HomeMy WebLinkAbout7/22/1970F a4 I WEDNESDAY, JULY 22, 1970 The Board of County -Commissioners of Indian River County, Florida met in regular session at the.Courthouse, Vero Beach, I , Florida on Wednesday, July 22 at 8:iO o'clock A. M. Present were Jack U. Dritenbas, Chairman, Richard P. Bogosian, Vice ° Chairman, D. B. McCullers, Jr., Alma Lee Loy and Edward J. Massey. Also present were Jack G. Jennings, County Administrator, Paul D. Burch, Attorney to the Board of County Commissioners, and Alfred H. Webber and Janet N. Turpan, Deputy Clerks,. The Chairman called the meeting to order and asked if there were any additions or corrections to the minutes of the special meeting of July 16. There were none and upon a Motion made by Commissioner Loy, seconded by Commissioner McCullers, the minutes of the special meeting of July 16 were unanimously approved as written. The Chairman then asked if there were any additions or corrections to the minutes of the regular meeting of July 8; he further stated that Paragraph 4,.Page 1 should be changed from "from the City of Vero Beach to a site" to read "to,a site", also that Paragraph 5, Page 1 should be changed,from"requesting a franchise0' to read" requesting an easement". These corrections having been made, a Motion was made by Commissioner Loy, seconded by Commissioner Massey and the minutes of the regular meeting of July 8 were unanimously approved as corrected. On a Motion made by Commissioner McCullers, seconded by Commissioner Massey, the request of Rosemary Richey to advertise for bids for the purchase of a new graphotype machine was unanimously approved. f`J11k rage I i Dewey Walker', County Zoning Tnspector appeared and reported on zoning violations. Daniel Stormont appeared before the Board reporting'on the progress being made in conforming with•County Regulations at his junk yard, which was satisfactory to'the Board. Harry L..Carpenter, Robert Grice and Kenneth Pangburn appeared before the Board in regard to the'moratorium-to restrict the placement of mobile homes throughout -the County., Valentyne , • ; Brennan, County.Planning Director spoke in favor of the moratorium . Mrs. Carrie McKinney appeared.in opposition to the moratorium. A Motion was made by Commissioner Bogosian, seconded by Commissioner ;r Massey and unanimously carried that the Attorney be requested to prepare a Resolution restricting'the placement of.mobile homes in residential areas thrQught the County to be effective September 1. When used in this ordinance, the following words shall mean: (a) . Board shall mean the Board of County Commissioners of Indian River County, Florida. (b) Musical or entertainment festival or festival shall mean any gathering of groups or individuals for the purpose of listening to or participation in entertainment which consists primarily of musical renditions conducted in open spaces not within an enclosed structure. Section 3. No person, firm, corporation or partnership. shall stage, promote, or conduct any musical or entertainment festival • in the unincorporated area of Indian River County ural ss he shall first secure from the Board a special entertainment perM' it for said festival. Section 4. Said permit shall not be: issued unless the following conditions are met and the following plans submitted to the. Board. (a) A plan for adequate sanitation facilities and sewage disposal, approved by the county health officer;, (b) A :plan for parking facilities, which are not within the area of the festival and a plan for the transportation of the patrons from said parking facilities to the festival area, .approved by the county administrator. (c) A plan for adequate medical facilities, approved by the county health officer; (d) A plan for the provision of adequate security and traffic control in and around the festival area, approved by the Sheriff of 52 Indian River County; 53 (e) Full disclosure must be made by, the promoters to the'Board of 54 the financial backing of the festival and the names of all persons or groups 55 who will perform at said festival; JUL 2 2, 19YU i Ai9r .p x,r'rfe`11 dsa i �3 y xr tia �y - (a MIR 56 (f) Any other reasonable condition -set by the Board in'its 57 discretion. 58 Section 5. Under no circumstances shall any person, firm, 59 corporation or partnership operate any festival which will continue for ., . 60 6'x more than one eight (8) hour period without a twenty-four (24) hour rest 61 . period before any continuation of the festival., 62 Section 6. No child under the age of 17 years shall, be 63 admitted to any festival unless he is accompanied by his parent or 64 guardian, Said parent or guardian shallremain with the child at all 65 times. .66 Section 7. The Board may assess a reasonable fee for the 67 issuance of the permit provided in Section 3. 68 Section 8. Anyone who violates any section of this ordinance 69 shall be prosecuted by the prosecuting officer in Indian River County f 70 having authority to prosecute misdemeanors and, upon conviction, shall 71.. be punished by fine not to exceed $500.00 or by ,imprisonment in the 72 county jail not to exceed sixty (60) days or by both such fine and imprison- ?3 ment. Each violation shall constitute a separate offense. The Board may 74 bring suit to restrain, enjoin, or otherwise prevent Violation of this • .75 ordinance in the Circuit Court of Indian River County. '- .76 Section 9. On a Motion made by Commissioner Massey, seconded by Commissioner McCullers, the request.of L. B. Vocelle on behalf of Bertram Bellay for a quit claim deed to be signed by the Chairman of the Board and attested by the Clerk of the Circuit Court to rectify an error in the description of the abandonment of Bell Aycres, Unit #1 in 1967 was'unanimously approved.. Attorney Kenneth Sharp appeared on behalf of and with. -John Pierson' of Pierson Enterprises requesting a time extension for removing the junked cars on.his premises. A Motion was made by Commissioner McCullers that the Board go with the decision of the Judge in the suit which is in process. This Motion died,for lack of second. A Motion was made by Commissioner Massey, seconded by Commissioner 4 Bogosian that John Pierson is given a'six month extension of time to remove the junked cars from his property and shall submit a progress report to the Board in sixty days. Commissioner Loy voted for the Motion and the Motion was carried with Commissioner McCullers voting against it. A Motion was made by Commissioner Loy, seconded by Commissioner Massey and unanimously carried that the Board authorizes the purchase of one aerial ownership map for the City -County Planning Office and that the order for additional maps at the written request•of the, County Officiak :mays be submitted within thirty days at a cost of $350.00 each. The Board then adjourned at 12:07 P. M. and reconvened at 1:20 o'clock P. M. 1 JUL w 1970 �� M, Y� j� •� yA� W. -Edward Weems, Jr. and Ronald W. Wiles, National Scientific Corporation appeared before the Board for the purpose of making a study at a cost of $12,840.00 to the. County for the purpose of determining the need of the County for.a data processing system. Commissioner Loy was requested to contact the elected Officials throughout the County, the School Board and the City of Vero Beach regarding their interest inAthe study. A letter was received from Harold E. Moffitt who wishes to go on record as being opposed to a moratorium on the placing of mobile homes in the County. A letter was received from the;Indian River County Chamber of I Commerce requesting that the following Resolution be made a part Df these minutes: i WHEREAS; the Long,Range Planning C'o•mmittee of the Vero Beach- Indian River County Chamber of Commerce has, for some months, been engaged in the study of the situetion.'with re4ard to the necessity •for additional bridge facilities across the Indian River, connecting the mainland -and beach area within'the City limits of Vero Beach; and WHEREAS, after much study and discussion of the problem, it appears to this Committee that all other things being equal, that the construction of a second bridge at a location within the City limits, other than at the site of the present bridge, will be more feasible and a more satisfactory solution to the problem than the expansion of the pre'se•ntly existing bridge for several reasons, not the leas t�fof which is that there would be much added traffic congestion to the approaches to the existing bridge upon its being widened; THEREFORE, be it resolved by the Long Range Planning Committee that we do urge the Board of County Commissioners of Indian River County that in its duscussion with the State Department of Transportation that they present the views of this Committee in regard to the situation, and that we urge the Department of Transportation JUL 2 2 1970 i Homer Fletcher, County Tax Assessor appeared before the Board requesting that the Tax Adjustment Board meet at 3:30.P. Lot 3, Block 1, LORD CALVERT ESTATES, according to the Plat thereof recorded in Plat Book 5, Page 57, of the Public Records, of Indian River County, Fla., 2. The former owner was,The Church of God of Gifford, - Florida. 3. The date of the Final,Decree was November 25, 1969, under which the title to said -land was quited in the county. 4. The price of the land has not been previously fixed by resolution of the board of county commissioners. 5. The use of the land was enjoyed as part of the property of The Church of God of Gifford, Florida. 6. On a Motion made by Commissioner Loy, seconded by Commissioner McCullers, the Certification of Felton Leon Flowers for free admission to the Florida School for the Deaf and the Blind was unanimously approved. On a Motion made by Commissioner McCullers, seconded'by Commissioner Massey the request of Sam Joyce, Sheriff for seamless quartz for the four booking rooms at a cost of $345.00 and for Vinyl Asbestos for other floors at a cost of $250.00 was unanimously approved. On a Motion made by Commissioner Loy, seconded by Commissioner Massey, the request of the Administrator to advertise for bids e for purchase of a new well point pump and for a compressor for painting heavy equipment was unanimously approved, providing the money is available.
