest and creating a sinking fund for the retire - (to raise the sum of 040630.00) ment, of the bonded debts which boundaries are as follows, to -wits Beginning at the No rth-westbco rner of Indian River County, run thence East on County line to Range line between Ranges 37 and 38, thence South on'Range line' between Ranges 37 and 38 to the North-west corner of Sec. 19 Tp. 31 S.R.38 E., thence South on section line between Range line dividing Ranges 38 and 39 to the South-east corner of Tp 32 S.R.38 East, thence west on Township line to west boundary of Indian River County, thence North on Fest boundary of Indian River County, to the point of beginning. The warrants so' dram from the respective funds being listed in the County Finance Record, as provided by law, and reference to said County Finance Record is made a part of these minutes as fully and ccm.pletely as if tihe said warrants were set out herein in detail. The County Depositories of the County filed their monthly statemento, showing receipts and disbursements, which having been checked were found to be correct.
