HomeMy WebLinkAbout1986-304 I l AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR THE PROPERTY DESCRIBED HEREIN, AND PROVIDING FOR EFFECTIVE DATE. WHEREAS, The Planning and Zoning Commission, sitting as the local planning agency on such matters, has held a public hearing and subsequently made a recommendation regarding this rezoning request; and WHEREAS, The Board of County Commissioners of Indian River County, Florida, did publish and send its Notice of Intent to rezone the hereinafter described property; and WHEREAS, The Board of County Commissioners has determined that this rezoning is in conformance with the Land Use Element of the Comprehensive Plan of Indian River County; and WHEREAS, The Board of County Commissioners has held a public hearing pursuant to this rezoning request, at which parties in interest and citizens were heard; NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian River County, Florida, that the Zoning of the following described property situated in Indian River County, Florida, to -wit: That portion of the following described parcel lying West of the West Right-of-way of Old Dixie Highway, THE SOUTH 440 FEET OF THE NORTH 880 FEET OF THE EAST HALF OF THE SOUTHEAST QUARTER OF THE NORTHEAST QUARTER OF SECTION 25, TOWNSHIP 33 SOUTH, RANGE 39 EAST, LESS THE WEST 400 FEET THEREOF, AND ALSO, THE SOUTH 440 FEET OF THE NORTH 880 FEET OF THE SOUTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 30, TOWNSHIP 33 SOUTH, RANGE 40 EAST. And less and except the following described property: Begin at a point lying 440 feet South of the Northeast corner of the Southeast quarter of the Northeast quarter of Section 25, Township 33, South, Range 39 East, From the Point of Beginning run South 891 50' 20" East and along the North line of the South 440 feet of the North 880 feet of the Southwest quarter of the Northwest quarter of Section 30, Township 33 South, Range 40 East, a distance of 518.75 feet; thence run South 180 57' 25" East a distance of 465.72 feet to a point on the South line of the said South 440 feet of the North 880 feet; thence run North 890 50' 04" West, along said South line, a distance of 670.61 feet to a point of intersection, said point lying on the West line of Section 30, Township 33 South, Range 40 East, said line being also the Range line, thence run South 890 56' 07" West along the South line of the South 440 feet of the North 880 feet of the East half of the Southeast quarter of the Northeast quarter of Section 25, Township 33 South, Range 39 East, a distance of 263.56 feet to a point lying on the East line of the West 400 feet of the South 440 feet of the North 880 feet of the East half of the Southeast quarter of the Northeast quarter of Section 25, Township 33 South, Range 39 East; thence run North 00° 00' 06" East, along said East L ORDINANCE NO. 86- 30 line a distance of 439.91 feet to a point on the North line of the said South 440 feet on the North 880 feet; Thence run North 891 55' 20" East, along said North line a distance of 264.11 feet to the Point of Beginning. Said parcel lying in Indian River County, Florida and containing 2.97 acres more or less. Be changed from RS -6, Single -Family Residential District, to RM -6, Multiple -Family Residential District. All with the meaning and intent and as set forth and described in said Zoning Regulations.
