AMENDMENT TO AGREEMENT BETWEEN INDIAN RIVER COUNTY,
FLORIDA, AND THE BOARD OF TRUSTEES, INDIAN RIVER COUNTY
LAW LIBRARY
THIS AMENDMENT is made as of this 13 day of November , 2012 , by and
between Indian River County, a political subdivision of the State of Florida ("County") , and the
Board of Trustees, Indian River County Law Library, a special agency created by Chapter 57-
1410 , Laws of Florida ("Trustees") , to that certain Agreement Between Indian River County,
Florida, and the Board of Trustees , Indian River County Law Library, dated July 18 , 1989
("Agreement") . .

WITNESSETH :
WHEREAS , in 1957 , the Florida Legislature enacted Chapter 574410 , Laws of Florida,
which created the Trustees and authorized the Trustees to establish, operate and maintain a law
library for the citizens of Indian River County ; and
WHEREAS , subsequent to 1957 , and acting pursuant to Chapter 57- 1410, Laws of
Florida, the Trustees established, operated and maintained a law library in the then existing
Indian River County Courthouse; and
WHEREAS , on July 18 , 1989 , the County and the Trustees entered into the Agreement
which transferred to the County complete responsibility for operating and maintaining the law
library ; and
WHEREAS , in section 3 of the Agreement, the County acknowledged that as long as the
Agreement is in effect, the law library will be located in the existing or any future Indian River
County Courthouses and
WHEREAS , the parties now desire to amend section 3 of the Agreement to create
certain flexibility with respect to the location of the law library, as set forth herein,
NOW, THEREFORE , in consideration of the mutual undertakings set forth herein, and
for other good and valuable consideration, the receipt and adequacy of which is hereby
acknowledged, the parties agree, as follows :
1 . Recitals . The above recitals are true and correct, and are incorporated herein.
2 . Amendment of Section 3 . Section 3 of the Agreement is hereby deleted in its
entirety and replaced with the following language : "As a material consideration for this
agreement, the County acknowledges that as long as this operation contract is in force and effect,
the law library will not be moved from the vicinity of the Indian River County Courthouse . The
County is specifically authorized to move the law books to the main public library located at
1600 20 Street, Vero Beach, Florida, and to maintain one or more computer terminals in the
courthouse for use by attorneys and members of the public conducting electronic legal research . "

3 . Remainine Provisions . In all other respects, the Agreement, as amended, shall

remain in full force and effect .
IN WITNESS WHEREOF, this First Amendment is executed by the authorized
representatives of the Parties , as of the day and year first above written .
