M. Present were Jack U. Dritenbas, Chairman;: D. B. McCullers, Jr.; Alma Lee Loy and Edward J. Massey. Absent was Richard P. Bogosian, Vice Chairman, canvassing absentee ballots as required by law, Also present were Jack G. Jennings, County Administrator; Paul D. Burch, Attorney to the Board of County Commissioners; Reams, Deputy Sheriff; and Alfred H. Webber, Ralph H. Stewart and Janet N, Turpan, Deputy Clerk@. The Chairman called the meeting to order and asked if there were any additions or corrections to the minutes of the regular meeting of October 22, 1970. There were none and upon Motion of Commissioner Loy, second of Commissioner Massey the Board unanimously approved the minutes of the:- regular meeting of October 22, 1970 as written. These trees aro at least forty years of age and many of them have been damaged due to cold and are partly dead. I believe they are too old to advise pruning them back., I believe the only thing I could recommend at this time would 'be removal of the trees when and if the money is available,. You will not be able to widen or improve that highway due to the root system of these gees. I have discussed the removal of the trees with the family ownini the property adjoining them and they would not*object if .they were removed ,even though they would hate to lose them. On Motion of Commissioner Loy, second of Commissioner Massey, the Board unanimously approved payment of bills 227,229 and 230 to Smith, Heath, Smith and O'Haire fur*,condemnation suits on SR 600 SR 611 and SR607 in the amount of $2,649.10. On Motion of Commi@mionor Loy, @®Cond of Commi®®i®n@r MoCu11®r®, the Board unanimously approved renewal of Notary Public for Ernestine Park. Chester Clem, Attorney, appeared in behalf of the Retail Liquor Association of Vero Beach, requesting that the Board take action to extend the hours of these businesses from 1:00 o'clock A.M. to 2:00 o'clock A. M. daily, except Sunday. James Graves, Minister of the First Baptist Church; Hayes B. Davis, Pastor of.the Forest Park Baptist Church; and James R. Thompson and other members of the Ministerial Association appeared in protest of the change. After considerable discussion, Motion was made by Commissioner Massey, seconded by Commissioner McCullers and unanimously carried that the Board authorizes advertisement for public hearing on December 9, 1970 for ordinance to extend the hours of the liquor businesses in 'the County. There were none and upon Motion made by Commissioner McCullers, seconded by Commissioner Massey, the following County Ordinance was unanimously adopted: NOV � 1970 COUNTY ORDINANCE NO. 2 1 An Ordinance to be entitled: 2 An Ordinance relating to the procurement of licenses to 3 carry firearms, providing for the application procedure, 4 providing for a fee to be paid for the issuing of the license, 5. providing standards for the issuing of licenses and pro - 6 viding an effective date. 7 Be it ordained by the Board of County Commissioners of Indian River 8 County: 9 Section 1. This Ordinance is enacted pursuant to Chapter 69.234, 10 Chapter 69. 32, Laws of Florida, 1969 and Florida Statute 790. 06 , 1969 11 for the purpose of regulating the carrying of certain firearms in Indian 12 River County. This Ordinance shall apply and be enforced in all areas 13 of- Indian River County not within the boundaries of any municipality of 14 the county. 15 Section 2. When used in this Ordinance, the following words 16 shall mean: 17 a. Board shall mean the Board of County Commissioners of 18 Indian River County, Florida. 19 b. Concealed firearms means any firearms, as defined,in 20 subsection (c) when the same is carried on or about a person in such 21 a manner as to conceal said firearm from the ordinary sight of another 22 person. 23 c. No person, except law enforcement officers as defined in Florida Statute 790.001, shall carry or have in his manual possession in Indian River County, Florida, any concealed firearm as above defined without having a license issued by the Board: Section 4. Standards: Licenses to carry firearms will be granted by the Board for a maximum of two years only to persons over the age of twenty -on-& (21) years, of good moral character, who have never been convicted of a felony or who having been convicted, have had their civil rights restored. Section 5. Bond: All applicants for a firearm license shall give a bond payable to the Governor of the State in the sum of One Hundred Dollars ($100.00) conditioned for the proper and legitimate use of said firearms, with sureties to be approved by the Board. Section 6. Application: Application for a firearm license shall be made through the Clerk of the Circuit Court in and for Indian River County on forms provided by the Clerk, which form shall include at least the name and address of the applicant, the name of the maker of the firearm licensed to be carried, the caliber and serial number of the firearm, and the reason the license is needed. Each application shall be accompanied by a written recommendation of approval signed by the Sheriff of Indian River County and, in the case of an employee, who requests a firearm license because of his employment, a written request for the license signed by the employee's employer. Section 7. Fees: A fee of $5.00 shall be paid by each applicant to the Clerk at the time of filing of the application. Said fee to be retained regardless of whether the application is approved or denied. .Said fees so collected to become part of the General Fund of the County. Section 8. The effective date of this Ordinance is December 1, 1970. - 2 N 0V 41 1970 W On the recommendation of the Administrator, Motion was made by Commissioner Massey, seconded by Commissioner Loy, and the Board unanimously voted that the bid of Florida Steel Corporation, in the bid opening of 9:00 o'clock be accepted as the lowest and best bro, subject to accordance with County specifications. The Board decided to hold approval on three Check Point Procedures received from the office of Economic Opportunity until a later date. The Administrator was requested to prepare procedures as to the replacing of -culverts under County roads as was requested by Mr. Richardson on Hearndon Road at Range Road and by Deerfield Groves on the xoad :from 'the new bridge to A 1 A. The Administrator reported he had received a call from James Beindorf on behalf of Sid Ansin asking if Vero Lakes Estates Subdivision were replatted,would the recorded subdivision'be required to conform to present subdivision regulations. The Administrator was requested to ask for a tentative plan, to mare inquiries as to which unit, and what he intends to do; at which time it will be., considered by the Zoning Board and the Board of County Commissioners. NOV zi1970 Y L On Motion of Commissioner Massey, second of Commissioner McCullers, the Board unanimously voted to grant the request of Frank Zorc that the drainage easement in Suncrest Terrace Subdivision be changed from 12 feet on either side of the centerline of the street between Lots A and 13 and the street between Lots F and 12 as shown on the plat of Suncrest Terrace Subdivision, Unit 1; to, a new easement for public utilities and drainage purposes to be 24 feet wide and lying parallel to and 7feet south of and parallel to -and 17 feet north of the north boundary line of Lot 13, also parrallel to and 7 feet south of and parallel to and 17 feet north of the north boundary line of Lot 12, as shown on the Plat of Suncroot Terrace Subdivision, Unit #1 as recorded in Plat Book 8, Public Records of Indian River County, Florida. Having received a letter from Fred Gallagher regarding the abandonment of 21st Street in E1 Vero Subdivision, and the possibility of a drainage easement to the County by Mr. Pellerin; the Administrator was requested to make inquiries as to securing drainage easements for the entire subdivision. The Board then adjourned at 12:05 o'clock P. M. and reconvened at 1:30 o'clock P. M. the same members and Vice°Chairman Bogosian being present. German D. Coast Plaza Merchants, Board of Realtors, Beach Business Bureau and other interested and concerned parties, which daily indicate that the recent opening of Interstate 95, with its attendant traffic routing around the City of Vero Beach has caused a drastic down- turn in the business of the above named groups -- all these 'tourist - oriented businesses -- said downturn amounting to a 25% to 35% decrease in business conditions in a short'24 hour period follwing said opening and routing of I-95, and has continued at this depressed level ever since, and, WHEREAS the tourist -oriented -businesses in Vero Beach and Indian River County is our second most important industry,(Citrus!'#1), and, WHEREAS the existing conditions cannot be permitted to continue without grave economic consequences in Vero Beach, and in the establishments of several effected taxpayers and Chamber members, and, WHEREAS there is no apparent reason for the re-routing of passenger traffic around Vero Beach, other than reasons unknown and, WHEREAS it appears that truck routing around Vero Beach a , without disturbing the normal flow of passenger traffic into Vero ISeaavla could be a accmoanpl.ishad by tlaca proper signing programs on State Road 600 at, and east of the terminus of I-95 and, WHEREAS this completion of the widening of State Road 60 from 1-95 tidal to Vuro bea cli is an integral p.Rr.t of the whole problem. 1 r�' NOV $j 1970 ea X . •3. 1. p a• NOW'THEREFORE BE IT RESOLVED that the'Chamber of Commerce of Vero Beach and Indian River County, does, 1) Call upon the Board of County Commissioners of Indian River County to immediately contact the Department of Transportation of the State of Florida and request that the signing for traffic be revised to route Truck Traffic Only around Vero Beach -- and the appropriate direction signs to Vero Hauch bo iiista llad for the bono- fit of passenger travelers and tourists, and remove some of the Sunshine State Parkway signs 2) Call upon said Board of County Commissioners to determine a date certain for the completion of construction of State Road 60, and further, • tha; said Board of County Commissioners us.e its full powers to insure that such construction be completed at the earliest possible date, and penalties be applied. 3) Request of the Board of County Commissioners that the economic plight of businesses in Vero Beach as the result of the signing program under- taken by the Repartment of Transportation of the State of Florida be brought to the attention of the appropriate authorities of the Department of Transportation of the State of Florida. 4) Enlist the aid of the Board of County Commissioners of Indian River County to work with the Chamber of Commerce, in carrying this debate to the highest authority in State and Federal government, if necessary, to insure the correction of this in- tolerable situation that is effecting.the welfare of its many members and the community it serves. ho v 97o ,ate. ...m.
