The Board of County Commissioners of Indian River County,
Florida met in regular session at the Courthouse, Vero Beach,
Florida on Wednesday, -February 10, 1971 at 8:30 o'clock A. M.
Present were Richard P. Bogosian, Chairman; Alma Lee Loy, Vice
Chairman; D. B. McCullers, Jr.; Jack U. I Dritenbas and Edward J.
Massey. Also present were Jack G. Jennings, County Administrator;
Paul D. Burch, Attorney to the Board of County Commissioners; James
ReaMat Deputy Sheriff; and Alfred H. Webber, Ralph H. Stewart and
Janet N. Turpan, Deputy Clerks.
The chairman called the meeting to order and asked if there
were any additions or corrections to the Minutes of January 20.
Commissioner Loy requested that Paragraph 4, Page 1 should be
reworded to clarify the contents of the letter to Mr. Grimm.
This correction having been made, Motion was made by Commissioner
ba s,, second- by- -Commis-s-i-one-r- Loy --and- the minutes of.the regular
meeting of January 20 were unanimously approved as corrected.
Dewey Walker, County Zoning Inspector, reported on violations.
Attorney Paul D. Burch reported that a Motion has been -filed in
Circuit Court against John Pierson.
David Calhoun and Frank Brumley appeared in regard to moving
a house from an agricultural district to South Winter Beach Road
at a point between Lateral A and King's Highway. Motion was made
by Commissioner McCullers, second by Commissioner Massey, and the
Board unanimously voted that the request be granted providing that
the building passes the building inspection and is brought up to
specifications.

The Deputy Clerk announced that all items must be removed from
County property within 10 days or the County will dispose of the
itemdby private negotiation. He also announced that any scrap or
articles within or on the vehicles were not included as a part of
the vehicle unless it could be ascertained that it had once been
a part of the vehicle.

On Motion of Commissioner McCullers, second of Commissioner Loy,
the Board unanimously authorized advertisement for public hearing
for zoning change for a mobile home park unit in the Gifford area
.from M-1 to industrial as requested by Wellford Hardee.
On Motion of Commissioner Loy, second of Commissioner McCullers,
it was unanimously carried that this Board has no objections to the,
sale of filled land as requested by the Bosworth Estate, through the
Trustees of the Internal Improvement Fund.
On Motion of Commissioner McCullers, second of Commissioner
Dritenbas, the Board unanimously authorized advertisement for public
hearing before the Zoning Board for a zoning change east of 195 and
south of SR 60 from F-1 to C -1-B and C 1 as requested by Rivers
Anderson on behalf of J. Leon Knight.
John Pierson appeared before the 0 Board requesting that additional
time be given him for removing junk from his property. Mr. Pierson
also requested that a Committee be formed to observe his problem.
No action was taken by the Board.
On Motion of Commissioner Massey; second of Commissioner McCullers,
the Board unanimously authorized public hearing for abandonment of
Gloria Avenue, Palm Avenue and Palmetto Place as shown on plat of

Gloria Gardens Subdivision.

appeared and said that this subject was also being considered by the
City Council. Motion was made by Commissioner Dritenbas, second by
Commissioner Loy, and the Board unanimously voted the continuation of
the public hearing to the next meeting of February 24, in order that
it may be given further consideration.

The foregoing letter having been received, Motion was made by
Commissioner Dritenbas, second by Commissioner Massey, and unanimously
carried that this Board accepts the resignation of Fred Prestin.as
Civil Defense Director with reluctance and commends Mr. Prestin on
the excellent performance of his duties as Civil Defense Director.

Upon Motion by Commissioner Loy, second by Commissioner Massey,
the.,Board unanimously voted to notify the public that applications
for Civil Defense Director will be accepted until March 8, 1971;
and that qualifications will be available in the Clerk's office.
Motion was made by Commissioner Massey, seconded by Commissioner
Loy and unanimously carried that the Administrator be directed to
write a letter of commendation to Fred Prestin for:the excellent
performance of his duties as Civil Defense Director.
Mrs. Ammons, appearing in quest of the use of Pleasant Ridge
School, was told to continue working on plans for the usage of the
School, and the Board deferred action for another two weeks.
Reverend Farr, appearing in behalf of the Ministerial Association
presented the following Resolution:
R E S O L U T I O N
The Ministerial Association of Indian River County, Florida
believes that in order to promote the spiritual growth of the
community it is necessary to look to the underlying conditions
whi ch„`hsvn_ to-do, idt#- tho "dignity- of man: and- the . iir- which man
lives, and particulariy the root causes of crime and delinquency,
many of which stem from the common enemies of mankind: disease,
poverty and indifference by man as to the conditions under which his
fellowman lives.
One of the problems with which this Association has been concerned
is the question of housing. An investigation has.disclosed that there
are many people living in Indian River County, in sub -standard homes,
which in turn reflect upon the standards of, children that are raised
In such surroundings, and reflect back to delinquency and crime; and,
that there is also a scarcity of homes in which people in the lower
income groups can live commensurate with their incomes, and that,
therefore, there is a demanding need for.something to be done to
correct these conditions, so as to bring about a better standard of
living for our people which not only will be toward their spiritual
growth, and uplifting, but will also be for the economic growth and
expansion of the community.
It has long been said that what is everybody's business is
nobody's business. It is, therefore, the belief of this Association
that immediate action should be taken to establish a housing
authority in the City of Vero Beach and also in Indian River County,
which authority when established would be charged with the respon-
sibility of moving forward in the housing field to correct the
deficiencies which we have enumerated.
THEREFORE, BE IT RESOLVED BY THE MINISTERIAL ASSOCIATION OF
INDIAN RIVER COUNTY, FLORIDA, in regular meeting assembled, that we do
respectfully request and urge the City Council of the City of Vero
Beach and the Board of County Commissioners of Indian River County,
without further delay, to take the steps necessary to establish
within their respective jurisdictions, a housing authority under the
provisions of Chapter 421 of the Laws of Florida.

when created, the full support of this Association in its endeavors.
The above resolution was passed by unanimous vote by the INDIAN
RIVER COUNTY MINISTERIAL ASSOCIATION in a regular meeting on Tuesday,
February 2, 1971 --
Reverends Renner and Wehrman and Pastor Jensen also spoke in favor
of the Resolution. Chairman Bogosian appointed a Committee of
Commissioner Dritenbas and Commissioner McCullers to work with the
Ministerial Association and the Attorney to report to the Board
at the next regular meeting.
Sam Joyce, Sheriff, appeared before the Board in regard to
a meeting with the Committee, which hall been formed to research
the building of an addition to the Jail.

Dear Governor Askew:.
I have your letters dated January 28 and February 8, 1971, regarding
complaints you received about the Indian River County Jail from
James E. Branch, Jean Fullwood and Virginia Crews. On Wednesday,
February 9, the Board of County Commissioners met in regular
session during which the conditions and operation of the County Jail

this meeting the.,Board authorized me to send this letter to you and
to advise you that our investigation has disclosed no improper
conditions at the jail.
As a practicing attorney and as the 'Chairman of the Board, I frequently
go to the County Jail and have the opportunity to observe its facilities
and operation. Frankly, my evaluation of the Jail and the treatment of
the prisoners establishes it as one of the best in the State and I am
confident that your investigation of this matter has confirmed my opinion.
The Board has always had considerable pride in the Jail, and these are
the first complaints received by the Board during the past five years.
As you know, the Jail is inspected monthly by the Florida Division of
Correction and the Board receives a copy of the report each month.
The Jail' is always rated either excellent or very good and there is never
a violation of any rule or regulation covering jails. I am enclosing copies
of recent inspection reports for your review.
The policy of the Sheriff is that the Jail is always open at reasonable
times for inspection by the public or any other interested party. The
Board wishes to. maintain the best facilities and conditions possible at
the County Jail and I would appreciate receiving any recommendations
you might have for improvement.

On Motion of Commissioner Loy, second of Commissioner Massey,
the Board unanimously voted approval for advertisement for bids,

the possibility of erecting a tower on the Fire Fighting Training
Grounds, and requested the County to cooperate in clearing trees
from the area. on Motion of Commissioner Loy, second of Commissioner
Massey, the Board unanimously voted to authorize the Administrator
to cooperate with the Fire Chief in developing the Training Area.
The Administrator reported that he had recieved phone calls
from Harry Butler and Doug Strickland who reported that the boat ramp
at the Sebastian Inland Park would be in a useable condition in ten
or fifteen days.
A report was received from Arnold Raxras, State Department of
Transportation, that the intersection at U. S. #1 and S. R. 510

of the Big "I" Insurance Agents, the Attorney write a letter to the
State Insurance Commissioner requesting a public hearing in order to

qualify for Windstorm Pool Insurance for the Beach Area.

Commissioner Dritenbas moved that the County partake in additional
insurance covering break -downs on certain County Property such as:

generators, steam -jennies and the central air-conditioning units, and
other such units as are; involved with steam and water; of which the

policy is to include quarterly inspections of all these units at a
cost of approximately $900.00 per annum. Commissioner Loy seconded

the Motion and Commissioners McCullers and Massey voted against the
Motion. Whereupon,Chairman Bogosian voted for the Motion -and the

On Motion of Commissioner Massey, second of Commissioner
Dritenbas, the Board unanimously voted that the scrap in the bid
opening of 9:00 o'clock A. M. be awarded to the highest bidder
of each individual item.
On Motion of Commissioner Massey, second of Commissioner
McCullers, the Board unanimously moved that the Clerk purge the
inventory records of all surplus material disposed of as a result
of this bid opening.
The Administrator reported that a letter had been received from
Arnold Ramos requesting that permits for fti'ture curb cuts be forwarded
to the Department of Transportation; and that those cuts should be
associated with building permits and subdivision regulations.
On .Notion of'Commi"ssioner Dritenbas, second of Commissioner Loy,
the Board unanimously approved authorization for the Administrator
to advertise for bids for electrical wiring for the addition to the
building of the County Garage.
A letter was received from W. T. Carlton regarding a $10,000.00
Beach Erosion Study by the State in Indian River County which may
lead into a grant of $40,000.00. That the Department of the Army is
to have a public hearing here regarding the Study on the 12th of
March at 10:00 o'clock.
On Motion of Commissioner Loy, second of Commissioner Massey,
the Board unanimously voted that the Administrator proceed with
the installation of the side walks to Middle School #6 .at a cost of
approximately $2,600.00 or $2,700.00.
On Motion of Commissioner McCullers, second of Commissioner
Massey, the Board unanimously moved approval for advertisement for
public hearing on the Ordinance for tie down of mobile homes.

The Attorney to the Board reported that public hearing for
abandonment of a County road right-of-way on the new Hibiscus
Airport is scheduled for 10:00 o'clock A. M. on February 24.
The Attorney was requested to obtain an Attorney General's
Opinion on sick leave pay for Road and Bridge Department Employees.
Motion was made by Commissioner Dritenbas, second by Commissioner
Loy, and the Board unanimously voted that the Attorney make application
to the Farmers' Home Administration for the water and sewer study.
C. E. Yoder, appearing on a ownership_ problem, was referred to
private legal counsel.
On Motion of Commissioner Massey, secofid of Commissioner Loy,
the following Resolution was unanimously adopted:

The Board of County Commissioners of Indian River County, Florida,
resolves:
1. Under date of January 20, 1969, The Moorings Development
Company, a Florida corporation, did enter into a performance bond as princi-
pal in which it bound itself unto Indian River County, Florida, a political sub-
division of the State of Florida, in the sum of $230, 000.00 in connection with
that principal having submitted to the Board of County Commissioners cif
Indian River County, Florida, for approval a plat of a subdivision known as
The Moorings, Unit One, which was to be recorded as provided by Chapter
29155, Laws of Florida, Acts of 1953, and as provided by the Subdivision
Resolution of Indian River County, Florida, and which said plat was subse-
quently recorded in the office of the Clerk of the Circuit Court of Indian River
County, Florida, in Plat Book 8, page 6.
2. Said bond was conditioned upon the completion and installation of
all of the improvements shown upon the preliminary plat or required pursuant
to the Subdivision Resolution and in lieu of its execution by a surety company
the principal did deposit the total amount of money in cash with the above
Clerk and in reliance thereon said board approved said plat for recording.
3. All of the conditions of said performance bond have been kept and
completed and the County Administrator has certified to said Clerk that all of
the improvements have been constructed on the land and the balance of the
cash deposit has been returned by the Clerk to the principal, whereupon in
accordance with the terms and conditions of the bond, the same has become
null and void, however, in view of the fact that said bond has been recorded in
the office of said Clerk in Official Record Book 308, page 390, it is necessary
that evidence of the full and complete compliance with the terms of said bond
be evidenced by Resolution of this board. This board does herewith find and
determine that said bond and the obligation created thereby has become null
and void and does herewith direct that a certified copy of this Resolution evi-
dencing such fact shall be recorded in the public records of Indian River
County,- Florida.

the following Resolution was unanimously adopted:
RESOLUTION 71-7
WHEREAS, the Indian River County Board of Commissioners has
through local gifts, public funds and through agreements with the
Florida Outdoor Recreation.Council has acquired 489+ acres in what
is now known as Kiwanis-Hobart Park, and
WHEREAS, the Indian River County Board of Commissioners with
the assistance of Mr. Edward Hobart and the Kiwanis Club of Vero
Beach has expended funds for development of a portion of this park,
and
WHEREAS, the Indian River County Board of Commissioners recog-
nize the need to further develop another portion of this park in
keeping with a general development plan for the entire park,
NOW THEREFORE BE IT RESOLVED that the Board of County Commissioners
does hereby endorse the further development of this park in the total
amount of fifty thousand ($50,000) dollars in.accordance with the terms
of the attached agreement.

The Annual Report of the Humane Society of Vero Beach for the
period Y,eg nrrin Ja rary 1, 19-70 and ending, December- 31, 1970; and
the Annual Report of the.Flood Control District for the period
