The Board of County Commissioners of Indian River
County, Florida met in regular session at the Courthouse, Vero
Beach, Florida on Wednesday, October 6, 1971 at 8:30 o'clock
A. M. Present were Richard P. Bogosian, Chairman; Alma Lee Loy,
Vice Chairman; Jack U. Dritenbas and Edward J. Massey. Absent
was D. B. McCullers, Jr. Also present were Jack G. Jennings,
County Administrator; Paul. D. Burch, Attorney to the Board; and
L. S. Thomas, Jr, and Janet N. Turpan, Deputy Clerks.
The Chairman called the meeting to order and asked if
there were any additions or corrections to the minutes of the
regular meeting- of September 22, 1971. Commissioner Loy requested
that in Paragraph 1, Page 4 correction be made of the spelling of
the word compensated; she requested that on page 14, first paragraph,
the name of the organization be changed to "Florida Department of
Natural Resources"; and that on Page 17, 3rd Paragraph the last
three words be stricken. These corrections, having been made-, Motion
was made by Commissioner Loy, second by Commissioner Massey, and
the minutes of the regular meeting of September 22 were unanimously
approved as corrected.
Dewey Walker, County zoning Inspector reported on zoning
violations.
On Motion made by Commissioner Dritenbas, seconded by
Commissioner Loy, approval was unanimously given for the site plan
to.construct a gasoline service station -west of I 95 and south of
State Road 60 as requested by B and M Construction Companyl subject
to a 75 foot set back as recommended by the Planning Director.
A Motion was made by Commissioner Loy, seconded by
Commissioner Massey and the requept.of Dave Robison, Architect for
Agricultural Center Complex for advertisement for public hearing
before the Zoning Board for a zoning change was unanimously approved.

Motion made by Commissioner Massey, seconded by
commissioner Loy, the Board unanimously authorized advertisement
for public hearing before the Zoning Board for a zoning change
as requested by Charles A. Sullivan, Attorney, on behalf of Frank
Bihari. a
The Zoning Inspector reported the cost ofproduction of
the new zoning. ordinance. Motion was made by Commissioner Loy,
seconded by Commissioner Dritenbas and unanimously carried that
the price of $1.50 per copy be established for the new Zoning Oxd'inance.
_Mayor Zimmer of Sebastian appeared and requested that
the County purchase two small fire trucks rather than one large
one. A Motion was made by Commissioner Loy, seconded by Commissioner
-Massey and unanimously carried that the Administrator be authorized
to advertise for bids on two new four wheel drive fire trucks for
the Sebastian Volunteer Fire Department.
A letter was received from Mr. Blume of the General
Development Corporation advising the'Board that they would proceed
with the work in Vero Beach Highlands, and record the plat later,
without posting performance bond. `
A Motion was made by Commissioner Loy, seconded•by
Commissioner Massey and unanimously carried that $37,598.77 deposited
with the Cbunty for performance bond on Moorings Subdivision, Unit
#2, be returned to the Moorings Development Corporation as
• recommended by the Administrator.
The Administrator reported that he has been advised by:-
the Department of Transportation that a traffic study will be taken
at the intersection of SR 5 and SR 510 to determine the need of a
flashing beacon, He also advised the Board that directional signs
will be placed at the intersection of AlA and SR 510 as soon as
installation can be made.

Upon a Motion made by Commissioner Loy, seconded by
Commissioner Dritenbas, the Board unanimously authorized travel
of Donald Macdonald to Sarasota on October 27, 28 and 29 to
attend the Marine Resources Annual Meeting of the Division of
Beaches and Shores of the Florida Board of Conservation. -•

Sam Joyce, Sheriff, appeared in regard to a letter
from the Rockridge Property owners' Association, requesting that
playing ball be banned at the Rockridge Park. The Board requested

Upon Motion made by Commissioner Dritenbas, seconded by
Commissioner Loy,'the following Resolution was unanimously adopted:
RESOLUTION NO. 71-54
WHEREAS, the Vero Beach - Indian River County Building and
Zoning Director has recommended certain changes in the Indian River
County Building Code Resolution, and
WHEREAS, the Board of County Commissioners of Indian River
are in agreement with said recommendations,
NOW, THEREFORE, BE IT RESOLVED by the Board of
County Commissioners of Indian River County that the Indian River
County Building Code Regulation is hereby amended so as to require
the following provisions:
1. All elevators installed in any structure in Indian River
County shall be a minimum 3000# elevator, having a carriage size of
five feet six inches by seven feet, and a minimum door size of three
feet six inches wide.
2. Section 902. 3, paragraph 1 of the Southern Standard Building
Code is hereby amended for use in Indian River County as follows:
Buildings exceeding one story and 50 feet in height is changed to
buildings exceeding three stories or more. The purpose of this change
is to require installation of fire fighting equipment on each floor within
reach of the most remote area of the building in accordance with
N. F. P.A. (14 - 1968 Edition).

The Chairman appointed Commissioner McCullers to represent
the Board at the Veterans' Day Celebration on October 25 at Memorial
Island.
The Administrator reported that the CBS restroom at
Wabasso Beach Park was actually located on property belonging to
Hilda B. Wason. The Administrator was requested to contact Thomas
H. Thurlow, representing Hilda B. Wason, to inquire if they would
be willing to sell a portion of therproperty.

Our marine biologist, Gerald Iierting, has inspected the subject
area and reports as follows:

River near Sebastian Inlet. Bottoms in the
subject area are exposed to strong currents
and consist of shifting sand. No vegetation
was found on these shifting I:-Ottoms. The
proposed dredging would not have significant
adverse effects on the marine biological
resources.

The Attorney to the Board recommended that in the future
the applicants for Agricultural Zoning, who may be denied agricultural
zoning, should be notified of the time of the Agricultural Zoning
Meeting.
On Motion of Commissioner Massey, second of Commissioner
Dritenbas, she Board unanimously accepted the bid of Arnold Ford
in the bid opening of 9:30 in the amount of $1,893.69 as being the
lowest and best bid.
Chairman Bogosian returned to the meeting and again took
the chair.
On Motion of -Commissioner Loy, second of Commissioner
• Dritenbas, the Board unanimously and retroactively approved the
out of County travel of Valentyne Brennan, Planning Director, to
Jacksonville on September 26,27 and 28 to attend a'.Conference of ,
the Florida Association of housing and Redevelopment Officials;
and the out of County travel of Thomas J. Leonard, pla:niing:Aide,
to Melbourne for State Road #60 Study; to Gainesville on July 27
to attend a State Soil Conservation Service Meeting; and to Orlando
on August 4 to attend a Meeting with the Environmental Protection
Agency.
Motion was made by Commissioner Loy, second by Commissioner
Dritenbas, and the Board unanimously approved out of County travel
to Tallahassee on October 15, 1971,by Rosemary Richey, Supervisor
• of Elections, to attend a Meeting called by the Division Director
of Elections.
A Motion was made by Commissioner Loy, seconded by
Commissioner Massey, and the Board unanimously approved out of
County travel of George Stokes, County Service Officer to St.
Petersburg on October 13, 14, and 15 to attend the County Service
Officers Midwinter Conference.

A Motion was made by Commissioner Loy, seconded by
Commissioner Dritenbas, and the Board unanimously approved out of
County Travel by L. S_ Thomas, Deputy Clerk, to Cocoa on October 19
and 20 to attend the Administrative Management Seminar.
On a Motion made by Commissioner Dritenbas, seconded by
Commissioner Loy, the State Witness Payroll, County Court, August
1971 Term, in the amount of $142.64 was unanimously approved.
A proposed Ordinance in regard to the ban of the use of
firearms on County Roads was referred to the Attorney.
A Motion was made by Commissioner Dritenbas, seconded by
Commissioner Loy, and unanimously carried that the Application for
Library Grant be signed and submitted.
A letter was received from William McClure, Superintendent
of Schools,that the work- to be done on 20th Avenue adjoining
Elementary School A be given highest priority. The Administrator
was authorized to proceed with plans for designing the project,
and revision of the drainage ditches.
The several, bills and accounts against the County, having
been audited, were examined and found to be correct were approved
and warrants issued in settlement of same as follows: General Fund,
Nos. 3135 to 3200 inclusive; Road and Bridge Fund, Nos. 1646 to 1671
inclusive; Fine and Forfeiture Fund, Nos. 500 to 507 inclusive;
Capital Outlay Fund, No. 101. Such bills and accounts being on
file in the office of the Clerk of the Circuit Court, the warrants
so issued from the respective funds being listed in the Supplemental
Minute Book as provided by the rules of the Legislative Auditor,
reference to such record and list so recorded being made a part of
these minutes.
There being no further business, on Motion made, seconded
and carried, the Board adjourned at 12:10 o'clock P. M.
