Grantor, for and in consideration of One Dollar ($ 1 .00) and other good and valuable
consideration, the receipt and sufficiency of which is hereby acknowledged, hereby grants to
Grantee, its successors and assigns, a non-exclusive, easement for pedestrian and vehicular
ingress and egress over, upon, and across the following described property located in Indian
River County, Florida:

organization , ("Grantor"), to INDIAN RIVER COUNTY , a political subdivision of the
State of Florida, its successors and assigns, ("Grantee'! :
WITNESSETH :
Grantor, for and in consideration of One Dollar ($ 1 .00) and other good and
valuable consideration, the receipt and sufficiency of which is hereby acknowledged ,
hereby grants to Grantee , its successors and assigns, a non-exclusive, easement for
pedestrian and vehicular ingress and egress over, upon, and across the following
described property located in Indian River County, Florida :
SEE EXHIBIT "A " ATTACHED HERETO AND MADE A PART HEREOF.
This corrective easement amends the language of the easement recorded in the
Official Records Book 2405 , Page 1557 of Indian River County , Florida.
WHEREAS, Grantor has acquired the property with partial funding from the
Florida Communities Trust (FCT), and the Property is subject to certain limitations
provided in the FCT Grant Award Agreement (as recorded in OR Book 1985 , Page 135
in Indian River County, Florida)(tlhe "Agreement ,") and
WHEREAS, as part and condition of the FCT fimding, the City provided and FCT
approved a Management Plan for the project site, and together with the Agreement, the
terms of which are hereby incorporated herein by reference; and
WHEREAS, FCT shall be notified of all leases, easements or other similar
documents that affect property funded by FCT; and
WHEREAS, the Agreement's restrictions on the FCT funded property are
superior to any other restrictions placed upon the property; and
WHEREAS, Grantor intends that the conservation and recreation values of the
Property be preserved and enhanced in accordance with the Management Plan, as it may
be amended from time to time only after review and approval by FCT; and
WHEREAS, All activities by the Grantor and Grantee shall be consistent with the
Agreement and Management Plan.

That portion of Tract "D" lying Southerly and Westerly of the Sebastian River
Drainage District easement as shown on map of Sebastian Highlands Unit 13 ,
recorded in Plat Book 7 , Page 82-A , Public Records of Indian River County,
Florida , less and except the South 550 feet of the above-described property .
All lying and being in Section 26, Township 31 South, Range 38 East, Indian
River County, Florida.
