HomeMy WebLinkAbout1988-011/4/88 dave LR -Planning DN/vj ORDINANCE NO. 88- 1 AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR THE PROPERTY DESCRIBED HEREIN, AND PROVIDING FOR EFFECTIVE DATE. WHEREAS, The Planning and Zoning Commission, sitting as the local planning agency on such matters, has held a public hearing and subsequently made a recommendation regarding this rezoning request, and WHEREAS, The Board of County Commissioners of Indian River County, Florida, did publish and send its Notice of Intent to rezone the hereinafter described property; and WHEREAS, The Board of County Commissioners has determined that this rezoning is in conformance with the Land Use Element of O the Comprehensive Plan of Indian River County; and WHEREAS, The Board of County Commissioners has held a public hearing pursuant to this rezoning request, at which parties in interest and citizens were heard, NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian River County, Florida, that the Zoning of the following described property situated in Indian River County, Florida, to -wit: All of Government Lot 2 of Section 3, Township 32 south, Range 39 east, less and excepting the following described property: beginning at the southwest corner of Government Lot 2, run north 1320 feet; thence run east 330 feet, thence run south 1320 feet, thence run west 330 feet to the point of beginning, and less the southern most 10 feet of Government Lot 2 as recorded in O.R. Book 99, Pg. 646, Indian River County. All lands lying and being within Indian River County. Be changed from A-1 Agricultural District, to RS -3, Single -Family Residential District. Situated within the above described property exists 2.8 acres, more or less, of Marginal Environmentally sensitive land (see Attachment 1) and 22.83 acres, more or less, of land designated as Environmentally Sensitive (see Attachment 2). That land described in Attachment 1 has been determined to be mitigatable wetland and may be developed at three units/acre provided approval and permits have been obtained from all appropriate jurisdictional agencies. That land described in Attachment 2 designated Environmentally Sensitive under the provisions of the Land Use Element of the comprehensive plan may not be developed in excess of one unit/acre.
