PUBLIC UTILITY EASEMENT
THIS PUBLIC UTILITY EASEMENT , made and executed this day of
MAY , 2011 ) by SASSON KASSAB and REGINA KASSAB , Trustees of the
Sasson Kassab Living Trust dated August 5 , 2009 , and any amendment thereto , whose
address is 36 NE First Street, Suite 211 , Miami , FL 33132 , hereinafter called " Grantor", to
INDIAN RIVER COUNTY , FLORIDA , hereinafter called " Grantee" .
(Wherever used herein the term Grantor and Grantee include all pOarties to this instrument and their heirs, legal
representatives, successors , and assigns)
WITNESSETH :
That Grantor for and in consideration of the sum of One Dollar and other consideration,
receipt of which is hereby acknowledged , does hereby grant, bargain sell , alien, remise , release ,
convey, and confirm unto Grantee an easement for Public Utilities including, but not limited to ,
natural gas along, over , across , and beneath the following described land , situate in Indian River
County, Florida, to -wit :
The West 25 feet of Tract 7 lying north of the North right of way of State Road
60 , in Section 1 , Township 33 South, Range 38 East, according to the last general
plat of lands of the Indian River Farms Company Subdivision, as recorded in Plat
Book 1 , Page 25 , of the Public Records of St . Lucie County, Florida; said lands
now lying and being in Indian River County, Florida .
Grantor hereby reserves the right of ingress and egress over, upon, and across the
easement parcel herein described, for the Grantor, and Grantor ' s successors , assigns , Lessees ,
Licensees , and invitees . Grantor further reserves the right to construct a roadway over the
easement parcel , or portion thereof, for the passage of vehicular and pedestrian traffic .
And Grantor hereby covenants with said Grantee that it is lawfully seized of said servient
land in fee simple , and that it has good right and lawful authority to convey the easement
established hereby, subject to mortgages and other encumbrances or restrictions of record .
IN WITNESS WHEREOF , the Grantor has herein set its hand and seal the day and year
first above written .

CONSENT AND JOINDER
The undersigned, INDIAN RIVER COUNTY, a political subdivision of the State of Florida,
as the owner and holder of the existing utilities easement by virtue of that easement granted at
Official Record Book 1296 , Page 238 , Public Records of Indian River County, Florida, hereby
consents and joins in this Amended Grant of Easement.
IN WITNESS WHEREOF , this Consent *and Joinder is executed by the undersigned this
