AMENDMENT NUMBER 2 TO WORK ORDER NUMBER12 This Amendment Number 2 to Work Order Number 12 is entered into as of this 1 st day of June 2010 , pursuant to that certain Continuing Contract Agreement for Professional Services entered into as of April 6 , 2004 and amended effective April 7 , 2007 (as so amended , the "Agreement") , by and between Indian River County , a political subdivision of the State of Florida (" County") and MASTELLER & MOLER , INC . (" CONSULTANT") . 1 . The County has selected the Consultant to perform the professional services set forth in existing Work Order Number 12 , Effective Date April 8 , 2008 2 . The County and the Consultant desire to amend this Work Order as set forth on Exhibit 1 attached to this Amendment and made a part hereof by this reference . The professional services will be performed by the Consultant for the fee schedule set forth in Exhibit 2 and within the timeframe more particularly set forth in Exhibit 3 , all in accordance with the terms and provisions set forth in the Agreement. 3 . From and after the Effective Date of this Amendment , the above- referenced Work Order is amended as set forth in this Amendment . Pursuant to paragraph 1 . 4 of the Agreement , nothing contained in any Work Order shall conflict with the terms of the Agreement and the terms of the Agreement shall be deemed to be incorporated in each individual Work Order as if fully set forth herein . Baird , County Administrator Approved as to form and legal sufficiency : Com,--� -�------� County Attorney Our File #0770 May 10 , 2010 NON -EXCLUSIVE PROFESSIONAL ENGINEERING AGREEMENT CONTINUING CONSULTING SERVICES AMENDMENT #2 TO WO #12 " EXHIBIT 1 " Work Authorization # 12 , which was approved by the Board of County Commissioners , includes Engineering Services in connection with the design and construction of 3 . 0 million gallon reuse water ground storage tank and related pump station to facilitate reuse service to North Indian River County . Amendment # 1 was approved to authorize Engineering Services related to Reuse Water Alternative Services . IRCDUS staff, after reviewing the design of the Facility as completed under the original Work Order, has determined that additional features must be added to the design of the Facility in order to ensure a successful project . The incorporation of these additional features into the project ' s Construction Plans and Specifications shall require additional professional services not included in the original contract . This Amendment #2 is therefore presented to include tasks for additional professional services necessary to support remote Facility monitoring and control functions , pump station control panel upgrades , and security fencing . A brief description of the scope of services and deliverables for Work Authorization # 12 , Amendment #2 is provided below: Scope of Services I . DESIGN SERVICES Task A — Pumping and Storage Systems — Task I (A) shall be revised to include design services for the following additional features : 1 . Conduit System - It is understood the County desires to provide for Remote Facility Monitoring and Control of the pump station . In order to support that system , we shall modify our Construction Plans to illustrate the design of a 2" - inch diameter conduit from the proposed pump station to the north side of the existing Parks and Recreation building between the Facility and the Lateral G Canal . The conduit is intended to support installation of a fiber-optic cable between these two locations . The design of the conduit shall be coordinated with the IRC Telecommunications Division . It is understood that the IRC Telecommunications Division shall select and install the fiber optic cable including providing the appropriate terminations in the proposed pump station building and at the existing fiber optic panel on the Parks and Recreation Site . The conduit and fiber-optic cable installation will support the ability for the County to remotely monitor and operate the pump station . The coordination and preparation of any specifications for the programming , hardware and software modifications shall be completed by the County . AMENDMENT #2 TO EXHIBIT # 1 5/ 10/2010 Page 2 2 . NEMA 3 Control Panel — We shall modify the Construction Plans and specifications to require NEMA 3 control panels in the pump station building to provide additional water intrusion protection over the NEMA 1 panels originally specified . 11 . LAND SURVEY SERVICES In order to support the design of the fiber-optic conduit described in Task I (A) , above , Task II of the original work order shall be revised to include a limited topographic survey of the Parks and Recreation site . The survey shall illustrate the existing building and other features along the proposed route of the conduit . The survey data collected as part of this task shall be incorporated into the survey performed as part of the original scope of services . III . SITE PLAN PERMITTING SERVICES ( NORTH PLANT SITE ) ( No additional services proposed . ) IV. CONSTRUCTION SERVICES ( NORTH PLANT SITE ) The scope of services described in Task IV of the original work order will be expanded by construction of the additional features described in Task I (A) , above . This task is therefore revised to include the additional construction services required .
