Pagcy 1 caf 12iU7r20 I I at O3 :40 Plbl JEFFREY K O K 13ARTON, CI_ ERF NOTICE OF GRANT REQUIREMENTS c . � 't)RI ( " Padgett Creek Match Tract" ) Indian River County, a political subdivision of the State of Florida (the "County" ), holds a Deed of Conservation Easement ( the " Easement" ) , recorded in Official Record Book 2229, Page 656, of the Public Records of Indian River County, Florida , on certain parcels of land in Indian River County, described in attached Exhibit A . The Conservation Fund entered into grant agreement number VA- 1\17816, dated April 21, 2010, for the "St . Johns River Headwaters Project — Phase I " (the "Grant" ) for land acquisition under the authority of the North American Wetlands Conservation Act ( 16 USC 64 ) with the United States of America , acting by and through the United States Fish and Wildlife Service (the "Service " ) . The agreement is on file with the United States Fish and Wildlife Service, Division of Bird Habitat Conservation , 1849 C Street, NW, Washington , DC 20240 . The purpose of the Grant is to acquire habitat for wetlands- dependent migratory birds . Notice is hereby given that the County approved the use of the Easement as a match for the Grant . Federal regulations require the Easement be used for the purpose of the Grant and restrict the County from disposing of the Easement or encumbering its title . The County' s interest in the Easement shall be administered in accordance with the terms, conditions and purposes of the Grant . The County' s interest in the Easement, or any portion of the County' s interest in the Easement, may not be sold , transferred , pledged, or otherwise disposed of or further encumbered without obtaining approval of the Service, its designee, or successor . This restriction has the effect of a covenant running with the land and is binding upon the County, its designee, or successor .
