AMENDMENT NO , 3 TO THE PROFESSIONAL CIVIL ENGINEERING i
SERVICES AGREEMENT FOR CIVIL ENGINEERING , SURVEYING
AND BRIDGE DESIGN SERVICES
41ST BRIDGE REPLACEMENT OVER IRFWCD LATERAL A CANAL
(66TH AVENUE)
AMENDMENT NO. 3 TO THE PROFESSIONAL ENGINEERING/LAND SURVEYING
SERVICES AGREEMENT BETWEEN KIMLEY-HORN AND ASSOCIATES , INC. AND
INDIAN RIVER COUNTY, FLORIDA.
This is an amendment to the existing Engineering/Land Surveying Services Agreement
(AGREEMENT) dated April 1St, 2003 between Kimley-Horn and Associates, Inc . (ENGINEER)
and Indian River County (COUNTY) . This amendment addresses changes in " Section III -
Scope of Services " , " Section V - Compensation " and " Section XVI — Duration of Agreement " of
the AGREEMENT .
Amendment Description
This Amendment includes the following :
" SECTION III — SCOPE OF SERVICES " is being modified to incorporate the following :
Utility Design
The ENGINEER will develop construction documents to detail the extension of the
existing 12 " water main, located along 41St Street east of 66th Avenue , over the proposed
bridge to be constructed on 41 st Street to the western right of way along 66th Avenue . In
addition, the existing 12 " reuse main will be modified to provide for a service connection
along the western right of way along 66th Avenue .
Utility Permitting
The ENGINEER will incorporate these utility modifications within a FDEP public
drinking water permit and/or notification as required . The consultant will coordinate
with FDEP in regards to obtaining these permits and/or authorizations . The COUNTY
will be responsible for all permit application and agency review fees .
Stormwater Permitting
The ENGINEER will submit a Standard General Enviromental Resource Permit to St .
Johns River Water Management District to address the proposed roadway improvements
along 41 st Street that is associated with the 66th Avenue/ 41 st Street Intersection
Improvement . The proposed 66th Avenue roadway and drainage improvements is
intended to be permitted by others . The COUNTY will be responsible for coordinating
with Indian River Farms Water Control District regarding the time extension of the

existing permit . The COUNTY will be responsible for all permit application and agency
review fees .
" SECTION V — COMPENSATION " is being modified to incorporate the following :
The COUNTY agrees to pay and the ENGINEER agrees to accept for services rendered
pursuant to this Agreement fees inclusive of expenses in accordance with the following :

The basic compensation mutually agreed upon by the ENGINEER and the
COUNTY is as follows :

The charges associated with the AGREEMENT (which include changes from
Amendments 1 and 2 and these additional services included in proposed Amcndment No .
3 ) , shall be increased from 5172 , 269 . 00 to S 187 , 5 19000 ,
" SECTION XVI — DURATION OF AGREEMENT" is being modified to incorporate the
following :
The utility construction documents and permit applications will be submitted to within
three (3 ) months following authorization to proceed .

The AGREEMENT is hereby amended as specifically set forth here in . All other sections of the
AGREEMENT shall remain in full force and effect and are incorporated herein .
This Amendment No . 3 to the AGREEMENT regardless of where executed, shall be governed
by and construed by the laws of the State of Florida .
In witness whereof the parties have executed this Amendment this 7th day of
February 2012 .
