ORDINANCE NO. 86- 56
AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA,
AMENDING SECTION 24: OFF-STREET PARKING AND
LOADING REGULATIONS, OF APPENDIX A OF THE CODE OF
LAWS AND ORDINANCES, KNOWN AS THE ZONING CODE,
PROVIDING FOR LIMITED REDUCTION OF REQUIRED
PARKING SPACES FOR THE PROTECTION OF TREES:
PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES;
CODIFICATION; SEVERABILITY; AND EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY,
FLORIDA that,
A new paragraph, Section 24(b)(8) Appendix A of the
Code of Laws and Ordinances, Indian River County is hereby
created and shall read as follows:
The number of required parking spaces may be reduced
where a protected tree on a given site, as defined by
the County tree protection ordinance, is located
within the par area. The allowable reduction of
spaces shall be one space for each protected tree up
to a maximum of ten percent (10%) of the total number
of reauired parking spaces after meeting the
following requirements:
1) the off-street parking area shall contain_ a_
minimum of ten (10) parking spaces,
2) the applicant shall agree to replace each
protected tree with a parking space in the event
of the death or removal of such trees used for
parking space reduction.
The Planning & Zoning Commission shall review and
authorize all parking space reductions based upon
protection of trees.
REPEAL OF CONFLICTING PROVISIONS
All previous ordinances, resolutions, or motions of
the Board of County Commissioners of Indian River County,
Florida which conflict with the provisions of this ordinance are
hereby repealed to the extent of such conflict. All Special
Acts of the legislature applying only to the unincorporated
portion of Indian River County and which conflict with the
provisions of this ordinance are hereby repealed to the extent
of such conflict.

The provisions
of
this ordinance
shall be
incorporated into
the Code of
Laws and Ordinances
of Indian
River County and the word "ordinance" may be cnangea to
"section", "article", or other appropriate word, and the
sections of this ordinance may be renumbered or relettered to
accomplish such purpose.
If any section, subsection, sentence, part thereof,
paragraph, phrase, or word of this ordinance is for any reason
held to be unconstitutional, inoperative or void, such holdings
shall not affect the remaining portions of this ordinance, and
it shall be construed to have been the legislative intent to
pass the ordinance without such unconstitutional, invalid or
inoperative part.
SECTION 5
EFFECTIVE DATE
The provisions of this ordinance shall become
effective upon receipt from the Florida Secretary of State of
official acknowledgment that this ordinance has been filed with
the Department of State.
Approved and adopted by the Board of County
Commissioners of Indian River County, Florida, on this 6th day
of August , 1986.
