The Board of County Commissioners of Indian River, County,
Florida met in regular session at the Courthouse, Vero Beach,
Florida on Wednesday, December 23, 1970 at 8:30 o'clock A. M.
Present were -Jack U. Dritenbas, Chairman; Richard P. Bogosian,
Vice Chairman; D. B, McCullers, Jr.; Alma Lee Loy and Edward
J..Massey" Also present:.were Jack G. Jennings, County Administrator;
Paul D. Burch, Attorney to the Board of County Commissioners; James.
Reams, Deputy Sheriff; and Alfred H. Webber, Ralph H. Stewart and.
Janet N. Turpan, Deputy Clerks.
The Chairman called the meeting to order and asked if there
r ' were any additions or corrections to the minutes of the regular
meeting of December 9. Commissioner Loy requested that on Page 7,
in the first paragraph the words "Indian River Mental Staff" should
be changed to read"Indian River.Memorial Hospital". This correction
I; having been made, Motion was made by Commissioner Loy, second by
+ Commissioner Massey and the Board unanimously ly approved the minutes

of the regular meeting of December 9, 1970, as corrected.
Dewey Walker, County Zoning Inspector, reported on zoning
violations;and presented pictures of dilapidated houses in the County.
!` On Motion of Commissioner Bogosian, second of Commissioner
" McCullers, advertisement for public hearing for a zoning change, as
requested by Sam Tillis, Was unanimously approved.
On Motion of Commissioner McCullers, second of Commissioner
Bogosian, the request of Mr. Reed to move a building to rep�ace one
which was to be demolished, was unanimously approved.
A letter was received from Mrs. Van Busch, giving approval to
burn down a building on her property on King's Highwa
Raymond Kupper, Realtor for Shelly Glass Company, appeared and
offered property located at 23rd Street and 14th Avenue for sale to
the County at a cost of $22,000.00. No action was taken by the Board.
Ralph Sexton, Indian River County Zoning Commissioner appeared
before the Board and presented the new proposed zoning ordinance,:On Motion

of Commissioner McCullers, second of Commissioner Loy, the Board
accepted the zoning ordinance and authorized advertisement for
public hearing before the Zoning Commission. Mr. Sexton w4s
commended for the fine work done by the Zoning Commission.

The Chairman then asked for receipt of Bids in accordance w`' e
Notice, and the following sealed bids were received, opened and

The bids were then referred to the Administrator for evaluation.
Valentyne Brennan appeared before the Board and recommended
participation in a water quality study to be made by the United
State6 Geological Survey Office offered through the Florida East
Central Regional Planning Council. Motion was made by Commissioner
Bogosian, seconded by Commissioner Massey, that the Board participate,
in the study and that the Clerk be authorized to pay $1,230.00 and Ir
request the City of Vero Beach to reimburse the County in the amount
of $615.00. Commissioner McCullers voted against the Motion and
Commissioner Loy voted for the Motion; and the Motion was carried.

On Motion of Commissioner Bogosian, second of Commissioner
McCullers, the Board unanimously voted that the Administrator be
authorized to notify the Trustees of 'the Internal Improvement Fund
and the Corp of Engineers that this Board has no objection to the
submarine cable to be laid across the'Indian River at the Wabasso
Bridge.

On Motion of Commissioner Bogosian, second of Commissioner Loy,
the Board unanimously voted that the bid of Monroe for electric
printing calculator in the amounty of $1,195.00 be accepted.
The Chairman signed the authorization from the Department of
Health -and Rehabilitive Services, Child Welfare, for a refund of
of $141303.57.
On Motion of Commissioner Bogosian, second of Commissioner
McCullers, the Board unanimously voted to acceptthe bid of Shelly
Tractor and Equipment Company in the amount of $1,046.75 for the
dragline bucket bid in the bid opening of 9:30 o'clock.

On Motion of Commissioner Bogosian, second of Commissioner Loy,
the Board unanimously voted that the County Administrator be
authorized to prepare and attain the proper description fdr the
drainage easements in Pompey Subdivision; subject to the release of
the easements to the County that the Administrator, be authorized to
construct drainage ditches on the easement,
The Administrator was requested to return a bill to the
Netto Construction Company for work -on the Annex roof as it has
leaked since the day.Netto Construction finished construction work om it.
The Administrator was requested to research the conditions
surrounding the zoning change made for W. J. Roschach for the
construction of 13 apartment buildings at 6th Avenue and 16th Street,
and report his findings to the Board, so that a reasonable time
limit may be established as requested by Mr. Roschach.

A request was received from State Representative Eugene Tubbs
requesting,a list of the Indian -River County Board of County
Commissioners and of the elected officials as well as copies of

the Board's minutes.
A letter was received from William Walling of Tropicolony
Subdivision requesting a light at 19th Street and 43rd Avenue.
On Motion of Commissioner Masse
y, second of Commissioner
McCullers, the Board unanimously voted that the Ordinance for
removal of dilapidated buildings in the County be advertised for'
public hearing.
The Attorney reported that the Wabasso Teenage Club is now
incorporated.'
No action was taken by the Board on the offer of David Langfitt
'.for sale -of the property at 21st Street and 15th Avenue to the County.
On Motion of Commissioner Bogosian, second of Commissioner
McCullers, the Board unanimously authorized the Administrator to
advertise for bids for the purchase of a vibratory compacter at a
cost of approximately $700.00, of a disc harrow at a cost of approximately
$500.00 and of a bush hog at a cost of approximately $437.00.

ROBERT R. DUERDEN AND NELLE E. DUERDEN, His wife and
GLADYS B. YERG, a single woman
as the second parties.
WITNESSETH: That the party of the first part, in consid-
eration of the sum of One Dollar and other valuable consid-
erations, does hereby release unto the parties of the second'
part, their heirs and assigns forever, that part of a Drain-
age Easement recorded in Official Record Book 224, page 193,
Public Records of Indian River County, Florida, described as
follows;

On Motion of Commissioner Massey, second of Commissioner
McCullers, the out of County travel of Forrest McCullers, County
Agricultural Extension Agent to Bartow on January 5 through 7 to
attend Extension Worker's School was unanimously approved.
On Motion of Commissioner Bogosian, second of -Commissioner
McCullers, the State Witness Payroll of the County Court, November
1970 Term in the amount of 5202.88; the State Witness Payroll of
the County Court, November Term 1970 in the amount of $214.20
were unanimously approved.
,. On Motion of Commissioner McCullers, second of Commissioner
Massey, the Board unanimously approved the renewal of permits for
carrying firearms for C. Reed Knight, Charles K. Lyle, Kip Wagner,
M. -,N. Hargett, Philip J. Arnold and Donald D. Rossko.
The Sheriff filed with the Board a statement of his appointment
of -Harry Albert Via whose voting precinct is 4B, and the continuation
appointment of William D. Gatling, as Deputy Sheriffs and the said
Deputy Sheriffs filed their bonds with the Clerk of the Circuit Court,.
which ween presented to the Board. On a Motion'made by Commissioner
Loy, second by Commissioner Masse and unanimously carried, the
bonds of said Deputy Sheriffs were approved and ordered filed with the
.Clerk of the Circuit Court.
Commissioner Loy presented a proposed list of County Employee
" Holidays to'the Administrator who was requested to contact the
Fee Offices in regard tolsame.
On Motion made by -Commissioner Massey, seconded by Commissioner
McCullers, the Administrator was unanimously authorized to release
the performance bond on Moorings Subdivision, Unit #1, providing
it meets requirements.

The County Commissioners conducted their quarter -annual
inspection of the offices and records of the County Judge, Sheriff
and Clerk of the Circuit Court and other officers of this County to
see that the laws prescribing and regulating the duties of said
officers were being fully complied with and they did not find
any failure on the part of such officers to perform their duties.
The several bills and -accounts against the County having been
audited, were examined and found to be correct were approved and
warrants issued in settlement of same as follows: General Fund,
Nos. 1933 to 1978 inclusive; Road and Bridge Fund, Nos. 998 to 1026
inclusive; Fine and Forfeiture Fund, Nos. 324 to 332 inclusive;
Capital Outlay Fund, No. 162. Such bills and accounts being on file
s in the office of the Clerk of the Circuit Court, the warrants so
issued from the respective funds being listed in the Supplemental
Minute Book as provided by the rules of the Legislative Auditor,
reference to such record and list.so recorded being made a part of
these minutes.
{ There being no further business, on.Motion made, seconded and
carried, the Board adjourned at 12:30 o'clock P. M.
