AN ORDINANCE OF INDIAN RIVER COUNTY,
FLORIDA MAKING ADDITIONS, DELETIONS AND
AMENDMENTS TO ARTICLE IV (ELECTRICAL
CODE), CODE OF LAWS AND ORDINANCES OF
INDIAN RIVER COUNTY; PROVIDING FOR
CONFLICTING PROVISIONS, PROVIDING FOR
SEVERABILITY; PROVIDING FOR INCORPORATION
IN CODE, AND PROVIDING FOR EFFECTIVE
DATE,
BE IT ENACTED by the Board of County Commissioners of
Indian River County, Florida:

SECTION 1.
Section 4-44, Code of Laws and Ordinances is amended to
The National Electrical Code published by the National
Fire Protection Agency, 1000 1987 edition, as adopted from
time to time by the State of Florida is hereby adopted by
reference as the electrical code for Indian River County,
Florida, subject to the limitations, exceptions, and
modifications set forth herein.
SECTION 2.

SECTION 4..
Subsection 4-53(4), Code of Laws and Ordinances is
amended to read.
Sec. 4-53. Powers and Duties of Building Official.
(4) All electrical. installations, regardless of type,
which are unsafe or which constitute a hazard to human life,
health or welfare are hereby declared illegal and shall be
abated by repair and rehabilitation. or by demolition in
accordance with the procedure as outlined in section 101101
102_4, unsafe buildings, of the Standard Building Code, as
modified by this article.
SECTION 5.
Section 4-55, Code of. Laws and Ordinances, is amended
to. read.
Sec. 4-55. Liability,:
Any officer'or employee, or member of the Indian River
County_ Building_ Code board of adjustments and appeals,
charged with the enforcement of any of the codes established
by this article, acting for the applicable governing body in
the discharge of his duties, shall not thereby render
himself _liable personally for ordinary negligence, and he is
hereby relieved from all personal liability for ordinary
negligence for any damage that may occur to persons or
property as a result of any act required or permitted in the
discharge of his duties. Any suit brought against any
officer or employee because of such act performed by him in
the. enforcement of any provisions of such codes shall be
defended by the county attorney (referred to in place of
department of law) until the final termination of the

electrical code.

offers electrical services in Indian River County shall be
licensed in accordance with the provisions of chapter 4601

SECTION -15.
Conflicting Provisions.

Special acts of the Florida legislature applicable only
to unincorporated areas of Indian River County, County
ordinances and County resolutions, or parts thereof, in
conflict
with
this
ordinance
are hereby
superseded
by this
ordinance
to
the
extent
of .such
conflict.
SECTION 16.
Severability.
If any section, or if any sentence, paragraph, phrase,
or word of this ordinance is for any reason held to be
unconstitutional, inoperative, or void, such holding shall
not affect the remaining portions of this ordinance, and it
shall be construed to have been the legislative intent to
pass the ordinance without such unconstitutional, invalid or
inoperative part.

This ordinance shall be incorporated into the Code of
Laws and Ordinances of Indian River County and the word
"ordinance" may be changed to "section", "article", or other
appropriate word and

ordinance

renumbered
of official
or relettered
to accomplish
such
purposes,
SECTION -18,
Effective Date,
This
ordinance shall become effective
upon receipt
filed
from
the Secretary
of State of the State. of Florida
of official
acknowledgment that this
ordinance has been
filed
with the
Department of State.
Approved and adopted by the Board of County
Commissioners of Indian River County, Florida, on this 1st
day Of& December , 1987.
This ordinance was advertised in the Vero Beach
Press -Journal on the 7th day of November 1987, for a
public hearing to be held on the lst day of December ,
1987, at which time it was moved for adoption by
