Home My WebLink About2010-183 " / l -7 110 $ . 3�0 a 0 / v -- / gam AMENDMENT NO . 1 TO WORK ORDER NUMBER M2 ADDITIONAL ASSISTANCE FOR THE FINAL REPORT FOR THE MAIN RELIEF CANAL POLLUTION CONTROL SYSTEM 319 GRANT CONTRACT This Amendment No . 1 to Work Order Number M2 is entered into as of this 17 day of August 2010 , pursuant to that certain Continuing Contract Agreement for Professional Services entered into as of March 15 , 2005 ( "Agreement" ) , by and between Indian River County , a political subdivision of the State of Florida ( "COUNTY" ) and Malcolm Pirnie , Inc . ( "CONSULTANT" ) . The COUNTY has selected the CONSULTANT to perform the professional services set forth on Attachment 1 , attached to this Work Order and made part hereof by this reference . The professional services will be performed by the CONSULTANT for the fee schedule set forth in Attachment 2 , attached to this Work Order and made a part hereof by this reference . The CONSULTANT wll perform the professional services within the timeframe more particularly set forth in , `tachment 3 , attached to this Work Order and made a part hereof by this reference , all i .-i accordance with the terms and provisions set forth in the Agreement . Pursuant to paragraph 1 . 4 of the Agreement , nothing contained in any Work Order shall conflict with the terms of the Agreement and the terms of the Agreement shall be deemed to be incorporated in each individual Work Order as if fully set forth herein . M2 ADDITIONAL ASSISTANCE FOR THE FINAL REPORT FOR THE MAIN RELIEF CANAL POLLUTION CONTROL SYSTEM 319 GRANT CONTRACT SCOPE OF WORK The CONSULTANT has provided the COUNTY with professional engineering services for water quality monitoring as required by a Florida Department of Environmental Protection ( FDEP ) 319 Grant Contract ( [ F] DEP Contract No . G0182 , dated April 11 , 2006 ) . The final report detail contemplated in Work Order No . M2 has been expanded by FDEP in recent telephone conversations by the COUNTY and the CONSULTANT with FDEP ' s project manager . FDEP now requires an enhanced final report discussing the following minimum topics : ® Executive Summary ® Introduction o Location ® Objective i Pollution Reduction Strategy e Project Task Summary ( surveying and modeling , QAPP , Construction Plans and Permitting , Construction , Public Involvement , Effectiveness Evaluation , and Preliminary Project Report ) ® Financial Issues ® Activities Summary ( Construction , Public Involvement , and Effectiveness Evaluation Results ) • Conclusion S Appendices for all necessary text sections The CONSULTANT shall prepare an enhanced final project report that discusses the above topics to the satisfaction of FDEP . The CONSULTANT will submit one hard copy of the draft enhanced final project report to the FDEP contract manager . M2 ADDITIONAL ASSISTANCE FOR THE FINAL REPORT FOR THE MAIN RELIEF CANAL POLLUTION CONTROL SYSTEM 319 GRANT CONTRACT 1 . COMPENSATION The COUNTY agrees to pay and the CONSULTANT agrees to accept , a not -to - exceed fee of $ 4 , 864 . 00 for services rendered according to Attachment 1 of this WORK ORDER . Hourly rates shall be as set forth in the Agreement and a breakdown of the fees is set forth below . Item Description Cost 1 . 0 Senior Project Manager — 2 hours at $ 182 . 00 $ 364 . 00 perhour 2 . 0 Design Engineer — 40 hours at $ 85 . 00 per hour $ 37400 . 00 3 . 0 Expenses ( additional reproduction and mail ) $ 1 , 100 . 00 TOTAL $ 49864 . 00 2 . PARTIAL PAYMENTS The COUNTY shall make monthly partial payments to the CONSULTANT for all authorized work pertaining directly to this project performed during the previous calendar month . The CONSULTANT shall submit invoices monthly for services performed and expenses incurred pursuant to this Agreement during the prior month . The CONSULTANT shall submit duly certified invoices in duplicate to the Director of the Public Works Department . For lump sum line items , the amount submitted shall be the prorated amount due for all work performed to date under this phase , determined by applying the percentage of the work completed as certified by the CONSULTANT , to the total due for this phase of the work . For time and material line items , the amount submitted shall be based on the actual hours worked and expenses incurred for the billing period . The amount of the partial payment due the CONSULTANT for the work performed to date under these phases shall be an amount calculated in accordance with the previous paragraph , less ten percent ( 10 % ) of the invoice amount thus determined , which shall be withheld by the COUNTY as retainage , and less previous payments . Per F . S . 218 . 74 ( 2 ) 5 the COUNTY will pay approved invoices on or before the forty-fifth day after the COUNTY receives the CONSULTANT ' s invoice . Per F . TIME FOR COMPLETION The CONSULTANT understands that time is of the essence for this Work and shall submit a draft copy of the enhanced final report to the COUNTY within two weeks of receiving the Notice -to - Proceed from the COUNTY .
