This Amendment Number 1 to Work Order 4 ("Amendment" ) is entered into as of
this day of December 18 , 2012 (" Effective Date" ) pursuant to that certain Continuing
Contract Agreement for Professional Services entered into as of November 15 . 2011 . (the
"Agreement" ) , by and between Indian River County , a political subdivision of the State of
Florida (" COUNTY" ) and Kimley- Horn and Associates Inc. ( " CONSULTANT" ) .
1 . The COUNTY has selected the Consultant to perform the professional
services set forth in Work Order Number 4 dated September 18 , 2012 .
2 . The COUNTY and the Consultant desire to amend Work Order Number 4
as set forth in Attachment 1 attached to this Amendment and made a part hereof by this
reference , all in accordance with the terms and provisions set forth in the Agreement .
3 . From and after the Effective Date of this Amendment , Work Order Number
6 is amended as set forth in this Amendment . Pursuant to paragraph 1 .4 of the Agreement ,
nothing contained in any Work Order shall conflict with the terms of the Agreement and the
terms of the Agreement shall be deemed to be incorporated in each individual Work Order
as if fully set forth herein .
IN WITNESS WHEREOF , the parties hereto have executed this Amendment as of
the Effective Date first written above .

Amendment to Work Order Number 4
Additional Permitting Services for
Algal Turf Scrubber System at
5`h Street SW Site
South RO Plant Concentrate Disposal
PROJECT DESCRIPTION
This Amendment to Work Order #4 includes additional permitting and design services as
requested by the Indian River County Utility Department, beyond what was included in
Work Order #4 and the previous Work Order #2 . In summary, the additional scope of
work in general, consists of.
IRFWCD Permitting
The County has requested that Kimley-Horn and Associates prepare and submit the permit
applications to the Indian River Farms Water Control District Board (IRFWCD) for the
proposed improvements at the Algal Turf Scrubber (ATS) site . The permit applications
will be for the proposed driveway connection and culvert, the removal of the existing
driveway and culvert, and ancillary improvements to the Sub- lateral J- 1 canal.
Additional Environmental Resource Permitting
The County has requested the Kimley-Horn and Associates prepare and submit a Standard
General Environmental Resource Permit (ERP) application and permit documents to the
Florida Department of Environmental Protection (FDEP) and the United States Army
Corps of Engineers (USACE) for the proposed stormwater pump station, the ATS site, the
ATS stormwater pipe, the access road from the adjacent South County Water Treatment
Plant (WTP) to the ATS site, and ancillary improvements to the Sub- lateral J- 1 canal. As
part of Work Order #4, Kimley-Horn was responsible for permit documents related to the
stormwater pipe only; however, the County has since requested that Kimley-Horn and
Associates prepare and submit the application and supporting documents for all of the ATS
project.
• This work order includes additional permitting services to prepare the Standard
General ERP application and supporting documents for the stormwater pump
station, ATS site, the ATS stormwater pipe, the access road from the adjacent
South WTP to the ATS site and ancillary improvements to the Sub- lateral J- 1
canal. This work also consists of additional design services to prepare drainage

calculations for the ATS site and a mitigation plan for wetland impacts on the ATS
site . The supporting documents for the ATS stormwater pipe will be prepared as
part of Work Order #4,
The following scope of work under this work order consists of.
SCOPE OF SERVICES
Task 1 — SURVEY AND UTILITY LOCATES
Additional Survey and Utility Locate Services are not included with this Amendment.
Task 2 - DESIGN
Additional Design Services for the stormwater pipe are not included with this Amendment.
Task 3 —PERMITTING
Task 3. 1 IRFWCD Permitting
Consultant will prepare and submit three (3 ) permit applications with permit exhibits for
the Algal Turf Scrubber (ATS) project to the Indian River Farms Water Control District
(IRFWCD) for review and approval. This is in addition to the one ( 1 ) IRFWCD
application that the Consultant will prepare as part of Work Order #2, for the proposed ATS
stormwater pipe crossing of the South Relief Canal . The permit applications will include .
• IRFWCD Application for Utility Construction Permit is permit will be for the
proposed ATS stormwater pipe crossing of the Sub-lateral J- 1 Canal .
• IRFWCD Application for Connection to or Use of District Facilities — This permit
will be for the proposed driveway connection and culvert and the removal of the
existing driveway and culvert .
• IRFWCD Application for Review of Site Plans for Subdivision, Bridges, &
Commercial Sites — This permit will be for ancillary improvements to the Sub=
lateral J- 1 canal.
Consultant will respond to one reasonable request for additional information and questions
by IRFWCD for each permit application.
The anticipated fee for the proposed utility crossing of the Sub-lateral J- 1 Canal is $250.

IRFWCD has indicated that there will be no fee for the driveway connection since it is a
replacement culvert and driveway and they will waive the application fee for the permit
application for the ancillary improvements to the Sub- lateral J- 1 Canal. All fees for the
IRFWCD permits will be paid for directly by the Indian River County Utility Department.
Task 3.2 ERP Permittine Services
Consultant will prepare and submit Sections A. C, and E of the Joint Environmental
Resource Permit Application (Form# 62-343 .900( 1 )) to the FDEP/USACE for the project.
This effort will consist of preparing the requested exhibits, review of plans provided by
Indian River County for the stormwater pump station and ATS site, preparation of
drainage calculations, preparation of a wetland mitigation plan, and compiling of
documentation requested in the application.
The plans provided by Indian River County will be used to illustrate water quality features,
such as water quality treatment areas, and will be submitted with the permit application.
The Consultant will develop erosion control details that will be submitted to the FDEP .
These erosion control details will be provided to Indian River County for incorporation
into the ATS site construction documents.
The Consultant will prepare additional exhibits consisting of wetland and surface water
impact plans and typical section, a location map, a soils map and land cover map. A
narrative will be prepared describing the proposed project and a brief narrative of the
existing environmental conditions .
The Consultant will prepare a mitigation plan including planting details for submittal with
the ERP . It is possible that the wetland treatment areas on the ATS site can be used to
mitigate the minor wetland impacts associated with the ATS site development. If the
treatment wetlands are not a suitable mitigation option, the Consultant will coordinate with
the County to identify an alternate mitigation option for the mitigation plan.
The Consultant will prepare and submit drainage calculations with the permit application
that will demonstrate the pre and post discharge from the ATS site and will quantify the
water quality treatment being provided. From conversations with FDEP, the stormwater
management system at the ATS site will need to provide treatment -for 150% of its
impervious area since the South Relief Canal discharges to an Outstanding Florida Water.
Calculations and documentation that demonstrate that the canals downstream from the
project site (Sub- lateral J and Lateral J) have sufficient capacity to handle the additional
discharge from the ATS site will also be submitted with the permit application package .

The permit fee for the application is expected to be $ 850 and is to be paid for directly by
the Indian River County Utility Department.
The Consultant will prepare for and attend two field meetings ; one with USACE and one
with FDEP . The Consultant will attend one meeting with FDEP following submittal of the
ERP application and one meeting with USACE, if required.
The Consultant will respond to one request for additional information from FDEP and
USACE. Additional requests for information will be provided as an additional service .
The following assumptions have been made regarding the scope of services in this task.
• Grading plans and details for the ATS will be prepared by Indian River County.
Indian River County will provide signed and sealed drainage plans that can be
included in the ERP permit submittal package . Grading plans and details for the
access driveway from the South WTP site and the ancillary Sub4ater J canal
improvements will be provided by KHA as part of a separate work order (Work
Order #4).
• Any grading and/or drainage modifications that need to be made on the ATS site as
a result of the ERP permitting process will be made by Indian River County. KHA
will coordinate with the Indian River County Public Works and Utility
Departments to provide guidance on the types of grading and drainage
improvements that may be required as part of the permit process.
• Any improvements illustrated in the permit level sketches prepared by KHA will be
added to the ATS site plans and advanced to a level of completion and detail
reasonably sufficient for construction by Indian River County.
• Wetland and surface waters have been delineated and surveyed and IRCU will
provide the survey in CADD to KHA. Thus, wetland flagging and delineation has .
not been included with this scope.
• The access road from the ATS site to the water plant will be planned to the extent
practical to avoid wetlands . Thus, mitigation for wetland impacts will not be
required for this portion of the road .
• Detailed Alternatives Analyses will not be required and site plan changes will not
be required to avoid surface water impacts .
• US Fish and Wildlife Service coordination will not be required.

Task 4 — CONSTRUCTION PHASE SERVICES
Additional Construction Phase Services are not included with this Amendment.
Task 5 — ATS SITE PLANNING
Additional ATS Site Planning Services are not included with this Amendment.
ADDITIONAL SERVICES
The following services are not included in the Scope of Services for this project, but may
be required depending on circumstances that may arise during the execution of this project.
Other items that may be considered additional services are mentioned herein. Additional
services include, but may not be limited to the following.
• Construction phase services including preparing the certification documents for the
FDEP and USACE permits
• Additional meetings beyond what is described in the Scope of Services
• Traffic studies
• Building department coordination
• Additional permitting beyond what is described in the Scope of Services, including
preparation of the IRFWCD permit for the proposed connection to the Sub- lateral
J= I canal for discharge and proposed ATS pump station
• Additional wetland mitigation beyond what is described in the Scope of Services
INFORMATION AND SERVICES PROVIDED BY OWNER
The Owner shall provide the following information related to the design of this
construction project :
• Stormwater pump station design, including site and mechanical plans by IRC
public works
• Boundary survey, base survey including wetland delineation, tree survey,
topographical information, and drainage plans and details for the new ATS site by
IRCU
• Geotechnical studies performed for the ATS site
• Drainage calculations that have been prepared for the ATS site and stormwater
pump station
• Copies of easements and plats for the ATS site and stormwater pump station

ATTACHMENT A - SCHEDULE
Since these tasks are greatly dependent on agency review and public comments, a more
defined schedule cannot be defined . Consultant will work as expeditiously as practical and
within a mutually agreed upon schedule. Submittal of applications for Task 3 is
anticipated to be completed within 6 weeks of notice to proceed .

ATTACHMENT B - FEES
