The Board of County Commissioners of Indian River County,
Florida met in regular session at the Courthouse, Vero Beach, Florida
on Wednesday, November 24, 1971 at 8:30 o'clock A. M. Present were
Richard P. Bogosian, Chairman; Alma Lee Loy, Vice Chairman; D. B.
McCullers, Jr.; Jack U. Dritenbas and Edward J. Massey. Also present
were Jack G. Jennings, County Administrator; Paul D. Burch, Attorney
to the Board of County Commissioners; James Reams, Deputy Sheriff;
and L. S. Thomas and Janet N. Turpan, Deputy Clerks.
The Chairman called the meeting to order and asked if
there were any additions or corrections to the minutes of the regular
meeting of November 10, 1971. There were none and upon a Motion
made by Commissioner Massey, seconded by Commissioner McCullers,
the minutes of the regular meeting of November 10, 1971 were
unanimously approved as written.
Mr. Van Murphy of the Division of Forestry appeared before
the Board and advised them that any person who wished to do open
burning would be required to call the Division of Forestry before
the burning.
A Motion was made by Commissioner McCullers, seconded by
Commissioner Massey and unanimously carried that authorization be
given for advertisement for public hearing before the Zoning Board
for a zoning change from C -1B Restricted Commercial District to
C-1 Commercial District as requested by Dan K. Richardson.
A Motion was made by Commissioner Massey, seconded by
Commissioner Dritenbas and unanimously carried that authorization
be given for advertisement for public hearing before the Board of
County Commissioners for a zoning change from C=l Commercial District
to R-lTM Transient Mobile Home District as requested by McKee -Sexton
Land Company.

A Motion was made by Commissioner Loy, seconded by
Commissioner McCullers and unanimously carried that authorization
be given for advertisement for a public hearing before the Board of
County Commissioners for a zoning change from M-1 Industrial District
to R-1 Single Family District as requested by the Church of the
Deliverance.
A Motion was made by Commissioner McCullers, seconded by
Commissioner Massey and unanimously carried that authorization be
given for advertisement for a public hearing before the Zoning Board
for a zoning change from Agricultural and M-1 Industrial to R-lMP
Mobile Home Park District as requested by J. Vincent Sparks.
A Motion was made by Commissioner McCullers, seconded by
Commissioner Massey and unanimously carried for site plan approval
for a citrus fruit packing house by Gulf Western Food Products Company -
at the site of the old.sugar plant in Fellsmere.
A Motion was made by Commissioner Massey, seconded by
Commissioner McCullers and unanimously carried for site plan approval
to place a service station on SR 60 at 195 as requested by Texaco, Inc.
A Motion was made by Commissioner Dritenbas, seconded by
Commissioner Loy and unanimously carried that the request by Hugh
Smith for site plan approval to use an undersize mobile home be
denied as presented.
A Motion was made by Commissioner Massey, seconded by
Commissioner Loy and unanimously carried that site plan approval be
given to Ervin Cartwright to place a triplex .n Hillside Subdivision
on King's Highway.
A Motion was made by Commissioner Massey, seconded by
Commissioner Loy and unanimously carried that special exception be
made to grant the request of Eugene and Mildred Griffith to place
a mobile home on agriculturally zoned property.
A Motion was made by Commissioner Massey, seconded by
Commissioner Loy and unanimously carried that authorization be
given for public hearing before the Zoning Board for a zoning change
from C -7A Restricted Commercial to M-1 Restricted Industrial District
as requested by Indian River Exchange Packers, Inc.

A Motion was made by Commissioner Dritenbas, seconded by
Commissioner Massey and unanimously carried that site plan approval
be -given to Ziebart Rustproofing to construct a metal building
on Lots 1, 2 and 3 Casa Rio Subdivision.
A Motion was made by Commissioner Massey, seconded by
Commissioner Loy and unanimously carried that site plan approval be
given for a service station at 17th Street and U. S. #1 as requested
by the Johnson Oil Company, Inc.
Dewey Walker, County Zoning Inspector, reported on zoning
violations.
The hour of 9:30 o'clock A. M. having passed, the Deputy

The Chairman then asked for receipt of bids in accordance with the .
Notice and the following sealed bids were received, opened and read:

The Administrator then took the bids for evaluation.
eharles Zimmer, Mayor of Sebastian, and Mr. Bird of Indian
River Farm Supply appeared before the Board and Mayor Zimmer reported
that the International Farm and Tractor Company had.been very
cooperative in meeting special requirements for the two fire trucks
bid in the bid opening of November:. 10, and it was his recommendation
that the bid of Indian River Farm Supply be accepted. A Motion was
made by Commissioner Massey, seconded by Commissioner Dritenbas and
unanimously carried that the bid of Indian River Farm Supply, bid in
the bid opening of November 10 in the amount of $13,000.00 for two
International Loadstars be accepted.
A Motion was made by Commissioner Massey, seconded by
Commissioner McCullers and unanimously carried that the offer of
the School Board to purchase used Addressograph Equipment at the
price of_$100.00 be.accepted with the approval of the Tax Assessor
and -the Tax Collector.
The Administrator reported that a letter had been written
to the Indian River Menotial Hospital'Staff requesting a meeting
to set up hospital policies but that to date no answer has been
forthcoming.
A Motion was made by Commissioner Dritenbas, seconded by
commissioner McCullers and unanimously carried that the out of
County travel of valentyne Brennan, City -County Planner,to Jacksonville
on December 8 through 11 to attend an Florida Planning and Zoning
Association Conference be approved.

WHEREAS, the Zoning Commission of Indian River County,
Florida, did, after public hearing make its final report recommending
changes and additions to the Zoning Resolution of Indian River
County, Florida; and
WEEMS, this Board did publish its notice of said

A Motion was'made by Commissioner Massey, seconded by
Commissioner McCullers and unanimously carried that approval of
the Application for Participation in the Federal Flood Insurance
Program be deferred until December 9th in order that the Application
might be reviewed by the Attorney.
A Motion was made by Commissioner Massey, seconded by
Commissioner McCullers, and the Board unanimously accepted the bid
of Pippin,Tractor and Equipment, Inc. bid in the bid opening of
9:30 o'clock for two tractors and mowers in the amount of $5,996.00
as being the lowest and best bid.
A letter from Harold S. Winter offering for sale to the
County, the lot adjoining the Wabasso Beach Park property, at a
cost to the County of $35,000.00 was to be taken under advisement.
The Administrator reported that the American Cancer
Society would like to be given from 45 to 60 minutes of the employees'
time. Arrangements were to be made by the department heads.
It was reported that there would be a meeting of the
Legislative Delegation on Saturday, January 8, at 2:00 P. M.
Items for the agenda should be mailed to Jane Robinson, Chairman of
the Delegation, prior to the meeting.
A request by Urban Development Utilities for approval
for an increase in rates was to be researched by the Attorney prior
to action by the Board.
A Motion was made by Commissioner Massey, seconded by
Commissioner McCullers and unanimously carried that the Blanket
Bond covering Road and Bridge Employees be discontinued.
ThenBoard adjourned at 12:00 o'clock Noon and reconvened
at 1:30 o'clock P. M.

Chester Clem, Attorney, appeared in opposition to a
15toposed Firearms Ordinance and submitted a petition of 572
names. After considerable conversation, a Motion was made by
Commissioner McCullers, seconded by Commissioner Massey and
unanimously carried that the Board take no action as to the
proposed ordinance.
Commissioner Dritenbas then left7the meeting.
Upon a Motion made by Commissioner McCullers, seconded
by Commissioner Massey, the Board unanimously approved travel of
the Administrator and an -employee to Tallahassee after the Thanksgiving
Holiday.
The Administrator reported that he has received a letter
from the Department•of Transportation that they would install no
culverts or make no cut-outs on secondary roads without the approval
of the Board of County Commissioners 'in Indian River County.
Upon a Motion made by Commissioner McCullers, seconded
by Commissioner Massey and unanimously carried, the Board approved
settlement, as recommended by the Attorney, in the condemnation suit
to acquire Lots 8 and 9, Block 30, original Town, as follows:
$37,500.00 To Defendant
1,200.00 To Defendant's Appraiser
1,800.00 To Defendant's Attorney
100.00 To B. T. Cooksey for tax collection
150.00 To John Sherman, County Appraiser

A Motion was made by Commissioner Loy, seconded by
Commissioner McCullers and unanimously carried that the Board
accepts and approves their Annual Report as submitted by the
Clerk of the Circuit Court.
The Sheriff filed with the Board a statement of his
appointments of Ralph Lee Latimer, Jr. whose voting precinct is
1A; of Charles William Brumley, Jr. whose voting precinct is 2;
and of Lonnie S. Waldron whose voting precinct is 1C; as Deputy
Sheriffs and the said Deputy Sheriffs filed their bonds with the
Clerk of the Circuit Court, which was presented to the Board. On

were approved and ordered filed with the Clerk of the Circuit

approved.
A Motion was made by Commissioner Massey, seconded by
Commissioner Mccullers and the applications for pistol permits
of Dale W. Campbell, Herbert F. Edelberg and of Rufus Tillis
were unanimously approved.
On a Notion made by Commissioner Loy, seconded by
Commissioner McCullers, the State Witness Payroll for the County
Court, August Term in the amount of $205.00; the State Witness
Payroll for the Circuit Court, Fall Term in the amount of $609.32;
the State Witness Payroll for the County Court, November Term in
the mount of $142.44;. and the State Witness Payroll for the County
Court, August Term in the amount of $178.96 were unanimously
approved.
On a Motion made by Commissioner Massey, seconded by
Commissioner McCullers, the following corrections in assessed
valuation and taxes -were unanimously approved:
