BE IT ORDAINED by the Board of County Commissioners
of Indian River County that Ordinance No. 71-3 is hereby amended
as follows:
Section 7. R -1A Single Family District
Add new Paragraph (B) (3) to read as follows:

This Ordinance was adopted on an emergency basis
by unanimous vote and is to be effective immediately.

MCCULLERS, THE BOARD UNANIMOUSLY GAVE TENTATIVE APPROVAL OF THE
PLAT OF HIDDEN COVE SUBDIVISION AS PRESENTED, SUBJECT TO ADDING
THE FOLLOWING: PRIVATE ROADS AND THE SEWAGE TREATMENT PLANT ARE
NOT THE RESPONSIBILITY OF THE COUNTY,

RESOLUTION NO. 72-35
WHEREAS, Indian River County has entered into an agreement
with McCullers Well Drilling, Incorporated, for the construction of a
ten inch artesian well, and
WHEREAS, the Board of County Commissioners of Indian River
County have required as security for the faithful performance of the
contract and one year's guarantee, a bond in the amount of Five Thousand
Dollars, and
WHEREAS, an agreement has been reached between the Board
of County. Commissioners of Indian River County and Billy J. McCullers,
President of McCullers Well Drilling, Incorporated, and. Mrs. James
Ada McCullers, for the deposit of Five Thousand Dollars in Savings
Account Certificate No. 3483 in the First Federal Savings & Loan
Association of Iridian River County,
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Indian River County that Richard P. Bogosian,
Chairman, is authorized to sign the signature card on behalf of Indian
River County, and
BE IT FURTHER RESOLVED that, in the event said ten inch
artesian well is constructed in accordance with county specifications
and is maintained for a period of one year, Richard P. Bogosian'is
authorized to sign a withdrawal slip and the Five Thousand -Dollars is to
be returned to Billy J. McCullers and Mrs. James Ada McCullers.

WBEREAS, under the provisions of Section 206.60 Florida Statutes
and Section 9, Article XII Constitution of the State of Florida, the
Florida Department of Transportation will receive a portion of the
surplus of this.County's pro -rata share of the Sth and 6th cent gasoline

tax to be used within this County; and
ImREAS, under the provisions of Section 339.08 and Section
339.081, Florida Statutues, the expenditure of such funds shall be as
prescribed by regulations of the Department and pursuant to an adopted

adopted.
WHEREAS, the Department of Transportation has located and proposes to con-
struct and improve State Road !0! , Section , in
ICY" HIM County, Florida, and
WHEREAS, in order for the Department of Transportation to further and
complete said project, it is necessary that certain lands now owned by
ISOM RIVFR County be acquired by the State of Florida for the use and

benefit of the Department of Transportation of Florida-- and
. WHEREAS, the Department of Transportation having requested said County to
execute and deliver to the Department of Transportation a deed or deeds in favor
of the State of Florida, conveying all rights, title and interest that said
County has in and to said lands required for right of way for said State Road,
and said reqaest having been duly considered.
NOW, THEREFORE, BE IT RESOLVED by the Board' of County Commissioners of
said County that the Chairman and Clerk of said Board be and they are hereby
authorized and directed to make, execute and deliver to the Department of
Transportation a deed or deeds in favor of the State of Florida conveying all
right, title and interest of said County, in and to said lands owned by said
County required for right of way for said State Road.

Re: Work Release Program
Dear Mr. Bogosian:
It now appears feasible for Indian River County to enter the
Work Release Program as provided in accordance with Florida
Statutes 948.07. This program would enable selected prisoners
agreed to by the Court, the Sheriff's Department and the Florida
Probation and Parole Commission, to be released in a work
situation whereby he would leave the confinement at the Indian
River County jail and be allowed to maintain full time, steady
employment, contributing his income to his family and returning
a portion to be paid toward his.own confinement costs.
The individual so released ,under these conditions would.return
each night to the Indian River County jail.
The major factor which now allows the county to enter into this
program is the fact that the Sheriff's Department now has addi-
tional personnel to handle the'necessary additional' duties required
in such a programa
It is the feeling of all agencies involved in carrying out this
program that there are many benefits. There is no question but
that. for some individuals incarceration is of benefit in. correcting
anti -social behavior. The program will provide incarceration
without causing loss of employment, and thus placing a family on
Welfare for those carefully selected individuals entered into this
program.
it is the recommendation of Judge D. C. Smith, Senior Circuit
Judge in the Nineteenth Judicial Circuit, Sheriff Sam T. Joyce,
Sheriff of Indian River County, and J. Vernon Wright, District
Supervisor of the Florida Probation and Parole Commission,
that the County Commission now enter this' -,program.
To enter into this program the County Commission needs only to
make.a motion and vote affirmatively on the motion to enter
into the Work Release program as outlined under Florida
Statutes 948.07.
