The Board of County Commissioners of Indian River County, Florida
met in regular session at the Courthouse, Vero Beach, Florida on
Thursday, October 22, 1970. Present were Jack U. Dritenbas, Chairman;
Richard P. Bogosian, Vice Chairman; D. B. McCullers, Jr.; Alma Lee
Loy and Edward J. Massey. Also present were Jack G. Jennings, County
Administrator; Paul D. Burch, Attorney to the Board of County
Commissioners; and Alfred H. Webber, Ralph H. Stewart and Janet N.
Turpan, Deputy Clerks.
The Chairman called the meeting to order and asked if there
were any additions or corrections to the minutes of the regular
meeting of October 7, 1970. There were none and upon Motion of
Commissioner McCullers, second of Commissioner Massey,.the Board
unanimously approved the minutes of the regular meeting of October
7, 1970 as written. There being no additions or corrections to'the
minutes of the special meeting of October 16, Motion was made by
Commissioner McCullers, seconded by Commissioner Loy, and the
Board unanimously approved the minutes of the special meeting of
October,16, 1970 as written.

The foregoing letter having been received, Motion'was made by
Commissioner McCullers, seconded by Commissioner Loy, and the
Board unanimously granted the request that the name of Francis T.
O'Brien be removed from the list of Candidates in accordance with
Chapter +r

Dewey Walker, County Zoning Inspector reported on progress
in removing zoning violations.
Henry Allen reported on the progress in -fencing his junk
yard which was satisfactory to the Board, as he has until January
21, 1971 to complete the fence.
On•Motion of Commissioner, Massey, second of Commissioner
McCullers, the Board unanimously authorized'advertisement for
public hearing before the Zoning Board, on the requested zoning
change of Marshall Barnes, South Winter Beach Road for the purpose
of establishing an industrial park.
The County Administrator presented a final plat of a Subdivision
known as Orangewood Estatea'Subdivision and recommended its final'
approval as meeting County Subdivision Requirements. Upon a Motion
made by Commissioner Loy, seconded by Commissioner Massey and
unanimously carried the recommended final approval was given for
Orangewood Estates Subdivision vubject to the depositing of a
$500.00 performance bond with the Clerk to be refundable one year
from today in which time the roads and ditches are to be maintained
._ by the developer, and final approval and inspection are made by the
County.
Don Karseboom, Fellsmere Volunteer Fire Department, reported
on the cooperation given to them and on their progress in replacing
the fire house and equipment -which was destroyed by fire. On Motion
of Commissioner Bogosian, second of Commissioner McCullers, the
Board unanimously authorized the Administrator to use County equipment
to aid the Fellsmere Fire Department in replacing their building..
On Motion of Commissioner Massey, second of Commissioner
McCullers, the Board unanimously moved that the County contribute
an,. additional $3,500.00 to the Fellsmere Volunteer Fire Department
to be used together with other funds for the purchase of a fire
truck, -title to which will be transferred to the County; and approved
the following Item to Item Transfers: °

McCullers, the Board unanimously authorized advertisement for
public hearing for transfer of Cablevision Permit from Sigma, Inc, to
Indian River Cablevision, Inc. as requested by Gilbert Swiger,
A letter was receivedfrom Florida Health and Rehabilitative
Services approving the establishment of a single health unit in
Indian River County with Doctor Flood as Director. .
The hour of 10:00 o'clock A. M. having passed, the Chairman

The Chairman then asked if anyone present wished to be heard.
There were none and after some deliberation regarding drainage
easements, on Motion of Commissioner Massey, second of Commissioner
McCullers, the Board unanimously moved to continue the public
hearing at another meeting.
On Motion of Commissioner McCullers, second of Commissioner
Bogosian, the Board unanimously moved that the request of Knight
Brothers for culverts and the construction of a road, be tabled
until a later meeting.
On Motion of -Commissioner Bogosian, second of commissioner

McCullers, the request of Rivers Anderson, that performance bond
on Indian River Twin Estates Subdivision be reduced and that the
Clerk be authorized to return $1,200.00 to the owner; and that copies of
proposals for the unfinished work be filed in the office of the
Administrator, was granted.
On Motion of Commissioner McCullers, second of Commissioner Loy,e
the Board unanimously authorized the Administrator to advertise for.
bids for a motor grader.
On Motion of Commissioner Bogosian, second of Commissioner
McCullers, the Board unanimously authorized the Administrator to
advertise for bids for a tire changer and wheel puller.
On Motion of Commissioner Massey, second of Commissioner
McCullers, the low bids in the bids for the 1970-71 Road Materials
as bid in the bid opening of October 7, were accepted as follows:

The Board deferred action on realignment of a drainage and
utilities easement in Suncrest Terrace Subdivision until the
time that Frank Zorc, developer, can appear before the Board.
On Motion of Commissioner McCullers, second of Commissioner Loy,
the Board unanimously authorized the Attorney to attend the hearing
on the Legislative Budget.
John E. Banks, Florida Inland Navigational District appeared
before the Board requesting the opinion of the Board regarding,
the selection by the Florida Audubon Society of Indian River Islands
for bird sanctuary.purposes. Because of the vast acreage of Pelican
Island National Wildlife Refuge located in Indian River County,
Commissioner Massey felt the islands located north of Wabasso should
be used for human recreation.
The Board then adjourned at 12:20 o'clock P. M. and reconvened
at 1:45 o'clock P. M.
On Motion of Commissioner Loy, second of Commissioner McCullers,
the Board unanimously approved the application of Franklin G. Melton
for permit to carry fire arms.
On Motion of Commissioner MdCullers, second of Commissioner
Bogosian, the Board unanimously approved the following Monthly
Warrants:

The Sheriff filed with the Board a statement of his
appointment of Neil G. Bevis as a Deputy Sheriff, whose voting
precinct is No. 4 A, and the said Deputy.Sheriff filed his bond
with the Clerk of the Circuit Court, which was presented to the
Board. On Motion of Commissioner Loy, second.of Commissioner
McCullers, the Board unanimously approved the bond of said Deputy
Sheriff which was ordered filed with the Clerk of the Circuit Court.
On Motion of Commissioner McCullers, second of Commissioner Loy,

RE S OLUT.I ON 70-47
WHEREAS, November 11th was originally designated as Armistice Day,
cor-.."raorating the cessation of hostilities following World War I, and
WHEREAS, the significance of this day has not changed but it has
now become known and designated a's Veterans' Day, as a day, not of
mourning but of recollection and dedication, and
WHEREAS, the Veterans Council of Indian River County believes that
one of the most vital things needed in our country today is a re -awakening
of patriotism that has in the past characterized our country, throughout its
long history, and a rededication by all Americans to the principles for
which our country stands, and for which it was founded, and
WHEREAS, the Veterans Council of Indian River County is -planning
.a patriotic program to take place at Memorial Island in Vero Beach, on
Veterans Day, November 11, 1970;
NOW, THEREFORE, BE IT RESOLVED BY the Board of County Commissioners
of Indian River Couhty, Florida:
That we do command the Votorans Council of Indian River County for
its foresight and interest in arranging the meeting to be held on Veterans
Day, November 11,1970, and we do call upon all of our citizens to participate
in this program and to take part in all of the ceremonies incident thereto,
and more importantly to use and observe the day as a day of appreciation for
all of those who have made sacrifices that our freedoms may be preserved, and
as a day when all of us should rededicate ourselves to love of our country
and to recognition of the necessity for the observance of and adherence to
law and order and justice to all of our citizens, if our way of life is not
to perish from the earth.
BE IT FURTHER RESOLVED that this body does hereby,by the adoption
of this Resolution, recognize the splendid work that is being done by the
Veterans Council of Indian River County in giving due recognition to the
significance and importance of Veterans Day and that we do pledge to the
Veterans Council our full cooperation in connection with the arrangements
and events planned for that occasion.
On Motion of Commissioner Loy, second of Commissioner McCullers,
the following Resolution was unanimously adopted:

WHEREAS, the Vegetable Industry of Florida is a multimillion
dollar business with tomatoes and strawberries being a major
commodity..
WHEREAS, the continued increase in importation of tomatoes
and strawberries from Mexico constitutes a most serious threat
to our.agri-business economy which cannot compete because of
wage differential between Mexican and American workers.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA IN REGULAR
MEETING ASSEMBLED.THIS 22ND DAY OF OCTOBER, 1970.
That the Board of County Commissioners of Indian River
County does hereby respectfully request the Congress of the
United States of America to take whatever action is available
and appropriate to protect our Vegetable Industry in the United
States from drastic consequences of the unlimited importation of
tomatoes and strawberries from Mexico.
BE IT FURTHER RESOLVED, that certified copies of this
Resolution be furnished to the Honorable Spessard L. Holland,
United States Senator; the Honorable Edward J. Gurney, United
States Senator; and the Honorable Sam Gibbons, United States
Congressman; the State Association of County Commissioners and
to each of the Boards of County Commissioners of the State of
Florida.
• On Motion of Commissioner•McCullers, second of Commissioner Loy,
the Board unanimously approved out of County, travel of Forrest N.
McCullars, County Extension Agent to Miami on.October 28 through
30 to attend the State Horticultural Society Convention.

On Motion of Commissioner Loy, second of Commissioner Bogosian
the Board unanimously voted to go on record as being in favor of
Amendment 44 on the November 3 ballot in regard to state Pollution
Control.
Planned Unit Development, having been tentative approved by
Indian River County Planning and Zoning Commission, was presented
to the Board of County Commissioners for tentative approval and
for authorization for public hearing. Members of the Indian River
County Planning and Zoning Commission; Valentyne Brennan, Indian
River County and -City of Vero Beach Planner; appeared in favor of
tentative approval of the concept. Charles Herring, Attorney and,
partial owner -developer, and Gerald Dake, designer appeared in
regard to Bellamar Subdivision, a model concept of Planned Unit
Development, which was also being considered for tentative approval
and advertisement for public hearing. Members of the Beach Association
appeared in protest of the concept.
On Motion of Commissioner Bogosian, second of Commissioner Loy,
the Board unanimously voted to deny the request of the Zoning Commission
for tentative approval and authorization for advertisement for
public hearing on Planned Unit Development.
The several bills and accounts against the County having been
aulited,were examined and found to be correct were approved'and
warrants issued in settlement of same as follows: General Fund,
Nos. 1658 to 1712 inclusive; Road and Bridge Fund, Nos. 841 to
875 inclusive; Fine and Forfeiture Fund, Nos. 288 to 293 .inclusive.
Such Mlls and accounts being on file in the office of -the Clerk
of the Circuit Court, the warrants so issued from the respective
funds being listed in the Supplemental Minute Book as provided by
the rules of the Legislative Auditor, reference to such record
and list so recorded being made a part of these minutes.
There being no further business, on Motion made, seconded and
carried, the Board adjourned at 5:25 o'clock P. M. '
