The Board of County Commissioners of Indian River'County,
Florida met in regular session at the Courthouse, Vero Beach,
Florida on Wednesday, August 5, 1970 at 8:30 o'clock A. M.
Present were Jack U. Dritenbas, Chairman, Richard P. Bogosian,
Vice Chairman, D. B. McCullers, Jr., Alma Lee Loy and Edward J.
Massey. Also present were Jack G. Jennings, County Administrator,
Paul D. Burch, Attorney to the Board of County Commissioners, and
Alfred H. Webber and Janet N. Turpan, Deputy Clerks.
The Chairman called the meeting to order and asked if there
were any additions or corrections to the Minutes of July 22.
Commissioner Loy requested that the word "easement" on the requested
change of.the minutes of July 6 should now be changed to read "to
use County road rights-of-way for the use of installing cablevision
cable". Page 1, Paragraph 3.
Commissioner Loy also requested that on Page 2, Paragraph 3
the words"to restrict the placement of mobile homes throughout the
County" should be changed to read "to restrict the placement of
mobile homes in residential areas throughout the County".
It was also mentioned that the words on Page 7, Paragraph 4
reading "written request of the County Officials would be submitted
within thirty days" should be changed to read " written request of
the County Officials may be submitted within thirty days:'.
The Chairman requested that on Page 9, Paragraph 2 "that the
County accepts the deed for right-of-way on 12th street" should
contain the property description. A deed having been obtained from
i the Recording Department will be made a part of the minutes of July 22.
These corrections and additions having been made a Motion was
made by Commissioner Massey, seconded by Commissioner Loy and the
minutes of July 6 and July 22 were unanimously approved as corrected.
A U G 5 1970
Homer C. Fletcher, County Tax Assessor appeared before the
Board reporting that the Tax Roll not having been approved, the
Tax Adjustment Board Meeting would have to be postponed until
10:00 o'clock A. M. on August 14.
Dewey Walker, County Zoning Inspector, reported on zoning
violations in the County.
Don Karseboom, Fellsmere Volunteer Fire Department appeared
in regard to the fire which destroyed the Fire Building and
equipment in Fellsmere and requested funds in the amount of $1200.00
from the County to aid in the emergency. A Motion was made by
Commissioner Bogosian, seconded by Commissioner Massey and unanimously
carried that this Board authorizes expenditures of $1,500.00 on
behalf of the Fellsmere Fire Department.
On a Motion made by Commissioner Bogosian, seconded by
Commissioner Massey, the following Item to Item Transfer was
unanimously approved:

A Motion was made by Commissioner Loy, seconded by Commissioner
Massey and unanimously carried that this is to be used for fire
fighting equipment only.
The County Administrator offered the use of the tank.and pump
from the County garage for a.few days.
Billy Roberson of the Florida Forestry Service appeared regarding
a Florida Forestry Fire Truck to be loaned for use of the Fellsmere
Fire Department. A Motion was made by Commissioner Loy, seconded by
Commissioner Massey and unanimously carried that the County accepts
,the equipment from the Florida Forestry -Service and commends Mr.
Roberson on the cooperation of his Department in making the equipment
available at such an early time; and approves the change from the.old
truck they have out there to the truck granted and the Chairman is
authorized to sign the agreement. COP,
Billy Roberson also reported that he was not at this time

because of the danger from the stones and bottles which were being
thrown at his vehicle. Sam Joyce, Sheriff, appeared in regard to
this condition and presented Reverend Stem from Wabasso and
Reverend Dillard from Gifford who wished to work with the County
in order to preserve fire protection for their respective areas.
A meeting of the Fire Protection Bodies, the above mentioned
Ministers, the Sheriff and interested individuals of the communities
was scheduled for 3:30 o'clock P. M. on Sunday at the Wabasso
Church.
On a Motion made by Commissioner Bogosian, seconded by
Commissioner Massey the plans of paving for the Food Market
parking lot on North Gifford Road and 25th Avenue dated July 1970
were unanimously approved.
Charles Smith and Fred Briggs., Hobart Landing Services Company,
appeared in regard to a water franchise. A Motion was made by
Commissioner Bogosian, seconded by Commissioner Loy and unanimously
carried that advertisement for public hearing of Hobart Landing
Services Company application as outlined in their letter of -July
24 in the outlined area be approved.
Arthur Baumhart of Fellsmere and Kenneth Pangburn appeared
in protestation of the moratorium restricting the placement of
mobile homes. A•Motion'was made -.by Commissioner Bogosian,-seconded
Commissioner Loy, with Commissioners Massey and McCullers voting
against the Motion; whereupon Chairman Dritenbas voted for the
Motion and the following Resolution was adopted:

WHEREAS, the Indian River County Zoning Commission, at the
request of the Board of County Commissioners of Indian River County,
has been working on proposed changes to the Zoning Regulations of Indian
River County, and
WHEREAS, one of said proposed changes restricts the Zoning
Districts in which mobile homes, trailers, campers and modular homes
may be located, and
WHEREAS, in the past year, the number of trailer or mobile
home permits granted in the county has increased 400%, and
WHEREAS, there are many suitable and approved locations for
trailer or mobile home living outside the zoned residential areas of the
County, and
WHEREAS, the Board of County Commissioners desires to promote
the health, safety and general welfare of the citizens of Indian River County,
desires to prevent a disproportionate high ratio of transcients to permanent
residents, desires to reduce overcrowding, desires to prevent the construction
of defective and unsanitary buildings, desires to promote the development of
Indian River County for permanent home owners, desires to protect property
values and conserve the values of buildings, desires to encourage the most
appropriate use of land, and
WHEREAS, pending the passage of the new County Zoning Ordinance,
the status quo should be preserved in so far as it is possible to do so,
THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Indian River County, -that public hearings shall be held as soon as possible
on the proposed zoning changes and after September 1, 1970 and until the new
County Zoning Ordinance is approved, no further trailer, mobile home or
modular home permits will be granted for occupancy in R-1, R-lA., R -2A,
R-2, R -3A, R-3, R -2B. For the purpose of this Resolution, "mobile home,
trailer -camper and modular homes" are defined as a single or multiple family

dwelling designed for transportation, after fabrication)on public highways on
its own wheels or a flat bed or other trailer to the site where it is to be occupied
as dwelling. Upon arrival at the site, mobile homes are complete and ready
for occupancy except for minor and incidental unpacking and assembly operations,
location on jacks or permanent foundations, connections to utilities and other
minor adjustments.

The Administrator was requested to furnish more information
regarding a request by..Mr�'Stough far repairs to a bridge on
Baughtman Road.
A Motion was made by Commissioner McCullers, seconded by
Commissioner Massey and unanimously carried that the County
Administrator be authorized to serve on the Regional Highway
Plan Implementation Committee of the East Central Florida Regional
Planning Council.
A letter was received from Howard Cail appertaining to the
performance bond held by the County on Van Trician Subdivision.
There was considerable discussion regarding a program by
Dempster Dumpster, Sanco Corporation for the disposal of trash
debris and garbage. The Chairman requested that some test wells
be drilled in the vicinity of the landfill areas to first determine
the extent of a pollution problem before further steps are taken.
A call was received from Mr. Butler requesting the Commissioners

to meet with him on Aug. 6 at 8:30 o'clock to discuss the proposed plans
of the Sebastian Inlet Park.
The Board then adjourned at 12:05 o'clock P. M. and reconvened
at 1:30 o'clock P. M., same members being present.
After considerable discussion regarding the words and intent,
A Motion was made by Commissioner Loy, seconded by Commissioner
McCullers, the following Resolution was adopted with Commissioner
Bogosian voting for the Motion and Commissioner Massey abstaining
from voting:

RESOLUTION NO. 70-31
WHEREAS, Chapter 70 - 359, Laws of 1970, amending
Section 197.065, Florida Statutes became law on August 4, 1970,
and
WHEREAS, Gene Morris, Indian River County Tax
Collector, in accordance with said law, has recommended the
following resolution by letter dated July 22, 1970 to this Board,
and
WHEREAS, this Board has found that the adoption of the
following Resolution will result in the saving of tax dollars,
NOW, THEREFORE, BE IT RESOLVED by the Board of
County Commissioners of Indian River County that the Tax Assessor
of Indian River County shall not make an extension on the tax roll for
any parcel for which the tax will amount to less than One Dollar
($1.00) and the Tax Collector of Indian River County shall not mail
notices to any taxpayer when the amount of taxes shown on the tax

notice is less than One Dollar ($1. 00). For the purposes of this
Resolution, the deduction allowed for early payment will not be

A deed was presented by Sherman N. Smith, Jr., Attorney on
behalf of the Moorings Development Company, in regard to Parcel
B, Unit No. 2, Moorings Subdivision. It was then changed from
an included stipulation that the Moorings Development Company
shall have exclusive use of the land until the time that a
bridge is constructed at that point, to a stipulation that the
County could use the property at any time for purposes for
right-of-way for installing public utilities, and that this
agreement.should be renewable at the end of a ten year period
of time. These changes having been made, on a Motion made by
.Commissioner Loy, seconded by Commissioner Bogosian, the following
Resolution was unanimously adopted and the deed was unanimously

The Board of County Commissioners of Indian River County, Florid
resolves:
1. That by its Resolution No. 68-56, it did renounce and disclaim
any right of the county and the public in and to all land or interest therein ac
quired by dedication for street, alleyway, road or highway purposes delineat
ed and shown as Floralton Boulevard upon the plat showing property of
Colonel Joseph W. Walton in Sections 21, 22, 27 and 28 in Township 33 South
Range 40 East, Indian River County, Florida, recorded in Plat Book 3, page
30, in the office of the Clerk of the Circuit Court of said county, which said
Resolution did contain a clause providing for the effective date of that Resolu
tion as follows: "Provided, however, that the provisions of this Resolution

shall become effective only upon the dedication or conveyance to Indian River
County, Florida, of all of the right of way for a public road of the area desig•
nated as Galleon Drive as shown upon the preliminary subdivision plan for
The Moorings, `Zero Beach, Florida, identified by the signature of the County
Administrator dated July 24, 1968, and filed in the records of his office. r'
The Proof of Publication of Notice of the public hearing, a certified copy of
said Resolution and Proof of Publication of Notice of the adoption of the Reso-
lution have been recorded in the office of the Clerk of the Circuit Court of
said county in Official Record Book 298, page 518.
2. This Board does herewith find and determine that said Resolution
68-56 has now become effective by virtue of the fact that by the plat of The
Moorings Unit One, recorded in Plat Book 8, page 6, and by virtue of the plat
of The Moorings Unit Two, recorded in Plat Book 8, page 28, both in the
office of the Clerk of the Circuit Court of Indian River. County, Florida, and
by virtue of a deed from The Moorings Development Company to Indian River
County, a Political Subdivision of the State of Florida presented to this Board
and approved and ordered recorded, there has been dedicated or conveyed to
Indian River County all of the right of way for a public road of the area desig-
nated as Galleon Drive as shown upon the preliminary subdivision plan des-

THIS WARRANTY DEED, Made and executed the
August, 1970, by THE MOORINGS DEVELOPMENT COMPANY, a Florida
corporation, hereinafter called the "Grantor, " to INDIAN RIVER COUNTY,.
a political subdivision of the State of Florida, whose address is Indian River
County Courthouse, Vero Beach, Florida 32960, hereinafter called the
"Grantee, " WITNESSETH:
That the Grantor, for and in consideration of the sum of Ten
Dollars ($10.00) and other valuable considerations, receipt whereof is here-
. by acknowledged, by these presents does grant, bargain, sell, alien, re -
mise, release, convey and confirm unto the Grantee, all that certain land
situate in Indian River County, Florida, viz:

All of Parcel "B" as shown upon the plat of The Moorings
Unit Two, recorded in the office of the Clerk of the Cir-
cuit Court of Indian River County, Florida, in Plat Book
8, page 28, PROVIDED, HOWEVER, that this conveyance
is made subject to the following:
1. Until the provisions of paragraph 3 hereof become
effective, the Grantee shall use the above described
property solely for a right of way for public utilities.
2. With the exception of the use and possession authorized
in paragraph one hereof, the Grantor does herewith reserve
unto itself, the exclusive right of possession of all of the
above described property until the provisions of paragraph
3 hereof become effective or until ten (10) years from this
date, which ever shall first occur.
3. The further purpose for this conveyance is to permit
the Grantee to use all of said above described property
as the right of way for a public road to connect Mooring
Line Drive as shown upon said plat with any causeway or
bridge hereafter constructed from the West line of said
Parcel "B" to the West shore of the Indian River. When
construction of said causeway or bridge across the Indian
River begins, then the right of possession of the Grantor
set forth in paragraph 2 hereof shall terminate and the
use and possession of said Parcel "B" by the Grantee for
the purposes herein stated shall begin.
TOGETHER with all the tenements, hereditaments and appurt-
enances thereto belonging or in anywise appertaining.
TO HAVE AND TO HOLD the same in fee simple forever.

The Administrator•was directed to reply to a letter from
William Lyon regarding the resale of.submerged lands to a public
body.

The Board felt that because of the cost and the continuing
turn -over of personnel, a County manual as suggested per letter
by John H. Lea would not be justifiably beneficial to the County.
Commissioner McCullers left the meeting.
A letter was received from the Department of Natural.Resources
regarding Florida Statute 70-634 appertaining to the prohibition of
construction within fifty feet of the Atlantic Ocean; and regarding
Florida Statute 70-155 authorizing the County to restore shorelines
and beaches.
A letter was received from Jackson and Clem regarding the
Drive -In property of the Indian River Citrus Ban].
On a Motion made by Commissioner Loy, seconded by Commissioner
Massey -designation to be made by the Clerk whether Democrat or
Republican, the following list was unanimously approved:

On a Motion made by Commissioner Loy, seconded by Commissioner
Massey, the State Witness Payroll for the County Court, May Term
in the amount of $114.32, the State Witness Payroll for the County
Court, May Term in the amount of $145.00-afid the State Witness Payroll
for the. Circuit Court, Spring Term in the amount of $111.92 were
unanimously approved.
The Sheriff filed with the Board a statement of his appointment
of Russell W. Billingsley as Deputy Sheriff, whose voting precinct
is No. 1-C, and the said Deputy Sheriff filed his bond with the
.Clerk of the circuit Court, which was presented to the Board. on
Motion made by Commissioner Massey, seconded by Commissioner Loy
and unanimously carried, the bond of said Deputy Sheriff was approved
and ordered filed with the Clerk of the Circuit Court.
On a Motion made by Commissioner Loy, seconded by Commissioner

RESOLUTION NO. 2/ 7y
WHEREAS, the Long Range Planning Committee of the Vero Beach -
Indian River County Chamber of Commerce, and other interested
citizens and organizations have, for some time been engaged in
the study of the necessity for additional bridge facilities
across the Indian River, connecting the mainland with the beach
area, within the city limits of said city, and
WHEREAS, after much study and discussion the Long Range
Planning Committee of the Vero Beach -Indian River County Chamber
of Commerce passed a resolution urging the Board of County
Commissioners of Indian River County to present the necessity
of the construction of a second bridge across the Indian River
within the city limits of Vero Beach;
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
VERO BEACH that we do endorse and approve the position taken by
the Long Range Planning Committee of the Vero Beach -Indian River
County Chamber of Commerce and other interested citizens and
organizations, and that we join in urging the Board of County
Commissioners of Indian River County, in their discussion with
the State Department of Transportation to urge that department
to give proper consideration to the desirability of constructing
a second bridge across the Indian River, within the city limits
of the city of Vero Beach, rather than to consider the widening
of the existing bridge.
BE IT FURTHER RESOLVED that a copy of this resolution be
forwarded to the Board of County Commissioners of Indian River
County, Florida.
The monthly report of the County Welfare Caseworker was
received and placed on file in the office of the Clerk.

A Motion was made by Commissioner Loy, seconded by Commissioner
Bogosian and the following Resolution was unanimously adopted:
RESOLU'I'1.ON NO. 70-33
WHEREAS, the Department of 1)crfense has announced plans that
on August 10, 1970, they will begin preparations to bury concrete coffins
of obsolete nerve gas 280 miles off Cape Kennedy, Florida, and
WHEREAS, experts are not in agreement about the best method
of disposal or the ecological and economical effects of this; du►nping, and
WHEREAS, the Honorable Claude Kirk, G(wernor of the State of
Florida, has announced that the State of Florida is opposed to said
dumping,
NOW, THEREFORE, BE IT RESOLVED by the 13oard of County
Commissioners of Indian River County that they are unanimously opposed
to the Department of Defense dumping nerve gas off the shores of Indian
River County and urge Governor Kirk to take all possible stops to insure
the safety of the citizens of the State of Florida from this potential menace.

A letter was received from Ralph Harris, Clerk of the Circuit
Court requesting purchase of the Smedley book of aerial photos.
The several bills and accounts against the County, having been
audited, were examined and found to be correct were approved and
warrants issued in settlement of same as follows: General Fund
Nos. 1274 to 1344 inclusive, Road and Bridge Fund, Nos. 665 to
706 inclusive, Fine and Forfeiture Fund, Nos. 244 to 253 inclusive.
Such bills and accounts being on file in the office of the Clerk
of the Circuit Court, the warrants so issued from the respective
funds being listed in the Supplemental Minute Book as provided by
the rules of the Legislative Auditor, reference to such record
and list so recorded being made a part of these minutes.
There being no further business, on Motion made, seconded and
carried the Board then adjourned at 5:15 o'clock P. M.
