HomeMy WebLinkAbout8/4/1971WEDNESDAY, AUGUST 4, 1971 The Board of County Commissioners of Indian River County, Florida met in regular session at the Courthouse, Vero Beach, Florida on Wednesday, August 4, 1971 at 8:30 o'clock A. M. Present were Richard P. Bogosian, Chairman; Alma Lee Loy, Vice Chairman; D. B. McCullers, Jr.; Jack U. Dritenbas and Edward J. Massey. Also present werel,Jack G. Jennings, County Administrator; Paul D. Burch, Attorney to the Board; James Reams, Deputy Sheriff; and L. S. Thomas, Jr. and'Janet N. Turpan, Deputy Clerks. The Chairman called the meeting to order and asked if there were any additions or corrections to the minutes of the meeting of July 21. Commissioner Loy requested that on Page 2, Paragraph 3, the words "No action was taken by the Board" be stricken and replaced by the phrase "The Board reacted favorably to the request." Commissioner Loy requested that on Page 4, Paragraph 5 "2;1"" be taken from the minutes. Commissioner Loy requested that the spelling of "Tomridge" Road be changed to "Tamrich Road". She also requested that on Page 6, Paragraph 9, the words "Tuesday, July 27" be added to the last sentence. Commissioner Dritenbas requested that on Page 4, Paragraph 8, "The matter was referred to the County Attorney for proper procedure in adding the amendments to the Building Code." be added at the end of the Paragraph. INDIAN RIVER COUNT .FLORIDA July 3% 1971. eo a 14 FaA27 AUG 4 1971 On Motion made by Commissioner Loy, seconded by Commissioner McCullers, the following Resolution was unanimously adopted: RESOLUTION NO. 71-43 WHEREAS, the County Auditor, after tentatively ascertaining the proposed fiscal policies of the Board of County Commissioners of Indian River County, Florida, for the fiscal year commencing on the lst day of October, 1971, and ending on the 30th day of September, 1972, did prepare and present to the Board of County Commissioners a tentative budget for said fiscal year for each of the funds .therein as provided by law, including all estimated receipts, taxes to be levied and balances expected to be brought forth and all estimated expenditures, reserves and balances to be carried over at the "end of the year; and, WHEREAS, this Board did receive and examine .said tentative budget for each fund and did require such changes to be made as the Board did deem necessary ,and the auditor's estimate of receipts other than taxes and of balances to be brought for- ward not having been revised, this Board did prepare a state- ment summarizing all of the tentative budgets showing for each budget in the total of all budgets the proposed tax millages, the balances, the reserves and the total of each major classification of receipts and expenditures classified according to the classi- fication of accounts prescribed by the Comptroller of the State of Florida; and,. WHEREAS, this Board did cause said summary statement to be advertised one time in a newspaper of general circulation pub- lished in Indian River County, Florida, to -wit: In the issue of July 22,1971, of the Vero Beach Press Journal, as will more fully appear by proof of publication thereof filed in the minutes of this Board; and, WHEREAS, this Board did meet at the time and place stated in said advertisement for the purpose of hearing requests and AOOA 4 PAGE 328 AUG 4 1971 complaints from the public regarding the budgets and for the purpose of holding a public hearing and making whatever revisions in the budget it may deem necessary, and all of the same having been now completed; Now, therefore, BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida, that this Board does herewith tentatively adopt the budgets for the funds of this Board for the fiscal year beginning October 1, 1971 and ending September 30, 1972, in the form as heretofore prepared and duly advertised; and, BE .IT FURTHER RESOLVED that the tentative budgets shall be filed in the office of the County Auditor as a public record and the County Auditor shall transmit forthwith to the Comptroller of the State of.Florida two copies of each of the tentative budgets as adopted, certified by the Chairman of this Board and by the County Auditor as a true and correct copy of the budget as adopted by this Board; and, BE IT FURTHER RESOLVED that said budgets as tentatively adopted by this Board shall be considered as finally adopted and as official thirty (30) days from the date the budgets are trans- mitted to the State Comptroller and no report of exceptions to the budget as filed has been made by the Comptroller or when the State Comptroller shall make a certificate upon each of such copies of.the budget attesting its approval giving the date upon which the budget shall finally become official and effective, whichever shall first occur. fto soot 14 FAGL329 AUG 4 1971 on Motion made by Commissioner Dritenbas, seconded by Commissioner Loy, the following Resolution was unanimously adopted: RESOLUTION NO. 71-44 BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida,_ that the rate of taxation necessary to meet the expenditures of the Board of County Commissioners of Indian River County, Florida, for the fiscal year ending September 30, 1972, pursuant to the budget of said Board as heretofore pub- lished and approved, is as hereinafter levied and that the tax rate as hereinafter shown and set forth be and it is hereby levied on all taxable property in Indian River County, Florida, .for the year 1971 with the rate hereinafter set out, to -wit: 1. In order to meet the estimated expenses of the General Fund, it is determined and hereby declared that a tax rate of two and fifty-six hundredths (2.56) mills upon the dollar be levied and is hereby imposed. 2 In order to meet the estimated espenses of the Road and Bridge Fund, it is determined and hereby declared that a tax rate of eighty-two hundredths (.82) mill upon the dollar be levied and is herby imposed. 3. In order to meet the estimated expenses of the Fine and Forfeiture Fund, itis.determined and hereby declared that a tax rate of two and five hundredths (2.05) mills upon the dollar be levied and is hereby. -imposed. 4. In order to provide funds to the Indian River County Public Health Unit, it is determined and hereby declared that a tax rate.of twenty-two hundredths (.22) mill upon the dollar be levied, assessed and is hereby imposed upon all property lying and being in the County of Indian River, the proceeds of which when collected shall be paid to the State Treasurer of the State of Florida for the account of the State Board of Health IMe. 1971 Health as provided by Chapter 154, Florida Statutes.' BE IT FURTHER RESOLVED that the Tax Assessor of Indian River County, Florida, be.and he is hereby directed to assess and levy all of the foregoing taxes as fixed and levied by this Board upon the taxable property in Indian River County just and due taxation. The Tax Collector of Indian River County, Florida, be and he is hereby directed to collect said taxes and pay over the same as provided by law and that a certified copy of this Resolution be furnished to the County Assessor of Taxes and County Collector of Taxes. Dewey Walker, County Zoning Inspector, reported on zoning violations and presented a list of abandoned houses in.the County in need of major repair. on Motion of Commissioner Dritenbas, second of Commissioner Loy, the Board unanimously approved advertisement for public hearing before the Zoning Board, and gave tentative approval of a zoning change from F-1 to R-1 of Jungle Cove Subdivision as requested by Michael O'Haire in behalf of James Karish. Upon a Motion made by Commissioner Loy, seconded by Commissioner Dritenbas, the Board unanimously approved advertisement for public hearing before the Zoning Board, and gave tentative approval for a zoning change from C-1 to R-1 as requested by Will Helseth in behalf of Dr. Inga 011a Helseth. Letters were received from Duke Newcome, Wellford Hardee, and Darrell Brumley requesting that the unused portion of Lindsey Road be closed. Action by the Board was deferred until the next meeting. A Motion was made by Commissioner Loy, seconded by Commissioner Massey and unanimously carried that Commissioner Dritenbas, County Administrator, Jack G. Jennings and City -County Planning Director, Valentyne E. Brennan be appointed to the special joint City -County Bus Study Committee.. Motion was.made by Commissioner McCullers, seconded by Commissioner Loy and unanimously carried that Civil Defense Director, Jay A. Smith be authorized to purchase an antenna rotator at a cost of $50.00 The hour of 9:30 o'clock A. That it is the owner of the following described property: All of WYN COVE, according to plat filed in the office of the Clerk of the Circuit Court of Indian River County, Florida, in Plat Book 4, page 61; LESS AND EXCEPTING, however, the following described property: Lots 14 and 18 and that part of Parcel "A" as described in Official Record Book 154, page 399, public records of Indian River County, Florida; said land lying and being in Indian River County, Florida. 2. They were informed that most of the trees were on Ben Bailey's property and that the Board has no jurisdiction to cut down trees on private property. On Motion of Commissioner McCullers, second of Commissioner Loy, the following Resolution was unanimously adopted: RESOLUTION NO. 71-45 ' WHEREAS, the Board of County Commissioners of Indian River County is authorized, under the provisions of Section 336.59 of the Florida Statutes, to levy an annual tax; for road and bridge purposes; and WHEREAS, under the provisions of said Section 336. 59 of the Florida Statutes, it is provided that one-half of the amount realized from such special tax on property within the City Limits of Indian River Shores shall be turned over to said City to be used solely for the purpose of maintaining and repairing the roads and streets of said City; and WHEREAS, the Board of County Commissioners of Indian River County, Florida, and the City Council of the City of Indian River Shores, have agreed on an accounting for the taxes collected within the City Limits of the City of Indian River Shores, from January 1,_ 1959 to May 17, 1971, under the .provisions of Section 336.59 of the Florida Statutes, and WHEREAS, the Board of County Commissioners of Indian River County and the City Council of the City. of Indian River Shores have mutually agreed to the following payment schedule for payment of funds owed by the County to the City, to be paid immediately. - $8, 460. 39, 1972 - $5,,000.-00, 1973 - $5, 000. 00 and 1974 $5, 000. 00, which amounts the Board of County Commissioners will budget in the future, and WHEREAS, the City has agreed to discharge the County from any liability for Road & Bridge Funds for any amount owed prior to January 1, 1959.
