The Board of County Commissioners of Indian River
County, Florida met in regular session at the Courthouse, Vero i
Beach, Florida on Wednesday, June 23, 1971 at 8:30 o'clock A. M.
Present were Richard P. Bogosian, Chairman; Alma Lee Loy, Vice

Chairman; D. B. McCullers, Jr.; Jack U. Dritenbas and Edward J.
Massey. Also present were Jack G. Jennings, County Administrator;
George Collins, Acting Attorney to the Board of County Commissioners;
James Reams, Deputy Sheriff; and L. S. Thomas, Jr. and Janet N.
Turpan, Deputy Clerks. Absent was Paul D. Burch, Attorney to the +
Board.
The Chairman called the meeting to order and recognized
Marvin Carter, representing James Karish and Mrs. Karish in regard to r +
Jungle g Cove Subdivision. The County Administrator presented a tentative
plat of a Subdivision known as Jungle Cove Subdivision and recommended
its tentative approval as meeting County Subdivision Requirements.
Upon a Motion made by Commissioner Massey, seconded by Commissioner
McCullers and unanimously carried the recommended tentative approval
was given for Jungle Cove Subdivision with the provision that the

maintained by the County and subject to approval by the Zoning.

The Chairman then - called for receipt of bids in accordance with the
Notice and the'following sealed bids were received, opened and read:

On Motion of Commissioner McCullers, second of Commissioner Loy,
the Board unanimously moved that the Administrator -take the bids for
evaluation.
S. P. Musick appeared before the Board in regard to
Indian River Aerodrome Subdivision. The County Administrator presented
a tentative plat of a Subdivision known as Indian River Aerodrome
Subdivision and recommended its tentative approval as meeting County
Subdivision Requirements. Upon a Motion made by Commissioner McCullers,
seconded by Commissioner Dritenbas and unanimously carried the
recommended tentative approval was given for Indian River Aerodrome
Subdivision with the provision that all work be done in accordance

ith County Subdivision Regulations.
On Motion of Commissioner Loy, second of Commissioner
[asset', the Board unanimously voted that the foregoing Motion be
Lmended to read'provided that the plat of the,Indian River Aerodrome
;ubdivision be taken to the Zoning Board for review.,
Commissioner Dritenbas then left the meeting.
Wallace McCormick, representative of Farmers Mme
Administration appeared in regard to Low's Park Subdivision. The
County Administrator presented a tentative plat of a Subdivision
known as Low's Park Subdivision and recommended its tentative approval
as meeting County Subdivision Requirements. Upon a Motion made by
Commissioner Massey,ssconJed by Commissioner Loy and unanimously carried
the recommended tentative approval was given for Low's Park Subdivision,
with the provision that pumps and equipment used for drainage purposes
be maintained by the residents of the subdivision. Commissioner
Dritenbas, being absent, did not vote.
On Motion of Commissioner Loy, second of Commissioner
Massey, the Board unanimously accepted the bid of Major Electrical
Supplies, Incorporated in the amount of $2,400.00 in the bid opening
of 9:30. Commissioner Dritenbas, being absent, did not vote.
On Motion of Commissioner McCullers, second of Commissioner
Loy, the Board unanimously denied the request of H. B. Barrett,
Department of Natural Resources for the County to grade the Sebastian
Inlet Road. Commissioner Dritenbas,.being absent, did not vote.
On Motion of Commissioner Massey, second of Commissioner
McCullers, the Board unanimously granted the following Petition and
adopted the following Resolution: Commissioner Dritenbas, being absent,
did not vote.

PETITION TO VACATE EASEMENT
Comes now CURTIS T. STONE and LOUISE W. STONE, his wife, by and
through the' undersigned attorney, and respectfully Petition the Board of County
Commissioners of Indian River County, Florida, as follows:
1. That they are the owners of the following described property, located
in Indian River County, Florida, to -wit:
Lot 1 and Lot 1A, Block D, Oslo Park, Unit #2 Subdivision, a
subdivision of Indian River County, Florida, as recorded in
Plat Book 4, page 13, Indian River County public records; said
land lying and being in Indian River .County, Florida.
2. That the plat of said lands duly recorded in the public records of Indian
River County, Florida, in Plat Book 4, page 13, shows the dedication of a 10 foot
public.utility and drainage easement on the rear lot lines and a 5 foot public utility
and drainage easement. on the side lot lines.
3. That Monte Mann and Donna L. Mann, his wife, are in the process of
purchasing the home located on the above-described property, from your Petitioners,
and that said purchasers are in the process of securing a mortgage from. Security
Federal Savings and Loan Association of Indian River County, which mortgage
- property, and the proceeds therefrom are to be used

as part of the purchase price in accordance with the purchase contract between the
parties. That before the said mortgage loan can be consummated, it has been re-
quired by Security Federal Savings and Loan Association of Indian River County
that whatever easement exists on either side of the common boundary line between
Lot 1 and Lot 1A, Block D, Oslo Park, Unit #2 Subdivision, above described,

4. That the vacation of the said easement will not adversely affect the sur-
rounding lands and will not affect the ownership of persons owning other parts of
said subdivision.
S. That all state and county taxes on the said land have been fully paid through
the year 1970.

RESOLUTION 71-37
WHEREAS, under Chapter 57-1412, Special Acts of 1957, the Board of
County Commissioners of Indian River County, Florida, was duly authorized
and empowered by Resolution adopted without publication, to vacate and abandon
and relinquish and disclaim the rights of the public acquired by dedication or
otherwise, of any and all rights-of-way, easements, or alleys either conveyed
to the said county or dedicated by plat or deed recorded in said county; and
WHEREAS, CURTIS T. STONE and LOUISE W. STONE, his wife, as the
fee simple title owner, for the benefit of Monte Mann and Donna L. Mann, his ,
wife, as purchasers, have duly petitioned the .Board of County Commissioners ►
of Indian River County, Florida, to vacate and abandon and relinquish and disclaim
all the rights of the public acquired by the dedication of the 10 foot public utility
and drainage easement on the rear lot lines and the 5 foot public utility and drain- i

On Motion of Commissioner McCullers, second of
Commissioner Massey, the Board unanimously expressed no objections
to a request for dredging permit by the Sebastian Inlet Commission
provided the dredging is done in accordance with Governmental
Regulations. Commissioner Dritenbas, being absent, did not vote.
Upon a Motion by Commissioner Loy, second by Commissioner
McCullers, the Board unanimously adopted the following Resolution:

RESOLUTION NO. 71-38
WHEREAS, the STATE OF FLORIDA has recently purchased certain
lands on the ocean South of the Sebastian Inlet from RONALD H. CHENOWETH
and MARCELLA E. CHENOWETH for the purpose of creating a state park,

which is'a recreational purpose, and
WHEREAS, for the year 1970, county taxes on said lands have not been
paid but there are taxes due on said property from the 1st day of January, 1970
through the 14th day of June, 1970, when the State of Florida took title to said
property, and
WHEREAS, the State of Florida has proffered a check for Three Hundred !
Eighty-seven and 30/100 Dollars ($387. 30) to Gene E. Morris, Tax Collector '
of Indian River County, for the taxes due on said property from January 1, 1970
through June 14, 1970, and -
WHEREAS, said property is exempt from taxation under Florida law

after June 14, 1970, -and
WHEREAS, Florida Statute 196.28 provides that the Board of County
Commissioners have the authority to cancel and discharge any delinquent or
current taxes held on lands owned by the county or state acquired by such
governmental agency for recreational or other public use,
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of. Indian River County, Florida:

1. . That, by and under the authority of Florida Statute 196.28,

taxes due after the 14th day of June, 1970 on the following described land, to

The North 200 feet of Lot 1, Less highway right-of-way as
shown in Record Book 157, Page 374, in Section 28, Town-
ship 30 South, Range 39 East, and the South 100 feet of the
North 300 feet of Lot 1, less highway right-of-way, as in
Record Book 157, Page 362, in Section 28, Township 30
South, Range 39 East and the South 100 feet of the North 300
feet of Government Lot 1 in Section 29, Township 30 South,
Range 39 East and the North 200 feet of Lot 1, less highway -
right -of -way as in Record Book 157, Page 374, in Section 29,
Township 30 South, Range 39 East, official records of Indian
River County. Said land -being held in the name of Ronald H.
and Marcella E. Chenoweth
are hereby cancelled and discharged.
2. The Tax Collector of Indian River County be and is hereby
ordered to cancel said taxes as hereinabove ordered.
3. That certified copies of this Resolution be furnished to the
Tax Collector and Tax Assessor of Indian River County and to the State of
Florida, Department of Natural Resources.

A Resolution prepared in connection with the Welfare
Department was to be taken up with the County Welfare Caseworker.
On Notion of Commissioner Loy, second of Commissioner
McCullers, the State Witness Payroll for the County Court, May Term
in the amount of $168.24 was unanimously approved. Commissioner
Dritenbas, being absent did not vote.
Commissioner McCullers reported that - the residents in
the area of a road running north from North Winter Beach Road were
desirous of closing the road because of the undesirable people who
came into the area. No action was taken by the Board.
Commissioner Dritenbas returned to the meeting.
The several bills and accounts against the County having
been audited, were examined and found to be correct were approved and
warrants issued in settlement of same as follows: General Fund, Nos.
2723 to 2769 inclusive; Road and Bridge Fund, Nos. 1423 -to 1439
inclusive; Fine and Forfeiture Fund, Nos. 4.50 to 453 inclusive. Such
bills and accounts being on file in the office of the Clerk of the
Circuit Court, the warrants so issued from the respective funds being
listed in the Supplemental Minute Book as provided by the rules of the
Legislative Auditor, reference to such record and list so recorded
being made a part of these minutes.
There being no further business, on Motion made, seconded
and carried the Board adjourned at 12:00 o'clock Noon.
