HomeMy WebLinkAbout2010-153A! 91 t a i i WHEREAS, Pointe West of Vero Beach, Ltd., a Florida limited partnership, and The Links at Pointe West, L.L.C., a Florida limited liability company, the owners of property known as Pointe West East Village Phase 1 P.D., as recorded in Plat Book 22, Page 59, Public Records of Indian River County, Florida, imposed a Covenant to Defer Maintenance Security for Development affecting certain property within the subdivision which was recorded in Official Record Book 2326, Page 256 of the Public Records of Indian River County, Florida; and WHEREAS, the owners have now requested the Board of County Commissioners release certain property depicted on the attached Exhibit "A" from the Covenant to Defer Maintenance Security for Development recorded in Official Record Book 2326, Page 256, and in consideration thereof, the owners have posted the appropriate security to warranty the road and drainage improvements against defects in materials and workmanship for a 1 -year period; and WHEREAS, the release from said Covenant to Defer Maintenance Security for Development over the property described in Official Record Book 2326, Page 256 requires the approval in writing by the Board of County Commissioners of Indian River County by recorded document; NOW, THEREFORE, by this instrument the Board of County Commissioners of Indian River County releases the property depicted on the attached Exhibit "A" from the Covenant to Defer Maintenance Security for Development recorded in O.R. Book 2326, Page 256, Public Records of Indian River County, Florida, with the remainder of the property continuing to be under the Covenant to Defer Maintenance Security for Development, recorded in Book 2326, Page 256 of the Public Records of Indian River County, Florida.
